They're both pretty stupid and shortsighted, 30 grand apiece and no longer being on the mortgage would probably do it. Jackson isn't a good enough lawyer to be able to do his own name change and Becky can't think beyond her next Disney trip.

The only Ventura County record I see relating to mortgages is the 2022 deed between the mortgage company and the three of them. Not sure there's a strong case that they peaced out of the mortgage.

If someone else more sophisticated with property records wants to correct me, feel free.

That's kindof where my train of thinking was going.
Back in the early 2000's, my wife and I went to refinance our home. We wanted to put her name on the title as well this time (I bought the house before we got married), but the agent said her credit was worse than mine (unemployed student/artist), and if we were to add her to the refinance paperwork, it would have cost us MORE....so we just refinanced the existing loan in my name only.

It makes zero financial sense to put all three of them on the lease if it would only hurt them all financially in doing so.

Regardless of how they feel about Becky, the Gerbers aren't going to stand by and watch Jackson get screwed over. It's not what affluent families do. Daniel has a highish income, but the Gerber family has wealth and you can guarantee Jackson's legal interests are not going unrepresented. By Becky's own admission, Mumma Gerber has been keeping them afloat financially. As if she's not going to pay for a lawyer to sort out his legal mess.

Jackson was pretty consistently employed for a number of years until after they purchased the house. We also have no idea what he receives in the way of unearned income, so I wouldn't assume he has shit credit now, let alone when the house was bought.

Likewise, we know nothing about the contributions of each towards the deposit on the house.

They've never lived a lifestyle commensurate with their assumed incomes, not even when Jackson was a student and during the periods when Daniel was jobless. It's very possible there has always been an additional source of income Becky doesn't mention.

All three are on the deed for the sale of the house and the security deed to the lender and no other deeds show up under the names. I think it's clear that on paper they own the home as joint tenants which means equal shares. But California allows the actual interest of the parties to be put at issue in a partition action regardless of what's on the deed, which means that Daniel would have the option to say this is actually a TIC and he owns most of it. No legal marriage + one person paying nearly all the costs could be good evidence of that. Daniel can also ask for equitable re-apportionment of the proceeds even without an order finding a different form of ownership.
Depending on how much of the costs Daniel has paid, it's possible both lawyers (seems like each side has one) know that he would have a decent chance of walking away with the vast majority of the proceeds of a sale. That would weaken the Gerber's bargaining position.

A guess about what's going on: Daniel prefers a negotiated solution because recent CA law will no longer allow him to force-buyout the others and he likes the property so he wants to keep it. The others have been advised its better because they might get very little after a long and expensive partition trial.

Regarding the post a few above, back when the loan was created I believe they were all employed. It would have made sense to put all three on the deed.

I really hope they're true. There's not much point in winning against someone with no assets, but holy shit Becky would seethe if a judgement against her meant her losing her share of the house (and maybe even Jackson's, too - not sure how community property works in California).

Poppy is a BPD troon that also accused his ex of rape and abuse as revenge for a break up. The ex is currently suing him for defamation. As of the last update, he is dangerously close to a default judgment. I don't know how different the defamation laws in California and New York are. But if they are similar, Becky is in trouble.

In the Poppy case, every single one of his tweet storms were considered a separate count of defamation. Racking up the total complaint to 105k in just pro se damages. Keep in mind, Poppy wasn't dumb enough to go after his ex's employment like Becky currently is.

Poppy also tried the pseudonym game, but he wasn't dumb enough to just shorten the ex's name. He started referring to her as "the moth". However, this still didn't work, and all those tweets were still included in the defamation filings.

It will be interesting to see how vindictive Daniel wants to be, and how generous Mama Gerber will be with lawyer fees.
