He can appeal to the state supreme court, then the U.S. Supreme Court (lol). After that, he can file state and federal habeas corpus petitions. At the state level, it's called post-conviction relief.

However, he isn't entitled to legal representation for free in any of that. I think Pennsylvania does provide one direct appeal, but doesn't require the public defender to waste time appealing hopeless cases to the Supreme Court.

I have to say this is one genuinely pathetic attempt at an appeal. Whoever filed this really didn't give a shit about Nick. Also, as I pointed out way back when, there was really nothing to appeal. The prosecutor and judge did this by the book, and there was nothing to appeal. There's always the lame old ineffective assistance of counsel Hail Mary, but that wasn't even tried. As @Saul Goodman reported way back when, Danny Kaye was actually rather aggressive in going after the victim, but when she didn't fall apart, chose not to do that in front of the jury.

Nick was pretty much fucked as soon as what he'd done was in front of a competent investigator.

This evidentiary issue was really, really weak, though. It's almost like even his own lawyer thinks he's right where he belongs. IMO if there is an ineffective assistance of counsel issue, it was on just letting in a completely unauthenticated log with no custodian of records and no foundation whatsoever establishing it as legitimate, but that was raised neither at trial nor on this appeal.

Anyway a theme song for the rest of Nick's life.

I remember seeing a picture of AO with Nick on ED before it got taken down. Her teeth were yellow, but nowhere near as bad as his.

Yeah, but keep in mind that he's quite a few years older than she is. Apparently the mother thinks that dental care is a rip off or some garbage like that.
