As in its not necessarily something that an educated, experienced, rational person like a judge would just dismiss on hearing it?

I ask because so much of Fatrick’s 100% certain claims are usually things which would annoy a judge.

And this theory is nonsensical. If no constitutional violations even occurred, and they didn't, then a municipality cannot be vicariously liable for constitutional violations that never even occurred.

I am honestly somewhat confused at the judge's decision not to dismiss the case entirely.

I am sort of hoping the judge shares my opinion that tolerating eternal swatting is actually a violation of Constitutional rights, but that it wasn't "clearly established law," so Rick wins a victory that benefits future swatting victims, but doesn't get a dime.

That has always been my favorite outcome.

(If you know Section 1983 law you know what I'm talking about.)

I do think the judge is taking this as a "this case is shit, but you fuckers should think about the question and get a plan together" perspective.

I'm pretty sure the judge already decided that some of them did actually occur, just that the officers can't be held liable personally. I think they were fairly minor though (it was a huge document and I don't remember it vividly), shit like peeping into his cellar without valid probable cause, so even if he wins I would be surprised if the award would be anything substantial. IANAL though, obviously.

On a related note, I am now thoroughly convinced that each and every swatting at Niki's house was staged by Patrick. It is not a normal human response to rush out of your house naked, gesticulating wildly, while police try to move your wife to safety. Like, swamp ass hot.) Possibly on the first day. Piggy will be livid about something that the judge ruled, or some other aspect of the proceedings. We need the video of that, if filming is allowed in the courthouse. It won't be in the court room. Don't even try.
