I just returned to the country in the early hours of this morning, so please forgive me if things are a bit delayed in getting sorted out.

I've received responses from the Vtuber in question and Good Smile Company, and we plan to proceed in a way that maximizes the protection of my rights.My stance is to seek amicable discussions through open communication.

The models I create are products that anyone can use if purchased on BOOTH.While they are primarily designed as avatars for VRChat-driven purposes,under the terms of use, as long as the form doesn't allow third parties other than the purchaser to use them, I also permit avatar use outside of VRChat.Additionally, personal Vtuber activities are allowed.

However, just because someone buys a model on BOOTH doesn't mean they own all the rights, and since it's essentially a form of licensing the model,if revenue is generated through general Vtuber activities like videos or streaming, I request credit notation.

Going further from there, for activities on a larger business scale that go beyond general Vtuber activities like videos or streaming—such as producing character merchandise—our terms of use require prior contact, and after review, I provide guidance on credit notation.

In most cases, these don't scale that large, and when individual Vtubers handle production and sales directly without going through a company, things like character merchandise sales rarely become an issue.

That said, when it's not an individual—such as when there's an affiliated agency, or use by a company or corporation—even if it's not commercial use, I require accurate details on the intended use and prior contact.The issue I raised was that, despite the Vtuber not owning the copyright to the character, they proceeded with a project through a contract with a company without any report to the original creator of the character, which became the problem.

As a result, for this character merchandise project, I requested a full halt to the production schedule.I have no need for royalties or incentives; I simply want to protect the copyright of the character.

If I were to allow this aspect—like through copyright license sales—it would create individual copyrights for derivative characters based on my models, potentially dragging others who use the same base model into complicated copyright disputes.

I want people to recognize that my BOOTH characters are shared models, not models for just one person.Since they're not a complete original design of your own, no matter how much modification is done, traces of the original creator remain, so I cannot relinquish the copyright.

Terms of use vary for each creator and model, so please be sure to check them in advance whenever using a model.

I highly doubt of her team scrubbing socials would also entail that she's changing her name. after all as shared in this thread before, She even have her name and +2 others copyrighted/trademarked.

She already entered a settlement with the artist who made her VTuber model a year ago when she was threatened with legal action after she hired a company in Japan to make figures of her model which is where the model artist is based which is how he found out about it.

Everyone is talking about Filian so its working.
They'll announce some kind of timer video in the next week or two thats counting down to something.
Which of course will be the redebut.

Back when I used instagram reels I had to block not one, not two but FIFTY NINE accounts that were just reposting clips of this fucker. Was Filian signed with a group/agency? I know when some people signed with Hololive for example, they were required to essentially remove every trace of their previous vtuber along with a prohibition on explaining why they were suddenly graduating.,

There is 0 chance that Filian is joining a traditional Idol organization. Not just because I imagine her singing sounds like a dying whale but also because she is a very large established creator that doesn't need to add in revenue sharing with more people.

She made edgy jokes but never acknowledged the backlash. There was one she chained the keanu "you're breathtaking" meme into "that was a george floyd quote". But didn't get a ban or anything

She also was using a vr chat model and was making merch with it, when word got to the creator when she had a deal to make a figure or plushie (mightve been a nendroid?) then the model's creator took legal action and stopped that. Which is why she's getting a new look currently.

She was collabing with a couple of well known Russian vtubers, in particular xKamysh who is open about her service in Russian Ministry of Defense.
That fact made WePlay Studio, a company that worked with Filian to host Vtuber Awards, publicly cut all ties with her, because most of WePlay management are hohols and anything related to Russia makes them seethe. Though of course it's a very convenient position to take when you're actually not in Ukraine and aren't going to get forcefully drafted to fight for Jewlensky's coke supply and Mindich's golden toilet.
