The motion to reconsider probably won't be granted (they rarely are) even though the arguments in it are solid, but a denial of a qualified immunity defense can always immediately be taken to an interlocutory appeal. I'm at a loss as to why the judge thinks there can be a failure to train or supervise claim while also claiming the police did nothing wrong because there is no clearly established law on the issue, but hey he's a federal judge and I'm just some bozo on the Internet, so maybe he's right.

I have no idea what a judge’s day to day would be but thinking from the perspective of someone who has dealt with professional moaners and pedants who are happy to keep coming back with fresh versions of the same complaint.
I would guess that this judge has figured out Patrick’s mode of operation and suspects that if this guy doesn’t get his day in court, he will re-litigate until he does.

To head off potentially years of the court system and city having to spend resources looking at it again and again, he could have figured that just letting Fatrick have his chance to oink at a judge, to be told “the city will write some rules, but no you can’t have a million dollars and the ability to decide whether or not the police visit your home.”
Perhaps there will still be appeal processes he can lean on, but I am sure that is less overall hassle than fresh cases over this every quarter.
