The judge forbids Alex from contacting him or the court. I'm sure that will stop him... *sigh*
Alex has obeyed the court before with the TRO over the DMCAs, so he should be smart enough to listen to a no-contact order.

It is blocking him from talking to his favorite copyright attorney though, so I'm not holding my breath.
 
My money is on a name change. All the court documents are against Alex Mauer. Alex has/will change names to Alex Kobayashi. So Alex Kobayashi is not under any court order and is free to pester anyone without fear of legal reprisal. In Alex's head the name Kobayashi is a cleaver subtle (as a freight train) reference, where if you are in a no win scenario then change the rules so you can. If this is true then Alex is one step closer to becoming a sovereign citizen.

Alex would appear to be a rather obsessive schizophrenic, with an “internet rules lawyer” mentality regarding the actual law. The judge has been gentle with him to this point because to be otherwise would be literally kicking the village idiot for simply being the village idiot. But I think that patience is up. The Judge is clearly upset, and a no contact order for the court seems rather unusual. I wonder how many Federal Protective Services Officers follow Alex around when he enters the building?

So, to summarize that video
1: Alex is forbidden from contacting the Judge or the Clerk directly
2: Alex is forbidden from asking Lemnard for legal advice.
3: Alex didn't show.
4: Imagos offered Lemnard position of General Counsel, so good for him.
5: "I still have no idea who Alex Kobayashi is. At this point I've stopped trying to understand it. I think it's an exercise in madness"

I'm not a law person, but the Judge in the case basically issued the equivalent of a restraining order against Alex, right? It's a pretty big deal for a federal judge to say "Don't fucking @ me, you crazy bitch" to a defendant in a court case, right?

Also, asking opposing counsel for legal advice is a really dumb idea, as far as I can tell.

I’m sure Alex has already left at least 7 messages on the Judges Phone, immediately following Leonard’s video. Which raises an interesting question, in a situation like this, where the litigant fails to appear and has arestrictive order entered against them, when does that become binding? At the hearing, when the judge verbally declares it? (Shoulda been there!) Once formally written? Or when the litigant is served? If you fail to appear when ordered you can’t actually claim ignorance of the outcome now can you?

I can’t help but wonder if this order is a form of tripwire. Violating it would give the judge leverage to either recommend some much needed psych evaluation, or kick the whole matter over to someone who can, as it is clearly no longer a matter before the court (that ended with the settlement) but Mauer direct contact has instead become a matter of or involving the court.

The court has retained jurisdiction under FRCP 41(a)(1), according to French. Also, the court gave some figure like 90 days during which the matter remains open.

It's also not that unusual for a court to tell a litigant to stop doing what Mauer is doing when they do what Mauer is doing. You aren't supposed to make ex parte contact with the court. All communications about a case should be going through official channels so all the parties know what's going on. If, for instance, Leonard did what Mauer has mostly gotten away with up until now, he'd have been found in contempt very quickly, because a lawyer is assumed to know these rules.
 
Someone remind me - isn't Alex unable to legally change his name because of the psych hospitalization or something like that?

He’s on probation for committing a crime that he pled guilty to. Although that might be almost up. I think that came down right after Christmas last year, or maybe early January?
 
Doesn't seem particularly fair to drag Lemnard into court (which costs Imagos) for everyone to sit around twiddling their thumbs because the nitwit that pushed the matter doesn't show up. Hopefully that is the end of the judge's indulgence on the matter.

According to the court docket, Alex pled guilty on March 30 of this year. Since they were sentenced to one year of probation, March 30 of next year is most likely the earliest Alex would be free to legally change their name.

One interesting note: if you check out the whole docket, you'll see Alex has (predictably) failed to pay any court costs. They were also ordered to go through a psychological evaluation (which they may or may not have done). I wonder if Alex might get their probation revoked and get hit with a harsher sentence for this and other misbehavior. No idea though, not my area of expertise.

From watching his video, Lemnard seemed pretty happy about the matter. He saw this as Alex's last chance to actually present a case to the judge and maybe get his point heard. Alex didn't show.

If Alex talks shit about Imagos, it's breach of the settlement and the Judge is gonna be unhappy.
If Alex tries to contact anyone at the court, it's breach of today's prohibition against contacting the Judge, who is gonna be unhappy.
Alex's only real option to try to get his way would be filing something with the court, on a case which has now been closed twice. If he tries that, the Judge is gonna ask why he didn't show the last time, and make his case known at any point previously. I think this option ends with the Judge really unhappy.

Plus, the Judge said Alex can't try to get legal advice from Lemnard. That alone probably made Lemnard's day.
