Obergfell v Hodges was about two people who are in a romantic relationship. The government has the power to regulate commercial activities, including forbidding ones it feels are detrimental to society. Someone already tried this exact argument, and it was rejected on the basis I just stated. The equal protection argument used in Obergfell doesn't apply here because it's illegal for everyone to pay for sex, not just a certain segment of society.

Can he make the argument that the government has no vested interest in banning said transaction? Or is the ability to regulate commerce unrestrained?
