Maybe I've just missed it, but how about the news that Phil is raising the bar so that pop-ups now only appear if you pay five dollars or more? And how the only reason he's doing this is because of "troll tips/cheers". Trust him, doods. It's nothing to do with squeezing more money out of fans, it's just dem dirty detractors.

Guarantee he's going to lose money over this greed. Several of his fans like to make a lot of very small donations, as opposed to one large donation. It doesn't require many brain cells to figure out why. They want the attention, and the pop-up/Phil reading it wombo combo is their dream come true. These fans won't pay five dollars for that, if they're of the type that like to constantly get attention.

Some business degree, Phil. Making the pop-up only available for a higher tier donation because you don't want your feelings to be hurt. You had them right where you wanted them, and you blew it because of how fragile your ego is. Seriously, this is "HONOR ROLL MY ASS" levels of stupidity. Maybe that should be the new meme. Just replace "honor roll" with "business degree". Because Phil is at that level now.

Pretty late to comment on the Rambo & Howard rant but I've got to say this...
Phil, people aren't believing your story because it requires them to also believe that someone refused take money for their work. No one says no to money, EVER. I wasn't following it when it happened nor do I know a lot about the situation yet I am 100% sure that Rambo and Howard didn't say "Nah, Phil. We're fine. You can keep all the money to yourself, we're just doing this for EXPOSURE."

Hoo hoo Robin I invented being bad at vidyagames, this fat potatoboy is ripping me off!

howard-stern-private-parts.jpg

lol that genuinely made me laugh.

More so because he does compare himself to Howard Stern.

It sounds less like greed and more like he probably lost some chargeback disputes recently and is salty. After months of shittalking trolls, and telling them Paypal would always take his side.

More so because he does compare himself to Howard Stern.

Emails can be legally binding depending on the context. There is very little argument about this in general.
https://www.dbllaw.com/can-emails-messages-constitute-legally-binding-agreement/

The next step from DSP would be to say "emails can be photoshopped!" which is partly true. But so can contracts and so can pretty much anything. Nowadays however it is actually possible to prove an email was sent/recieved based upon security/encryption of the email service (if it has that).
Internet is internet. Anything you show me could be fabricated. :stress:

Thanks for the info. What I meant, more specifically, was that Phil seems to try to treat emails, and other printed text, as legal contracts. The OPseat emails were more of an honor rule agreement. If he had signed anywhere, physically or digitally, we would have been made aware. He was adamant about it being "in writing!" that he'd get a chair.

But he first argued this during the copyright strike saga of 2015. Apparently, posting fanart in the TKOH forum fanart submission thread gives him 100% legal ownership of the work. (But what if that work itself is stolen?) @Jackie Chin might be able to explain further.

I would argue that the American school system in general is bankrupt. But of all the states, Connecticut ranks #4 in the best states for education. CT is one of the richest states, and plenty of money goes towards the constant improvement of education. However, these resources are not always spread evenly, and some schools have fallen behind.

On the same page, it's mentioned that Phil graduated from Bassick High School in Brideport, which has a reputation for being a complete shithole and is quite possibly the worst high school in the state.

I found an article about Bassick High School entitled "Connecticut's Shame: In One of America's Richest Counties, a High School Has Been Failing for 50 Years".

A 1961 quote from the now defunct Bridgeport Sunday Herald mentions the "sharp contrast between private opulence and public squalor" that existed in Bridgeport half a century ago and continues today. For many years, students of Bassick were forced to buy their own books, science equipment, globes, and maps. Since Americans are entitled to free K-12 public education, these costs are not typical.

In 50 years, things have only gone downhill for Bassick. Teachers are still not given the resources to do their job properly. In America, we have the controversial Common Core standards for language and mathematics. In 2015, 15% of Bassick's students reached proficiency in language, while zero reached mathematics proficiency. In 2013, the advocacy group ConnCan gave Bassick an F in all academic categories.

Bassick is also an incredibly violent environment. Recently, ten students were arrested in one day for fighting. Bridgeport in consistently labeled one of the most dangerous cities in America due to the frequency of violent crimes.

We've established that Phail was not valedictorian at Fairfield University. But what about Bassick? Like those Kiwis who've researched before me, I was unable to pull up any listing of Bassick valedictorians.

If one were to find the information, it would likely be found in back issues of The Connecticut Post. The online archives of the paper only date back to 2001, as indicated by the website's search engine:

http://www.ctpost.com/archives/

A particularly ambitious Kiwi would have to go into the city, head to a library, and view the pertinent microfilm to either confirm or deny Phail's claim of being a Bassick valedictorian, which we've established is not an impressive feat.
Swear to God I remember Phil talking about attending a ritzy Catholic school at one point. He even dropped the name. I Googled it at the time, and the tuition was allegedly tens of thousands of dollars. If it's still on YT, Vic Vos or Deviltetsuo555 would have it.

Importantly, Phil never specified when or how long he attended this expensive high school, whether he graduated from there, or if he *gasp* flunked out.

He's somehow not aware that almost every single contract and agreement you sign nowadays includes the "we can cancel our shit with you whenever we want for no reason at all" and the "if you have a problem you can only go into arbitration and suck my dick" clauses.

I don't know how he somehow thinks he'd ever win a court case against Google or even Opseat. They'd stomp him in 3 seconds flat.

Yeah I've seen the disclaimer and it makes for an interesting legal situation. The only real benefit for DSP is that no one can sue him for what someone else posts (safe harbor) but it doesn't mean if the original rights holder decided to DMCA him that he could do anything about it.

upload_2018-1-31_7-53-50.png

I think that all it'd actually protect him against is being able to say he used the fanart based upon good faith, and that someone who was suing him for damages/copyright infringement would probably end up having to sue the person who falsely submitted the artwork.

Whether or not he'd still get copyright strikes even if a video got taken down is a bit of a mystery. I'm not sure that Google or YouTube would really care enough to begin with (as in they'd just leave the hard copyright strikes on your accounts).

Usually when companies or websites allow user submissions they not only claim full copyright for all of eternity but they also have a provision whereby you "legally agree" that you are actually the rights holder. However, it mostly doesn't matter for shit because the cost to pursue something like that legally when it comes to DSP is far greater than any damages you'd ever receive.

On top of that, most agreements like those make you agree that you're above the age of 18 because if some 16 year old is signing virtual forum contracts then it wouldn't work.

So DSP keeps mentioning how his emoticons have to get manually approved:

So has DSP been issued a warning in the past 90 days? Or is he not a Twitch partner (I thought he was?)

EDIT:
Looks like others have noticed this as well

Apparently if you like DBFZ you're FGC fanboy. He seems to bring this up at every chance tonight. Then again I'm barely paying attention so maybe it just seems that way.

He says this for every fighting game. If you bring up nobody else has issues online you're an FGC fanboy sheep who just follows everything they say, even if you've never seen anything FGC related, like me.

He called someone "faggot" in the past 90 days, remember. To my knowledge, he's always been made to wait for emote approval. So assuming Twitch is consistent, Phil has never been more than 90 days gone from a warning being issued? The channel does get reported all the time...

EDIT: besides the "faggot" clip getting around and probably being the basis of several reports, there was the Back Taxes/Definitely Not Laundering Money to Move My GF in Fundraiser, which rubbed a lot of people the wrong way.

Him not playing Monster Hunter World is a HUGE missed opportunity for him.

Thanks to the SOS system, you can call for help and have players join your game. He could have have random people carry him the entire way through practically. Sure, it would make for a semi-boring playthrough, but I'd imagine it would be a lot more profitable than fucking Heavy Rain.

The elephant in the R&H story is that Phil kept the money for himself, and bought himself a BMW. Even when Rambo and Howard never asked for money, at least he could have the courtesy to give them something anyways. But he demonizes Howard and Rambo instead and claims all they wanted is exposure to their channels.

The whole story he tells is fishy - first of all he thinks his youtube channel is so big that your channel being mentioned on it is a huge thing and will grant you millions of views, then he claims everybody but him who worked on Project 7 refused to take any money.

It's sad how he treats people who were supposed to be his real life friends, especially John Rambo who comes across as a likeable person (at least next to Phil).

I remember when Phil moved into the Gout Mansion there was some reason he told the moving people that if they did something he'd give them a bunch of exposure on his youtube channel. I think it was putting his furniture together or something. So it makes sense to me that Rambo and Howard would have been paid in exposure too over actual money. I remember because people mocked him cause he told the movers that he'd get them tons of business.

Phil attracts the best fan base doesnt him

I often think about the silly skinny teachers who honestly seem to believe every little child is born to be special and will achieve greatness in life if they try. I believe if that type ever saw one of their precious children-of-the-future turn down opportunities and hobbies in life to give all their money to what is essentially gaming's Scientology, they'd cry. A lot. They would likely break inside (even though this guy is obviously trying and failing to be sarcastic.)

So I get to see two people make me laugh at the same time! Life is kinda cool sometimes.

The only games with as many viewers as Monster Hunter (#3 US) are PUBG, Hearthstone, and LoL.

The next highest games have half as many viewers.

Dragonball FighterZ has literally a tenth as many viewers (4k for DBZ, 47k for Monhun).

I'm watching some streamers I like who do it casually get 2k viewers for monster hunter after barely streaming for two years.

And like someone else said the game literally let's you open up your game to drop in with the press of a button. So even if Phil didn't want to lobby with his fans he could just shoot off a flare every time and let some Asians carry him.
