Quick question on fair use.

Dave is doing playthroughs and because the work is transformative it's covered under fair use. If i were to download his videos and put them together into 1-2 hour long videos and post them on youtube, would they get copyright strikes?

You'd be somewhat safe if you didn't monetize them and just did reuploads/mirrors. Might have to pull a Snort Burnell and tweak the footage to avoid tags.

I still have a hard time with the concept of Phil's gameplay being "transformative", unless it's how exceptional he's playing. His commentary isn't transforming shit.

From what I saw he is basically spamming the axe like you would an arrow so that he doesn't have to get in close. It's a very slow way to kil enemies.

Welp RIP that playthrough I suppose. I don’t see why anyone is going to bother watching this if he decides to mute it, but after Burnout Paradise I wouldn’t be surprised if he ultimately did.

WOW, I won't be viewing the God of War one as I am playing it myself and so far its a masterpiece and I am like 4 hours in.

Jesus christ though Dave; ITS YOU THAT IS THE PROBLEM! Your audience tangents and does not talk about the game because you do not direct them to talk about the game by not asking questions or commentating. When your audience is not engaging you, you have pretty much failed as a broadcaster at that point.

How many views did he have? Last night at midnight he got about 500 which is pretty bad for him even. Looks like we are entering self-destructive Phil phase.

If I recall it right, he once said it's transformative because he controls the character with his controller and adds his commentary. (a really old statement).

Which is the equivalent of singing bad to a song and claiming the song was changed enough so you can resell it again. Every single piece of work in a game was made by other people. Even how he is allowed to move himself, where he is allowed to go and what he is allowed to do. So he just moves in the allowed boundaries of the developers. He only adds his voice, and shitty on top, which just puts him in a grey area.

What does he add when he sleeps during 1 hour of Yakuza cutscene?

I love when he blames his viewers. When you try and engage him he ignores you 90% of the time unless you pay him. Then, depending on what you asked you either get called an idiot or banned. Sometimes if you're lucky you'll get a long-winded answer that segues into something completely unrelated. That's if his mods and "hardcore fans" don't just jump on you for daring to try and have a friendly conversation.

He killed interaction a long time ago. If he wants to interact then interact. It's not difficult you fat fuck, just talk to people. Your chat moves slower than a crippled snail, it's not like you can't just pick something at random and carry it on. You're supposed to be an entertainer. Entertain you nonce.

Honestly, I think he believes that the detractors are the cause of his money issues. Although that may be true to an extent, he started this train rolling himself and steadily keeps it moving with his bad decision making. I agree that he would probably get rid of the detractors.


As always Phil is late. That was a pretty decent draw from what I saw on Twitch. Unless there is some new DLC comoing out soon I doubt he'll have much of an audience besides those who were waiting for him specifically to play it.

It just got a psuedoraid hunt.

LMFAO @ the thumbnail of the stream above Phil's that just has a 'Starting Soon' message and 132 more viewers.

Also seeing his thumbnail in the sub-directory really hammers home how shit his streaming set-up is. If he's playing the game he looks like he is distractedly staring off to the right. If he is "interacting with chat and not an isolation booth, because it's 2018 not 2008" he's 50% physically not on camera hunched over staring off to the bottom-left of camera. He literally has no self-awareness or conception of what a Twitch stream is.

I know one streamer who figured out exactly when Twitch takes the screenshots for the thumbnail, set a timer, and would just do something wacky every time the timer went off like a super close-up and funny expression or something. It was entertaining for the people watching and it actually got new people browsing the sub-directory to join his stream.
