Law Justice Brett Kavanaugh Megathread - Megathread for Brett Kavanaugh, US Supreme Court Justice

they're good justices, brentt

https://www.cnbc.com/2018/07/05/trump-picks-brett-kavanaugh-for-supreme-court.html

President Donald Trump has picked Brett Kavanaugh, a federal appeals court judge with extensive legal credentials and a lengthy political record, to succeed Justice Anthony M. Kennedy on the Supreme Court, NBC News reported.

Kavanaugh, 53, is an ideological conservative who is expected to push the court to the right on a number of issues including business regulation and national security. The favorite of White House Counsel Donald McGahn, Kavanaugh is also considered a safer pick than some of the more partisan choices who were on the president’s shortlist.

A graduate of Yale Law School who serves on the U.S. Court of Appeals for the D.C. Circuit, Kavanaugh has the traditional trappings of a presidential nominee to the high court.

If confirmed, the appellate judge would become the second young, conservative jurist Trump has put on the top U.S. court during his first term. Kavanaugh's confirmation would give the president an even bigger role in shaping U.S. policy for decades to come. The potential to morph the federal judiciary led many conservatives to support Trump in 2016, and he has not disappointed so far with the confirmation of conservative Supreme Court Justice Neil Gorsuch and numerous federal judges.

At times, he has diverged from the Republican party’s ideological line on important cases that have come before him, including on the Affordable Care Act, the 2010 health care law which Kavanaugh has declined to strike down on a number of occasions in which it has come before him.

Anti-abortion groups quietly lobbied against Kavanaugh, pushing instead for another jurist on Trump’s shortlist, 7th U.S. Circuit Court of Appeals Judge Amy Coney Barrett, ABC News reported in the run-up to Trump’s announcement.

Kavanaugh received his current appointment in 2006 after five years in the George W. Bush administration, where he served in a number of roles including staff secretary to the president. He has been criticized for his attachment to Bush, as well as his involvement in a number of high-profile legal cases.

For instance, Kavanaugh led the investigation into the death of Bill Clinton’s Deputy White House Counsel Vince Foster, and assisted in Kenneth Starr’s 1998 report outlining the case for Clinton’s impeachment.

Democrats criticized Kavanaugh’s political roles during his 2006 confirmation hearing before the Senate Judiciary Committee.

“Your experience has been most notable, not so much for your blue chip credentials, but for the undeniably political nature of so many of your assignments,” Sen. Chuck Schumer, D-N.Y., said at the time.

“From the notorious Starr report, to the Florida recount, to the President’s secrecy and privilege claims, to post-9/11 legislative battles including the Victims Compensation Fund, to ideological judicial nomination fights, if there has been a partisan political fight that needed a very bright legal foot soldier in the last decade, Brett Kavanaugh was probably there,” Schumer said.

Kavanaugh's work on the Starr report has been scrutinized by Republicans who have said it could pose trouble for the president as he negotiates with special counsel Robert Mueller over the terms of a possible interview related to Mueller's Russia probe. The 1998 document found that Clinton's multiple refusals to testify to a grand jury in connection with Starr's investigation were grounds for impeachment.

In later years, Kavanaugh said that Clinton should not have had to face down an investigation during his presidency. He has said the indictment of a president would not serve the public interest.

Like Trump's first nominee to the Supreme Court, Neil Gorsuch, Kavanaugh clerked for Kennedy. If he is confirmed, it will mark the first time ever that a current or former Supreme Court justice has two former clerks become justices, according to an article by Adam Feldman, who writes a blog about the Supreme Court.

Kavanaugh teaches courses on the separation of powers, the Supreme Court, and national security at Harvard Law School and Yale Law School, and does charitable work at St. Maria’s Meals program at Catholic Charities in Washington, D.C., according to his official biography.

After a blistering confirmation battle, Justice Brett Kavanaugh will take his seat for oral arguments on the U.S. Supreme Court with a skeptical public, a majority of which opposed his nomination. However, Democrats may not be able to exploit this fact in the upcoming elections as much as they hope, because the independent voters overwhelmingly disapprove of their own handling of the nomination by a 28-point margin, a new CNN/SSRS poll finds.

Overall, just 41 percent of those polled said they wanted to see Kavanaugh confirmed, compared to 51 percent who said they opposed his confirmation. In previous CNN polls dating back to Robert Bork in 1987, no nominee has been more deeply underwater.

What's interesting, however, is even though Democrats on the surface would seem to have public opinion on their side, just 36 percent approved of how they handled the nomination, compared to 56 percent who disapproved. (Republicans were at 55 percent disapproval and 35 percent approval). A further breakdown finds that 58 percent of independents disapproved of the way the Democrats handled the nomination — compared to 30 percent who approved. (Independents also disapproved of Republicans handling of the matter, but by a narrower 53 percent to 32 percent margin).

Many people have strong opinions on the way the Kavanaugh nomination will play out in November and who it will benefit. The conventional wisdom is that it will help Democrats in the House, where there are a number of vulnerable Republicans in suburban districts where losses among educated women could be devastating, and that it will help Republicans in the Senate, where the tossup races are in red states where Trump and Kavanaugh are more popular.

That said, it's clear that the nomination energized both sides, and that the tactics pursued by the parties turned off independent voters in a way that makes it much harder to predict how this will end up affecting election outcomes.

Don't they see the wheel always turns and sooner or later it will be their pick that has to stand up to what ever muck the GoP can sling at him/her?

Honestly? The GOP, besides rare outliers like Trump (and Trump is barely conservative in any real sense), is filled with such worthless political cuckolds that I expect they would "take the high road" and let the Democrats have whoever they wanted without a fight.

If the FBI doesn't come up with the right answer, they'll be sent back to do it again. As many times as it takes.

Ah, the Brexit Do-Over Strategy.

Graham will bodyslam a fucker through a desk if it's one day longer than a week

His little performance might have been satisfying, but don't forget what a worthless neocon faggot Graham is. We will all soon go back to hating him like he deserves.

"Lighter take"

It's political "comedy," shitlord. Just like John Oliver, Colbert, and The Daily Show! The laughter exists only as a brief respite from the 24/7/365 leftist anxiety created by the talking points being spread by the comedy shows.

So, I listened a little to his opening statement.... And wow. That is a man filled with professional rage about what has happened to him. Every. Signal. Point. Made its home against the left. Not once did he drag his accuser through the mud. But he sure as hell made sure his real enemies knew he wasn't taking their shit anymore.

I'm shocked at how the dems tried to paint him as a rapist. I get horrible people can live normal lives and hide what they do. But the people she counts as there said "Yeah we are pretty sure that party didn't even happen" nothing like "oh yeah I was there, but nothing happened". No one will back her up and that is the sad part. I'm sure some dumbasses are sending her death threats and shit which if something like this happen to her is fucked.... But only she knows what the truth is.

To end this giant autistic rant. This whole thing has been a fucking sad embarrassment to watch. A good man has been dragged through the mud and I'm sure his kids will get shit for it, some poor woman the dems conjured up has had her life destroyed forever. Its just fucking sad

TL;DR
They're the same victim of the same hate machine.

Time for Dueling Narratives

Ford Says Journalists Caused Her to Publicize Her Kavanaugh Charge
Christine Blasey Ford said that she went public with her allegation against Supreme Court nominee Brett Kavanaugh after journalists approached her at her home and classroom.

Ford first made her allegation confidentially to her congresswoman, Anna Eshoo, and then to Senator Dianne Feinstein, both California Democrats. Journalists learned of the allegation and some identified Ford before she went public in an interview with the Washington Post published Sept. 16.

Where the valiant victim, speaking confidentially, was only dragged kicking and screaming into the public spotlight after journalists preyed on her. She couldn't be seeking attention because she didn't even want to come forth!

Investigate Sexual Assault Allegations Now! Delay the Kavanaugh Vote!
Early in the summer, when it became clear that Kavanaugh would be selected as Trump's nominee, Blasey sent a letter to her congresswoman, Anna G. Eshoo, and reached out to The Washington Post tip line. Later in July, she sent a letter to Senator Dianne Feinstein.

For several weeks, Blasey chose not to speak publicly in order to protect her family and her own privacy. Knowing she would be attacked, she completed and passed a lie detector test, administered by an ex-FBI agent, and gave the results to The Washington Post.

Where the brave victim is totally credible because one of the first things she did was contact the press and continued to update them before she ever went public.

Liberals don't understand law enforcement. Either

1- All cops are racist murderers who hunt black kids for sport and laugh at rape victims.

or

2- Law enforcement is magic and can see what people are thinking and even find evidence where there isn't any.

Alternatively:

1- All cops are racist murderers who hunt black kids for sport and laugh at rape victims.

and

2- Law enforcement is magic and only they should have scary, black guns.

Ummm? Didn’t she, under oath, admit that she or her lawyer contacted the WaPo BEFORE the Senate? Or did I miss something major there?

Does nobody on the left realize the risk in all this to this woman? How many Trump admin people have been sandbagged by Mueller now on the charge of “lying to the FBI”? Well calling for an FBI investigation means the FBI WILL be talking to her. And any inconsistency in her story will set off all sorts of red flags. They want a clean timeline, which she seems incapable of providing. (Do note that the “accurate” timeline that the Dems are waving around comes from Kavanaughs records and recollections. Nothing she provided.) Mitchell was being generous when she said she would not have referred this matter for Prosecution or Investigation.

So that’s how much a false rape accusation costs.

Women are so oppressed.

It's like I told a friend about this #MuhToo shit: if you can destroy a man's reputation with an evidence-free accusation, you're not a second-class citizen by any stretch of the imagination, and you really need to drop the "Western women are oppressed" shit.

But that's the thing about this primitive mindset people are slipping into: if you don't know why you believe anything you believe (because it's all about your feelings), how would notice when there are direct contradictions between your beliefs?

A very interesting quirk is that, at least up here in NY, outside the Manhattan Bubble, it's had the opposite effect: The Dem base is fucking pissed. There's a reason Schumer's about as well-liked as Crohn's Disease up here outside his rabid fanbase. The dude pathologically goes with shafting his own constituency, and the only reason he still has his job is because the DNC bankrolls anyone who dares primary challenge the selfish prick while strategically deplatforming any opposition in-party. That's the case for many, if not all of the establishment Dems, and while they're really big on going on about how they're going to improve shit, fact of the matter is that both sides of the electorate fucking hate them. It's only the party insiders that want them to be there, and that's not going to avail them forever if they keep fucking losing.
Either you are in a bubble of your own, or the democrats have really upped their astroturf game, like from peewee to major league upped it.

Every time I think I've found rock bottom of the cuckservative commentariat, they show me a new low.
I don't want to make a long post because it'll be all :autism: and a-logging, so I'm just going to lay down a marker: at no point before the final vote (the actual final vote; if no such vote occurs due to outside events, I'll consider the cutoff point to be whenever Kav leaves the running) will Jennifer Rubin, Bill Crystol, Megan McArdle, or Russ Douthat say either/or: "Brett Kavanaugh has been exonerated" or "Republicans should ignore Democrats' demands and proceed with the vote." Like all the rest of the MSM, the controlled opposition's masks are slipping.

If I'm wrong, I'm giving KF $100.

This whole thing is like quantum mechanics.

It is impossible to know if the alleged sexual assault did or didn't happen, but apparently because there might have possibily happened means we should ruin this man's life.

And now it only gets worst as now liberals are using his coaching a girl's basketball team as an issue.
https://www.usatoday.com/story/spor...-no-longer-coach-girls-basketball/1459496002/

Hell liberals on twitter are now vaguely suggesting he's a pedophile because he coaches his daughter's basketball game.

These people should be put to the wall.

How long until people are desensitized to the word "pedophile"? Can the left actually accomplish that?

If you're not familiar with NY (and if so, I don't blame you; NY's politics are a fucking shit-show), the TL;DR is that we have a sort of weird mutation of the California situation where a tiny shred of our state dictates the majority of state policy due to districting and population distribution. The rest of the state fluctuates wildly in demographic and political affiliations, from outright red (much of upstate) to mostly blue (Central LI) to purple (Eastern LI) and while as a whole it's basically always at least leaned blue, the entire state isn't the NYC area and Albany. Like was joked about earlier in the thread, for the most part NY is hilariously unrepresentative of its own electorate (with much of the state having no meaningful impact on politics beyond the local level) and entirely at the whims of the small blocks of die-hard blue at the state level. It's why you can have a county-by-county breakdown that looks like this in 2016 and still have the senate race go to the Incumbent Dem.

By no means is my analysis a comprehensive breakdown, and I'm absolutely willing to acknowledge my own data on it might be incorrect.
