Zack doesn't have to prove actual defamation to win the tortious interference claim. It's a lot simpler than that. Waid's political opinions about Zack outside the context of competition are protected, and it would be very hard to prove they weren't protected under the Sullivan actual malice standard if this were purely a defamation case.

However, the fact that Waid has a direct financial interest in Zack's books not sharing the same shelves where his own are sold and that he arranged to induce a third party to breach a contract with Zack in order to arrange for that gives him a financial incentive and his speech in that context, particularly in his call to Antarctic and his recruitment of others to harass and threaten Antarctic, puts his speech into a commercial context where First Amendment protections are lesser.

It's entirely possible that speech that would be protected against a defamation claim if he were a bystander with no financial stake in the matter is tortious in the context of inducing a breach of contract. Defamation is, quite simply, not an element of the tort. It is not necessary at all that the speech inducing the breach is defamatory.

As in every cause of action, First Amendment protections are an issue, but the contours of First Amendment protections in commercial speech are different and not at the robust height they would be at in pure political speech.

Waid, like most people high on an inflated sense of self worth, probably believes it himself that he was the one who deserved the credit for KC. While I'm sure he helped, it isn't to the degree he pretends.
He helped with the dialogue, the story itself was made by Alex Ross.

The only difference is that D&C would probably laugh along with his being labeled autistic. Hell, I think he's even called himself that on a few of his videos.

No waid, facebook isnt your living room or private conversation. It's you shouting at people in the street and then getting upset when people tell you to go fuck yourself.
Also as I've said before if comics are for everyone why do they cost 3-8 bucks?

My understanding is that current mainstream comics are 3 to 8 USD for a book that is 50% ads. That is not even getting into how you have to buy books from several different series to understand the story of the actual series you are reading. There has been some talk among the smaller companies of going to a manga style of releases. Where you would get a small black and white bound book akin to a manga for 8 or 9 bucks. The previous system vs. buying a $8 or 9 book that has less ads, more content, but is black and white only. As a means of giving more content to the consumer and making it easier overall to follow the plot of a series.

The current model is truly an outdated that the industry mainstream wants to keep going because of inertia. It has also been speculated that this is some of the reason for the big social justice push (in addition to various other factors lending to its rise). As a means of indirectly fucking over small companies. So some bastardized form of rent seeking instead of adapting to new market conditions.

The whole industry seems to suffer from bloat and horrible company setup. It all just seems very rigid, in terms of company and market structure. Which may be one of the many factors that is helping cause it to crash and burn.

The best way to measure a man's worth is whether or not you'd have a drink with them. D&C seems like someone you hang out with and find some common interests with as the two of you shoot the breeze. Mark Waid seems like the sort who'd invite you to a bar, spend the night ranting about mean things people said to him on the internet, before finally capping things off by discovering that he "accidentally" left his wallet at home when the topic of who's paying comes up.

I don't know about DC's situation but from what I understand about Marvel, editors like Cebulski are overly permissive (if not downright absent) which leads to awful quality control. The direction in Marvel Comics probably think they're doing great in terms of sales, as they ship a motherload of their crappy "progressive" comics. It's up to Comic Shop retailers to sell the crap to their clients, who are letting them gather dust on shelves. The retailers are the fuses in this whole mess, as they need to pay for virtually unsellable matter. They're the first to kick the bucket.

Since Marvel earns shit from failures of titles like Ms Marvel or Captain Marvel (that they consider like their flowers nowadays) and Disney only care about Marvel Studios, they're forced to hire cheaper b-listers to continue to churn out tons of mediocre content. It's a vicious circle which contribute to cement Marvel's reputation as a liquefying company. Since the higher up have their head so far up their butts, they blame everyone else but themselves for the spectacular fall...
