As pointed when it first happened, "there was nothing stopping him from seeing another publisher!" is nonsense as Meyer was targeted for being Meyer. Do they really expect anyone to believe that if Image or some other publisher deciding to pick him up that the mob and Waid wouldn't go after them next? It'd be silly to chase after it but considering we had Joe Quesada voice similar opinions and we've had some employees bring up Google Hangouts and such, couldn't it be argued that this Autism Jihad is "Unofficially officially supported by Marvel Entertainment"? Fuck if I know how deep the rabbit hole goes but it's interesting how heads of the company agree though we haven't heard them comment on Waid's actions.Not a lawyer, but from what I understand they can't use the Sherman because the lawsuit is focused primarily on Waid who is being sued in his personal capacity. Not in his capacity as an employee of Marvel. There is also some debate as to whether he even IS an employee of Marvel rather then just some dude they have a contract with. There is a legal distinction.
Of course this is just the preliminary phase, and we have yet to reach discovery. If it turns out that Marvel execs/management knew about and/or encouraged Waids actions, then they could get sucked into the mess. From what I am seeing though Meyers lawyer wants to run a tight ship and go for what he can reasonably get, as opposed to going full Captain Ahab and hunt a white whale.
One good idea got edited out of the thread: @Splendid Meat Sticks proposed that a lawyer write up a sticky for this subforum that includes stuff like I posted earlier about the difference between civil and criminal proceedings. It's come up before here and it'll come up again, and I'm not a lawyer so I'm not the best choice for that. It's a good idea.

I kinda believe that's not really an option for Waid. If still goes after Zack then he's risking getting into shit again and if he says anything apologetic then he just nuked his career with a hundred "MARK WAID SUPPORTS COMICSGATE" articles. - Any reference to "innocent until proven guilty" is not relevant. That is not the standard for civil suits.
- There is no prosector. There is a plaintiff, who has a lawyer. The state is not obliged to supply the defendant with a lawyer, although in some cases a defendant can get free representation.
- Nobody is going to jail over this suit, nor will anyone cop a plea, nor are there "charges". The suit alleges various civil wrongs, which are provided for in law or by precedent.
- There will be no grand jury, no indictment.
I'm no lawyer, but my understanding is that the standard in a civil trial is preponderance of the evidence. That is a lesser burden to meet. It's why O.J. Simpson could be found not guilty in a criminal trial, but could be found civilly liable for the murders based on mostly the same evidence."Innocent until proven guilty" is kind of how it works though. Yes, but that would be a separate proceeding. It is a crime to disobey a court order. This is a civil trial.As for not going to jail. You can go to jail for not paying fines or other court ordered payments I think. Obviously Waid would pay, and even if he doesn't they could take it from his wages or send the bailiffs round. But it is possible in some countries.

Perhaps this lawyer is just telling Mark Waid what he wants to hear. That's almost certainly what happened with LanDUI in the maddox lawsuit. I have a feeling Waid would be stupid or gullible enough to fall for it to.I stayed away from all this comic stuff but I do love lawsuit salt. Rackets sure seems animated over this one.
