As i understand it (read: i watched Leonard French) Meyer has requested a jury trial but the judge may simply make a ruling on their own before it reaches that point.

Either party has the right to demand a jury trial on any material factual issues in dispute. There may not be any factual issues requiring a jury, though.

This is a case under Texas law, although it is being litigated in federal court under diversity jurisdiction. The most likely defense Waid has unless he is actually going to deny, in the face of his own repeated admissions, that he called Antarctic and repeatedly publicly discussed exactly what he did both before and after the fact, is that his actions were justified and he was acting in good faith.

That's a mixed issue of fact and law, because there's the issue of whether he actually believed his actions were justified (relevant to the punitive damages issue among other things), and a legal issue of whether his actions actually were justified. At least part of this requires a factual finding material to the claims, and would tend to preclude a summary judgment bypassing jury trial unless the parties stipulated to it.

So in short, a party is constitutionally entitled to a jury determination of facts, and I think either party, if they wanted to, could frame this issue as factual in nature, for at least some part of the case.

I think there may be a partial summary judgment on undisputed facts, such as that the phone call in question did occur and that Waid did in fact make public statements before, during and after the events in question.

This one and the other common one used, Superman, are both red herrings. These are mainly BS claims in order to rail on about Copyright. The truth is Copyright is not the issue with Mickey Mouse or Superman. They are both actively exploited Trademarks. And Trademarks don’t expire unless they go unused. It gets weird, but ultimately the Copyright expiring on Steamboat Willie means less than everyone thinks it does. Once it happens you would be free to reproduce Steamboat Willie, so long as the frames don’t contain the Trademarked character. It gets very weird very fast.
 
I'm glad it's not Waid going on the offensive. Cause it's easy to dismiss a lot of foolish people suing over dumb shit, like with Maddox suing Dick and many other people, or Matt Hoss suing H3H3. But you got to remember, even when those guys filing the lawsuits don't win, the defendants still had to deal with all the legal fees and time in their lives lost to this bullshit.

I hope Meyer wins, but only so that it sets up some kind of precedent.

I think it's even better because when they started attacking him a LOT of his videos were when he was outside and filled with environmental noises of NY such as cars honking, street-sweepers, construction, dogs barking, people and the wind, oh god the WIND. Every second video sounded like he was speaking from the inside of a wind tunnel.
 
I would love nothing more than to see Mark Waid throw one of his famous tantrums in court.

I'd like to see it because if you pitch a tard fit in federal court, you can end up dragged off in handcuffs and cooling your heels behind bars for a night or so. One hopes his lawyer doesn't have the sense to tell him not to have an infantile screaming temper tantrum in court, because Waid is the kind of angry manbabby who actually would do that.

Notice that Meyer kept this fairly quiet and extremely professional. Hewasn’t The one who announced it. He seemingly sought out good well versed practical legal advise. And his lawyer paired things down to the simplest most direct case. No grandstanding. Pure matters of law. No fluff. Those are all signs of a legit legal case and a legitimately grieved party, as opposed to e-drama and self importance.

Exactly. Waid and those siding with him keep sperging out over how this will go nowhere, as if saying that on social media will change anything.

It's quite fascinating how their attempts to maintain their "dominance" manage to fuck them over in the long run.

Very old archetype, but I don't think they created Meyer. Meyer is big in spite of them, not because of them. In this case it's more they went after him to take him down. So the bear hunt analogy works better.

When you go hunting bears, you have to work really hard and go out of your way to find one. The problem arises however that once you do find a bear...the bear has found you too.

This is the part where I'm trying to figure out how you justify disrupting someone's business the way that Waid did.

It wasn't a scam; the books are gonna ship and the money's there (thanks to IGG). It certainly wasn't illegal. How does Waid paint himself acting in good faith?

Aside from getting negative press coverage (as opposed to positive) it's pretty reminiscent of what happened with ScamKeysIan where they never really would have gotten popular had retards not made them infamous by continuously sperging out over their shitty videos.

History is doomed to repeat itself I guess.
