Law Justice Brett Kavanaugh Megathread - Megathread for Brett Kavanaugh, US Supreme Court Justice

they're good justices, brentt

https://www.cnbc.com/2018/07/05/trump-picks-brett-kavanaugh-for-supreme-court.html

President Donald Trump has picked Brett Kavanaugh, a federal appeals court judge with extensive legal credentials and a lengthy political record, to succeed Justice Anthony M. Kennedy on the Supreme Court, NBC News reported.

Kavanaugh, 53, is an ideological conservative who is expected to push the court to the right on a number of issues including business regulation and national security. The favorite of White House Counsel Donald McGahn, Kavanaugh is also considered a safer pick than some of the more partisan choices who were on the president’s shortlist.

A graduate of Yale Law School who serves on the U.S. Court of Appeals for the D.C. Circuit, Kavanaugh has the traditional trappings of a presidential nominee to the high court.

If confirmed, the appellate judge would become the second young, conservative jurist Trump has put on the top U.S. court during his first term. Kavanaugh's confirmation would give the president an even bigger role in shaping U.S. policy for decades to come. The potential to morph the federal judiciary led many conservatives to support Trump in 2016, and he has not disappointed so far with the confirmation of conservative Supreme Court Justice Neil Gorsuch and numerous federal judges.

At times, he has diverged from the Republican party’s ideological line on important cases that have come before him, including on the Affordable Care Act, the 2010 health care law which Kavanaugh has declined to strike down on a number of occasions in which it has come before him.

Anti-abortion groups quietly lobbied against Kavanaugh, pushing instead for another jurist on Trump’s shortlist, 7th U.S. Circuit Court of Appeals Judge Amy Coney Barrett, ABC News reported in the run-up to Trump’s announcement.

Kavanaugh received his current appointment in 2006 after five years in the George W. Bush administration, where he served in a number of roles including staff secretary to the president. He has been criticized for his attachment to Bush, as well as his involvement in a number of high-profile legal cases.

For instance, Kavanaugh led the investigation into the death of Bill Clinton’s Deputy White House Counsel Vince Foster, and assisted in Kenneth Starr’s 1998 report outlining the case for Clinton’s impeachment.

Democrats criticized Kavanaugh’s political roles during his 2006 confirmation hearing before the Senate Judiciary Committee.

“Your experience has been most notable, not so much for your blue chip credentials, but for the undeniably political nature of so many of your assignments,” Sen. Chuck Schumer, D-N.Y., said at the time.

“From the notorious Starr report, to the Florida recount, to the President’s secrecy and privilege claims, to post-9/11 legislative battles including the Victims Compensation Fund, to ideological judicial nomination fights, if there has been a partisan political fight that needed a very bright legal foot soldier in the last decade, Brett Kavanaugh was probably there,” Schumer said.

Kavanaugh's work on the Starr report has been scrutinized by Republicans who have said it could pose trouble for the president as he negotiates with special counsel Robert Mueller over the terms of a possible interview related to Mueller's Russia probe. The 1998 document found that Clinton's multiple refusals to testify to a grand jury in connection with Starr's investigation were grounds for impeachment.

In later years, Kavanaugh said that Clinton should not have had to face down an investigation during his presidency. He has said the indictment of a president would not serve the public interest.

Like Trump's first nominee to the Supreme Court, Neil Gorsuch, Kavanaugh clerked for Kennedy. If he is confirmed, it will mark the first time ever that a current or former Supreme Court justice has two former clerks become justices, according to an article by Adam Feldman, who writes a blog about the Supreme Court.

Kavanaugh teaches courses on the separation of powers, the Supreme Court, and national security at Harvard Law School and Yale Law School, and does charitable work at St. Maria’s Meals program at Catholic Charities in Washington, D.C., according to his official biography.

After a blistering confirmation battle, Justice Brett Kavanaugh will take his seat for oral arguments on the U.S. Supreme Court with a skeptical public, a majority of which opposed his nomination. However, Democrats may not be able to exploit this fact in the upcoming elections as much as they hope, because the independent voters overwhelmingly disapprove of their own handling of the nomination by a 28-point margin, a new CNN/SSRS poll finds.

Overall, just 41 percent of those polled said they wanted to see Kavanaugh confirmed, compared to 51 percent who said they opposed his confirmation. In previous CNN polls dating back to Robert Bork in 1987, no nominee has been more deeply underwater.

What's interesting, however, is even though Democrats on the surface would seem to have public opinion on their side, just 36 percent approved of how they handled the nomination, compared to 56 percent who disapproved. (Republicans were at 55 percent disapproval and 35 percent approval). A further breakdown finds that 58 percent of independents disapproved of the way the Democrats handled the nomination — compared to 30 percent who approved. (Independents also disapproved of Republicans handling of the matter, but by a narrower 53 percent to 32 percent margin).

Many people have strong opinions on the way the Kavanaugh nomination will play out in November and who it will benefit. The conventional wisdom is that it will help Democrats in the House, where there are a number of vulnerable Republicans in suburban districts where losses among educated women could be devastating, and that it will help Republicans in the Senate, where the tossup races are in red states where Trump and Kavanaugh are more popular.

That said, it's clear that the nomination energized both sides, and that the tactics pursued by the parties turned off independent voters in a way that makes it much harder to predict how this will end up affecting election outcomes.

It's a reference to the John Lennon/Yoko Ono song "Woman is the Nigger of the World".

Woman is the nigger of the world
Yes she is, think about it
Woman is the nigger of the world
Think about it, do something about it

We make her paint her face and dance
If she won't be a slave, we say that she don't love us
If she's real, we say she's trying to be a man
While putting her down we pretend that she is above us
Woman is the nigger of the world, yes she is
If you don't believe me take a look to the one you're with
Woman is the slave to the slaves
Ah yeah, better scream about it
We make her bear and raise our children
And then we leave her flat for being a fat old mother hen

We tell her home is the only place she should be
Then we complain that she's too unworldly to be our friend
Woman is the nigger of the world, yes she is
If you don't believe me take a look to the one you're with
Oh woman is the slave to the slaves
Yeah, alright

We insult her everyday on TV
And wonder why she has no guts or confidence
When she's young we kill her will to be free
While telling her not to be so smart we put her down for being so dumb
Woman is the nigger of the world, yes she is
If you don't believe me take a look to the one you're with
Woman is the slave to the slaves
Yes she is, if you believe me, you better scream about it

Wew lads, I can hear the chimpout in her mentions from here.

I expect to experience something similar tomorrow here in Chiraq when they pronounce the verdict in that cop shooting trial.

Well this is news to me.

Explain.
Paul McCartney was on 60 Minutes this sunday and he brought up a photoshoot right after Ono had interjected herself into the Beatles. He went "why the fuck is this piece of ass in a BAND PHOTO?!" I may be reading between the lines with that misquote but I think it captures the spirit of what he was trying to say without potentially harming his future revenue streams.

Men died by the millions in various wars yet you don't hear them whining on account of--you know--being dead. Furthermore, there is no need to act like the last hundred years didn't happen. Women have more educational and career opportunities than they ever had at any point in the history of the Western World. I swear third-wave feminism has done more to disempower women through the perpetration of the "rape culture" myth and thus making them psychologically dependent on the state for protection.

Perhaps Bette should go to Saudi Arabia or North Africa to lecture the men there on how they treat their women. I'm sure they'll appreciate it.

I will go ahead and rate myself :autistic: before anyone else can... fucking christ, it's almost as if the hardcore feminists want the 'patriarchy' imposed on them as some form of sexual kink. the concerning part is that I may be inclined to play along for structural purposes.

This kind of stupid guilt shit is why women hate the gays; we can't be touched by this. We're not interested in their pussy, we can't be guilted about muh raep, we don't expect them to serve us in our lives. I have never seen a woman more furious than when she realizes she's talking to a gay man that absolutely, positively cannot be touched by all her scamming bullshit and the realization that she has no power hits her dead in the face. They use their sex as a crutch to avoid developing any personality, skills, or actual intrinsic power and they hate confronting this fact.

Women are not the niggers of the world. Niggers are. Its in the name you stupid cunt.

The supposed end game for feminism was equality between the sexes and the first and second-wave feminists had won those battles. What the third-wavers have left is finding "patriarchy" and "rape culture" in anything and everything from advertising to video games, which I think has fueled their paranoia about the male gaze. Yet they wonder why those with a 'y' chromosome stay the fuck away. :story:

Sometimes in blue cities police will "arrest" prominent protestors who request it for publicity, to build good relations with people (as if that actually would be a good way), or to prevent them from doing something that actually causes problems. Now I don't think that's what happened here, but you have to wonder.

U.S. Capitol Police are a relatively small force that only protect members, staff, visitors, and facilities. They largely operate outside of political pressure that city or local police forces may have. They give zero fucks about a celebrity, red or blue.

Remember the GOP only needs 50 votes to confirm with Pence breaking the tie. Assuming Manchin votes yes they can actually afford one defection on top of the absence of Daines to get Kavanaugh confirmed. Looks like the game plan is a vote Saturday if McConnell can whip 50 votes. If not Daines will fly back and the vote will be held Sunday.

90% chance the vote will be on Saturday. If necessary, they can hold it open as long as they want until Daines gets back early Sunday morning. I think the record vote length is 6 hours, but there’s no hard limit.

There’s a key cloture vote tomorrow morning that will show where people stand. If cloture passes with a spare vote, they’ll vote Saturday. If it passes without a spare vote, they’ll probably still vote later on Saturday and just plan on leaving it open until Daines flies in. McConnell has been saying all week that there would be a final vote this week, so he needs to save face by at least starting the vote this calendar week.

If there’s a long vote, CNN will likely sperg out and track the flight the entire time while their weekend anchors slowly descend into insanity and madness.

Somewhat off topic but I was reading a magazine while waiting for my dentist and there was an article lamenting the fact that 2/3's of American women are on SSRIs and wondering why there was such a huge gender gap in anti anxiety drug use. Maybe telling women that there are rapists around every corner and that every man they meet is two minutes away from raping them isn't good for their mental health or something?

Any sane person would call that psychological abuse. It makes me wonder how many Democratic congressmen and senators are in the pockets of the big pharmaceuticals.

I know it's anecdotal, but most of the feminists I've met usually had daddy issues, so it wouldn't be surprising that more than a few would get off to the idea of a father figure bossing them around or making decisions for them.

Honestly though, what do you guys think of the view count on the SNL video?
View attachment 559375
That looks like a lot of idiots.

I noticed the viewcount for that video became artificially inflated overnight after that "soyboy roundhouse kicks pro lifer" video started trending. I say artificially inflated because SNL is a zombie show and many of the older alumni have long disowned it as a husk of it's former self. Also consider that it's source, NBC, is a den of sexual rapists' and just the mere fact they think they can talk down on Kavanaugh or anyone else is indicative of how immensely disconnected and predatory the "mainstream" media is.

The problem applies to incels too. Destroying the importance of community and family was the first step down a slippery slope.

That's why the left go after straight, white men so hard right now. Destroy what's normal and replace it with degenerates like fags and troons and you destroy the structure of community, leaving kids to be raised by tech and the state, indoctrinated to be good little robots into the LGBT immigrant globalist new world.

This is what happens when you remove shame from society and make normality a taboo.

But as we know, #MeToo got rid of all the sexual predators in Hollywood so now they have the moral high ground to lord over the plebs of Middle America again.

I guess because there's not really any evidence to say he didn't do it either. I like to assume people claiming to be sexual violence survivors are telling the truth (especially since I'm :optimistic: and want to believe most people aren't awful enough to do something as shitty as lying about rape). Therefore I guess I don't want to write her off as definitely lying without any undeniable proof she is (like a record showing she wasn't even living in the same state as him the year it happened or some shit like that).
The thing is, it's not as simple as "she's lying or she's not". Eyewitness testimony is notoriously shitty.

There's been psychological studies done about it. Researchers have been able to plant false memories in people with carefully structured interviews and prodding. These memories feel 100% real in these people's heads. They can't tell the difference. It's like Total Recall shit.

On its own, your mind will fill in gaps in shoddy memories automatically.

We can't confirm such an event happened. In order to completely confirm that it happened, we need to establish when, where, and the specifics (like who was at the party).

Considering that, here's the variables:
  • she's wavered on when it happened over the years. at least 3 years range
  • she's wavered on where it happened. if she narrowed it down to a single summer, how many house parties were there in that part of the county that summer?
  • and who actually raped her. she didn't name Kavanaugh for awhile
It's a matrix of several variables. The number of candidate parties might be in the 4 digits, and countless potential rapists. If she reported this allegation two years after she graduated high school (not 30 years later) I might cut her a break on missing one of these elements.

But no, this recollection is swiss cheese.
I think it's also possible something happened between her and Kavanaugh, just not something as serious as she's claiming. Like he tried to make out with her and she shoved him off and that was the end of it or they consensually fooled around and she later regretted it, shit like that.

Idk the fact that her claim is that he almost raped her instead of that he flat out raped her makes me think there might be a grain of truth to the story. It feels like if you're gonna concoct a false accusation completely out of thin air, you might as well go with full blown rape instead of just attempted, especially since that was the claim in most of the major, proven false accusation cases.

The idea that someone did try to rape her, just not Kavanaugh is interesting and would explain a lot. I'm gonna go out on a limb and say for now that's probably what most likely happened.
Actually, I think that's less likely. I think there'd be more people attesting to the existence of the party itself if that was the case. We can't even establish the event itself.
Idk I'm high as fuck right now*yawn*
Jealous, I'm on a THC break because my tolerance is sky high.
