Law Justice Brett Kavanaugh Megathread - Megathread for Brett Kavanaugh, US Supreme Court Justice

they're good justices, brentt

https://www.cnbc.com/2018/07/05/trump-picks-brett-kavanaugh-for-supreme-court.html

President Donald Trump has picked Brett Kavanaugh, a federal appeals court judge with extensive legal credentials and a lengthy political record, to succeed Justice Anthony M. Kennedy on the Supreme Court, NBC News reported.

Kavanaugh, 53, is an ideological conservative who is expected to push the court to the right on a number of issues including business regulation and national security. The favorite of White House Counsel Donald McGahn, Kavanaugh is also considered a safer pick than some of the more partisan choices who were on the president’s shortlist.

A graduate of Yale Law School who serves on the U.S. Court of Appeals for the D.C. Circuit, Kavanaugh has the traditional trappings of a presidential nominee to the high court.

If confirmed, the appellate judge would become the second young, conservative jurist Trump has put on the top U.S. court during his first term. Kavanaugh's confirmation would give the president an even bigger role in shaping U.S. policy for decades to come. The potential to morph the federal judiciary led many conservatives to support Trump in 2016, and he has not disappointed so far with the confirmation of conservative Supreme Court Justice Neil Gorsuch and numerous federal judges.

At times, he has diverged from the Republican party’s ideological line on important cases that have come before him, including on the Affordable Care Act, the 2010 health care law which Kavanaugh has declined to strike down on a number of occasions in which it has come before him.

Anti-abortion groups quietly lobbied against Kavanaugh, pushing instead for another jurist on Trump’s shortlist, 7th U.S. Circuit Court of Appeals Judge Amy Coney Barrett, ABC News reported in the run-up to Trump’s announcement.

Kavanaugh received his current appointment in 2006 after five years in the George W. Bush administration, where he served in a number of roles including staff secretary to the president. He has been criticized for his attachment to Bush, as well as his involvement in a number of high-profile legal cases.

For instance, Kavanaugh led the investigation into the death of Bill Clinton’s Deputy White House Counsel Vince Foster, and assisted in Kenneth Starr’s 1998 report outlining the case for Clinton’s impeachment.

Democrats criticized Kavanaugh’s political roles during his 2006 confirmation hearing before the Senate Judiciary Committee.

“Your experience has been most notable, not so much for your blue chip credentials, but for the undeniably political nature of so many of your assignments,” Sen. Chuck Schumer, D-N.Y., said at the time.

“From the notorious Starr report, to the Florida recount, to the President’s secrecy and privilege claims, to post-9/11 legislative battles including the Victims Compensation Fund, to ideological judicial nomination fights, if there has been a partisan political fight that needed a very bright legal foot soldier in the last decade, Brett Kavanaugh was probably there,” Schumer said.

Kavanaugh's work on the Starr report has been scrutinized by Republicans who have said it could pose trouble for the president as he negotiates with special counsel Robert Mueller over the terms of a possible interview related to Mueller's Russia probe. The 1998 document found that Clinton's multiple refusals to testify to a grand jury in connection with Starr's investigation were grounds for impeachment.

In later years, Kavanaugh said that Clinton should not have had to face down an investigation during his presidency. He has said the indictment of a president would not serve the public interest.

Like Trump's first nominee to the Supreme Court, Neil Gorsuch, Kavanaugh clerked for Kennedy. If he is confirmed, it will mark the first time ever that a current or former Supreme Court justice has two former clerks become justices, according to an article by Adam Feldman, who writes a blog about the Supreme Court.

Kavanaugh teaches courses on the separation of powers, the Supreme Court, and national security at Harvard Law School and Yale Law School, and does charitable work at St. Maria’s Meals program at Catholic Charities in Washington, D.C., according to his official biography.

https://www.washingtonexaminer.com/...ett-kavanaugh-nomination-by-a-28-point-margin

After a blistering confirmation battle, Justice Brett Kavanaugh will take his seat for oral arguments on the U.S. Supreme Court with a skeptical public, a majority of which opposed his nomination. However, Democrats may not be able to exploit this fact in the upcoming elections as much as they hope, because the independent voters overwhelmingly disapprove of their own handling of the nomination by a 28-point margin, a new CNN/SSRS poll finds.

Overall, just 41 percent of those polled said they wanted to see Kavanaugh confirmed, compared to 51 percent who said they opposed his confirmation. In previous CNN polls dating back to Robert Bork in 1987, no nominee has been more deeply underwater.

What's interesting, however, is even though Democrats on the surface would seem to have public opinion on their side, just 36 percent approved of how they handled the nomination, compared to 56 percent who disapproved. (Republicans were at 55 percent disapproval and 35 percent approval). A further breakdown finds that 58 percent of independents disapproved of the way the Democrats handled the nomination — compared to 30 percent who approved. (Independents also disapproved of Republicans handling of the matter, but by a narrower 53 percent to 32 percent margin).

Many people have strong opinions on the way the Kavanaugh nomination will play out in November and who it will benefit. The conventional wisdom is that it will help Democrats in the House, where there are a number of vulnerable Republicans in suburban districts where losses among educated women could be devastating, and that it will help Republicans in the Senate, where the tossup races are in red states where Trump and Kavanaugh are more popular.

That said, it's clear that the nomination energized both sides, and that the tactics pursued by the parties turned off independent voters in a way that makes it much harder to predict how this will end up affecting election outcomes.

Speaking if Michael Moore, he's been having a rough time defending himself against allegations made by his ex-wife, who looks for all the world like his goddamn sister. Look at this shit:

Not the first time. Murkowski has been voting against the majority of things her fellow republicans have been voting in favor of for years and she's been critical of Trump quite a few times, often calling his decisions and those of her fellow reps "cruel and tragic". She was also against Trump's choice for secretary of education. Susan Collins is the other notable republican who often sides with Murkowski, often opposing Trump and fellow reps and she supported the majority of Obama's choices. When all the other reps in the senate vote yes, you can bet Collins and Murkowski will vote no. A suspicious duo who loved Obama and dems. They've even been referred to as the "liberal Republicans". Basically embodying everything wrong with both parties.
So she's basically a neocon RINO. Good to know.

Collins is a fucking snake. She has a horrible reputation in Maine political circles because she is a conniving bitch with no principles. Angus King snuggled up to her when he got in as well. She is also horrible to work for. Collins isn't a Sheila Jackson tier horrible cunt to her staff, but bad enough that I wonder why good people on her staff stick around.

Okay, am I crazy or does the one in the hijab look like a white girl/guy wearing dark makeup?

That's the leader of the Women's march and notorious Islamist Linda Sarsour. She's pro-FGM, anti-semetic, anti-capitalist, vocally supports Palistianian terror against Israel and terror attacks against the U.S. yet she is a leader of the women's march because lol.

Organizes the Women's march. Wears a garment associated with the subjugation of women. I have got to wonder if she remembered to pack her suicide bra for the day of Kavanaugh's confirmation.

I love how leftists are comparing the Trump Presidency to "A Handmaid's Tale," a fictional show where women are required to wear modest clothing against their will ... And yet they have Sharia Law supporter Linda Sarsour as the leader of their Women's March as she "Muslim-splains" why hijabs are a symbol of liberation for women.

L-O-fucking-L. The projection couldn't get any stronger than this, right?

Hmmm? The plot thickens. It seems Grassley is not done investigating. He is just done investigating Kavanaugh.

https://dailycaller.com/2018/10/05/leland-keyser-felt-pressure-change-story/

When Christine Blasey Ford alleged she had been sexually assaulted by a then 15-year-old Brett Kavanaugh, she offered the name of a female friend who she said was at the party with her – Leland Keyser.

Keyser, through her lawyer, denied any memory of such a party or knowing Kavanaugh at all. Since that original statement, the Wall Street Journal reports, Keyser was pressured to change her statement to be more supportive of the claim.

Keyser “told FBI investigators that she felt pressured by Dr. Ford’s allies to revisit her initial statement that she knew nothing about an alleged sexual assault by a teenage Brett Kavanaugh, which she later updated she believed but couldn’t corroborate Dr. Ford’s account,” according the the Journal.

One of the people Keyser told investigators had reached out to encourage the change was former FBI agent and Ford friend Monica McLean. McLean is the woman an ex-boyfriend of Ford’s swore in a statement to the Senate had been coached by Ford on how to handle a polygraph test, contradicting her sworn testimony. McLean issued a press statement through Ford’s lawyers denying the allegation.

The Journal reports Keyser told the FBI McLean “had urged her to clarify her statement” because her original statement denying any knowledge of the party Ford described “was being used by Republicans to rebut the allegations against Judge Kavanaugh.”

“The friends told Ms. Keyser that if she intended to say she didn’t remember the party – not that it never happened – that she should clarify her statement,” the Journal continued.

McLean’s attorney, David Laufman, released a statement denying any pressure was applied. “Any notion or claim that Ms. McLean pressured Leland Keyser to alter Ms. Keyser’s account of what she recalled concerning the alleged incident between Dr. Ford and Brett Kavanaugh is absolutely false,” the statement read.

On Thursday night, Republican Sen. Chuck Grassley sent a letter to Ford’s attorneys that, among other things, requested they “please turn over records and descriptions of direct or indirect communications between Dr. Ford or her representatives and any of the following: (1) U.S. Senators or their staffs, particularly the offices of Senators Feinstein and Hirono, other than your communications with me and my staff in preparation for the September 27 hearing; (2) the alleged witnesses identified by Dr. Ford (Leland Keyser, Mark Judge, and Patrick ‘P.J.’ Smyth); and (3) Debbie Ramirez, Julie Swetnick, or their representatives.”

In her testimony before the Senate Judiciary Committee, Ford said she had not talked with Keyser for years.

https://dailycaller.com/2018/10/05/grassley-ford-witnesses/

Senate Judiciary Chairman Chuck Grassley sent a letter to Dr. Ford’s legal team late Thursday night asking for all of their communications with specific Democratic senators, the alleged witnesses to her getting assaulted, as well as the other alleged victims.

Grassley specifically asked for all direct or indirect communications between Ford or her legal team and:

“(1) U.S. Senators or their staffs, particularly the offices of Senators Feinstein and Hirono, other than your communications with me and my staff in preparation for the September 27 hearing; (2) the alleged witnesses identified by Dr. Ford (Leland Keyser, Mark Judge, and Patrick “P.J.” Smyth); and (3) Debbie Ramirez, Julie Swetnick, or their representatives.”

The chairman did not specify what spurred this request. However, the Wall Street Journal may have uncovered a possible reason for it.

The WSJ reported on Thursday night that Keyser, Ford’s life long friend, was pressured to revisit her initial statement. She reportedly accused another one of Ford’s friends, Monica McLean, who is a retired FBI agent, of applying said pressure. (REPORT: Ford’s Friend Felt Pressure To Change Story Denying Knowledge Of Party, Kavanaugh)

McLean reportedly told Keyser that the Republicans would use her sworn statement to discredit Dr. Ford.

In Keyser’s statement, she said that she had no recollection of any alleged incident, and had never met Brett Kavanaugh. Keyser also later clarified that she believed Ford, but could not corroborate her story. (RELATED: Report: Another Person Who Allegedly Has Knowledge Of Kavanaugh Accuser’s Assault Has ‘No Recollection’ Of Being At Party)

McLean’s name only recently surfaced in the Dr. Ford saga.

Earlier this week, Brian Merrick, an ex-boyfriend of Dr. Ford’s, came forward and said that he witnessed Ford help McLean “prepare for a potential polygraph exam.”

“Dr. Ford explained in detail what to expect, how polygraphs worked and helped McLean become familiar and less nervous about the exam. Dr. Ford was able to help because of her background in psychology,” his statement read in part. (RELATED: Report: Dr. Christine Blasey Ford’s Ex-Boyfriend Says She Coached A Friend Before Taking A Polygraph Test)

Merrick’s statement directly conflicts with Ford’s testimony in front of the Senate Judiciary Committee last week. She said she had not ever coached or prepped anyone prior to the administering of a polygraph examination.

At this point, it’s unclear what Ford’s communications with Deborah Ramirez or Julie Swetnick could turn up.

Grassley also asked again for Ford’s “therapy notes, polygraph materials, and communications with The Washington Post.” [ /spolier]

e.

The ex FBI agent friend of Ford’s, that Ford coached about polygraph tests has been contacting and pressuring another witness, Leyland Keyser, the woman named as the other girl at the party, who said under oath that it never happened, to change her story. Hmmm? Something is afoot besides the votE.

Grassley is demanding Ford’s contact records with witnesses. The other zoo crew of accusers, and most interesting Diane Feinstein and Mazie Hirono.

Yeah, now you have 30 hours of debate and then finally the big vote.

Thanks. This circus has been headache-inducing. I've kept silent about it because, as I wasn't there, I have no idea what happened or didn't happen decades ago. It's pissed me off how some folks assume the man will push his personal beliefs to further a supposed agenda instead of recognizing that he will decide matters based on legal precedent keeping in the spirit of the constitution, etc.

Both Lefties who think he's going to immediately plunge the nation into Handmaid's Tale-type dystopia and Righties who think he's immediately going to overturn Roe v Wade and also stop them gays from marrying are bound to be disappointed, which equals amusement to me.

Hoo boy, it's like the Republicans don't need to do any more work. The Democrats just keep destroying themselves.

I've rarely seen any right-wing news or twitter outlets declare that (at least not in any reasonably large abundance). Only ones I've seen making such claims in abundance that Kavanaugh will do just that are left-wing news outlets or blogs using fear-mongering. Only right-wings I've seen opposing Kavanaugh are /pol/ and some neocons in a similar vein to Murkowski. Half of /pol/ is just screaming that Kavanaugh is actually a "anti-white spy" in cahoots with "Trumpstein and Israel", while diehard neocons have been firmly against Kavanaugh from the start and are running off to join the dems while declaring Trump and Kavanaugh traitors to America.

This is bizarre, like a daytime soap. Imagine if this takes Feinstein down, let it be true.

I’m a registered Democrat but I fucking hate the democrat leadership. I will not vote for anyone that supports these idiots and I’m not moving further left. They screwed up and embarrassed themselves because only morons bought into this shit.

At this point, I think everyone who is remotely sane, regardless of politics, can agree the fruits and nuts who have been contributing to this farce are worthy of mockery, and if this fumigates some of the more noxious politicians while guaranteeing we will never lack for sodium, so much the better.

That said, I'm going to visit a warehouse supply outfit, the salt from whatever happens when they vote on Kavanaugh for real will mean we'll need some huge containers to store all the tears we're gonna harvest.

It's no surprise when Murkowski's 2010 election was probably rigged against Joe Miller.

What, do you live in a liberal bastion where Republicans don't even bother to run? Tucker Carlson is a registered Democrat in Washington D.C. so he can vote in the primaries just for this reason.
