On ComicsGate Live, EVS is claiming that GoFundMe does not permit campaigns to raise funds for legal defense. I was curious, so I checked the rules:

…you agree to not use the Services to:

A. to raise funds in connection with any of the following activities or items, including by establishing or contributing to any Campaign with the implicit or express purpose relating to any of the following: …

8. campaigns deemed by GoFundMe, in its sole discretion, to be in support of, or for the legal defense of alleged crimes associated with hate, violence, harassment, bullying, discrimination, terrorism, or intolerance of any kind relating to race, ethnicity, national origin, religious affiliation, sexual orientation, sex, gender or gender identity, or serious disabilities or diseases;

Arguably, this is a defense of a crime associated with harassment and bullying, but there's still plenty of wiggle room for GFM to not take it down if they don't want to; for example, they could argue the rules only apply to defense in criminal cases, not civil ones.

That being said, I think this rule is dumb and people should be able to fundraise their legal defense no matter what they're accused of. Justice is expensive.

They probably don't want to get involved in criminal defense funds because they can't investigate them and it would be a really great way to end up sucked into some money laundering fiasco.
 
@AnOminous I remember Jack Thompson getting thrown off his court case against Rockstar for all the spergery on the internet back in the day. Is it possible that Zaid could get reprimanded for this?

In September, I was sued by a man named Richard Meyer, one of the perceived leaders of an online movement called “ComicsGate” that I and many comics professionals strongly feel has unfairly and offensively targeted women, people of color, and LGBTQ+ creators working in our industry. Mr. Meyer alleges that I deliberately and singlehandedly blocked the publication of one of his comic books. I did no such thing, and I believe this lawsuit is his effort to try and intimidate and silence those of us who stand up publicly against bigotry and racism and who continue to defend diverse creators from harassment..

Mr. Meyer is also suing me for defamation, claiming that in taking a stand against ComicsGate, I have defamed him by allegedly referring to him as a “racist,” “serial harasser of minorities,” and as “affiliated with white supremacists.” Here is just a small sampling of Mr. Meyer’s social media posts that can be judged by their content:

Even though I am confident that Mr. Meyer’s claims are entirely meritless, lawsuits are expensive and time-consuming. If I were wealthy, a lawsuit wouldn’t be much of an issue, but I work, y’know, IN COMICS. My expenses already tally more than $25,000, with much larger bills to come. Still, for nearly 40 years, I’ve been lucky enough to write stories featuring heroes we all know--characters like Superman and Captain America--who taught me at an early age to stand up for kindness, equality, and tolerance. None of those show that he is specifically a "racist", a "serial harasser of minorities", or "affiliated with white supremacists" as opposed to Mark Waids tweets which shows he called Meyer those very things.

It's going to be interesting to see how quickly and how far Waid's gofundme will go, he's gotten 4.2k in 5 hours so far. So far it looks like Zack's got enough money to fund his by himself and hopefully Waid will have to cover his legal costs after losing. One thing is for certain, CG is chomping at the bit to throw money at Zack and he will far outperform Waid's gofundme if needed.

Didn't waid defame Meyers more in his go fund me? Am I reading this right. Hes getting for saying x, so he doubles down and says x more? Is this like the chewbaca defense from south park?

I honestly can't see them win the Tort lawsuit. The defamation suit definitely I can see it being thrown out but, outside of threatening the judge, I don't see them winning the Tort.
But doesnt the defamation sort of go hand in hand with the tort case? Arent they kind of linked together? Wouldnt an outright dismissal of the defamation case be premature when discovery hasnt happened?

There's not any factual dispute that I know of as to whether Waid said what he's accused of saying, just whether it's actionable defamation. It doesn't have to be actionable defamation to constitute tortious interference, though.
 
Can't you argue for a retrial based upon misconduct by your counsel? I know it's an option, just rarely successfully argued.

There isn't an ineffective assistance of counsel defense in a civil case. Your only real option is to sue them for malpractice and hope their insurance covers it if they can't.

They wouldn't need to refile the entire case, just make a pretty straightforward motion to enter it into evidence.

Maybe in legal terms, the two mean the same thing, but if not, then I think that, if IGG has to be called in to rule on the matter, there's wiggle room for them to rule in favor of closing the campaign, and just as much room for them to rule in favor of leaving it open.

Yes it says "legal fund for a criminal defense," but this isn't a criminal case, this is a civil case. As much of a piece of manbaby garbage as Waid is, he hasn't committed a crime by interfering in a contract or defaming yaboi.
