Okay, the official response is supposed to be filed by this friday and still no response from Waid and Zaid. Think they'll try asking for another extension again or will they file before the deadline is up?
 
From listening to Zack’s video last night, there’s almost no chance his lawyer doesn’t object to another extension. His lawyer was irritated by the way the local firm asked for an extension without noting the whatever thing about Zaid being admitted as co-counsel & then another firm from Austin supposedly requesting an extension too. I’m really curious who this 3rd firm is & why they’re involved.

I'm expecting it on Friday. It should either be an answer or more likely a motion to dismiss under FRCP 12(b)(6), or some other responsive pleading although those two make up the vast majority of such.

If they don't, it will reflect very poorly on Zaid.

If they really did that, it's incredibly uncollegial and unprofessional. Part of why people politely go along with requests like this is they assume opposing counsel is acting on the level, not hiding the real reason they're asking for an extension.

It also makes Zaid's public tantrum about being said to be off the case even more pathetic and dishonest. Nobody had any reason to think he was on the case at all.

One thing I can't find myself understanding is just how dead certain some people on Twitter, Reddit and such are that Mark Waid will win. Granted, anything can happen in a courtroom and I'm not an attorney in Texas (or tort law) but so many people are convinced its a dead lock. I just don't get it. It seems the very possibility that Waid will falter before a judge can't even enter their minds.

I don't understand - the majority of the facts aren't in question and the legal issues are straightforward enough for a common layman to follow so why can't they even voice the possibility of failure?

I don't understand - the majority of the facts aren't in question and the legal issues are straightforward enough for a common layman to follow so why can't they even voice the possibility of failure?

* They think Mark Waid is a righteous crusader, not a bullying asshole throwing his weight around to intimidate someone into breaking a contract.

* The ones who do understand his actions think Meyer had it coming, and somehow a judge will be convinced to see it that way.

* Most of them are too stupid to understand the tort in question. They think it's just about saying mean things, and that's supposed to be ok. They don't understand the legal obligations that attach when a contract is formed, or what a problem it is if you induce someone to breach it. That would be forgivable. Refusing to educate themselves about it before declaiming on Twitter how Meyer is gonna get his clock cleaned because he's a bad bad Naziman is not.

Because Meyer is a nazi and Waid is the good guy who's trying to stop him.

The gravamen of it isn't defamation or false statements, as such, at least in Texas.

It is that it is unlawful to breach a contract and it is also unlawful to procure the breach of a contract by another. It is generally considered worse to procure the breach of a contract in which one has no legitimate claim of right.

I think it is fundamentally a question of worldview. In theirs, the narrative is all. If they can confidently articulate and control the narrative, then magical things will happen. At one time, they and like-minded folk controlled the publicly available narrative, so this very often worked. That has changed now. They have not adapted to this change. Therefore, they keep trying the same stupid crap, and reacting with the rage of an infant denied a treat when it fails to work yet again.

When they learn from this, they will be dangerous again. However, they will also be changed by the experience of learning, and I'm not sure what they'll be like then. It should be interesting to find out.
 
EVS has started his stream for the night. Last night, he said he'd have the Pierce-Outlaw 911 recording, but I don't think he's mentioned it tonight so far; he's only talked about the GFMs and his interview with Waid last year. Really hoping he comes through with the tape.

ETA2: My mistake. He says he knows how to get the tape, but apparently getting the recording involves faxing someone and he doesn't know how to do that in current year. Apparently Rekieta is helping. "I promise you we will have this tomorrow."

ETA3: EVS is sharing these snippets of emails and text messages Waid sent him after he found out that someone was in the chat mocking him during his interview with EVS. More evidence of Waid sperging out when things don't go his way.

It because they believe that this is a Defamation lawsuit. Just look at Waid's GoFundMe and articles talking about the GFM, no mentions of the Tort (AKA the main lawsuit). There is a defamation suit attached to the main Lawsuit (Tort) but it's pretty much just tacked on.

Of course he wasn't getting it same day. All this shit happened late night Friday. It's crazy to think the government will get you anything in less than a day. It probably won't be tomorrow either. But hopefully this week. Always take EVS promises with a grain of salt. At base he is a car salesman. The car might really be nice, but he will make it sound AMAZING.

Because the only people disagreeing with them are racist Nazis and they are the ones fighting for justice and the oppressed. Also, they have the legal genius Jamal Igle Esq. on their side.

Quite a few of his defenders in the industry mention that he helped them get their foot in the door or helped them at some point so he can't do any wrong, as if that's mutually exclusive.

All that really says is they're easily bought and corrupted, and that he apparently has a good sense for people with no spines or souls.

I know it's bad just repeat what someone else said with "I agree" tacked onto the end, but I really think this is the issue. Look at how few anti-CG articles and tweets even mention the tort. Even the go fund me for the "defence fund" doesn't mention it at all. I don't know if this is deliberate misleading on the part of anti-cg, or if people just don't understand it or it's implications.

At times it seems like anti-cg expect Mayer to goose step into the courtroom in a SS uniform covered in the blood of a recently lynched minority, give a nazi salute to Trump, and then proceed to be blasted by the judge as Waid and Zaid deftly counter every "b-b-b-but" that comes out of Mayers mouth. These are the same kinds of people that assumed the Kavanaugh hearings were a rape trial, and bringing up his record as a judge was a feeble attempt to dodge the accusation, instead of the other way around.

Feels before reals in a nut shell. Waid is reminding me of Alex Mauer. Both are overgrown man children who have abused the system up until they bit off more then they could chew and the system bit back. Like Mauer, waid was able to bully his targets into doing what he wanted and nobody could really do anything about it as lawsuits are expensive. In Mauers case it was the youtube community that rallied round the flag poll and funded a lawsuit. This time its comicsgate, and in both instances the bully has failed to grasp just how fucked they are. Because they had been getting away with it for so long now.

It eventually got through Mauers thick skull and he settled, but Mauer was a general issue troon. He could not afford to die on the hill.Waid on the other hand has cash to spare, especially thanks to the GoFundMe. That is a poisoned chalice because the expectation is he will fight the good fight with it. If he instead settles with Meyer and uses the money to pay him off I think all the people donating to him will have a collective aneurism. The idiot and his idiot lawyer have painted themselves into a corner.

An archived 911 tape from several years ago? Something obscure and routine that wasn't in any way flagged for follow up? That will take a few days at a minimum.
