Probably not. Monica has yet to prove she has "25 women" ready to go to court over this. Any time someone tries to pin down her bullshit she deflects, dodges the question, or screeches about harassment.

It's been what, three or so weeks since this broke? In those three weeks if they had any evidence of their accusations being true they have no reason to hold out on it unless legally ordered to. If they haven't ponied up evidence in all the time they've been losing their shit on Twitter then in all likelihood it just doesn't exist. And what evidence has been given has been all fabrications and misdirection which isn't a great look for team #KickVic

Once again “I have first hand knowledge of how awful he was” but no actual description of what constitutes “awful”. No descriptions of what he did. And even admits she enjoyed the attention from him as a fan. It keeps looking like a vague whisper campaign of everescalating rumors. Yet nobody can say what the actual supposed crimes are. The only fully specific complaint I have seen is he touched Monica Rial’s hair. But considering we have video above of her initiating similar friendly/casual contact, and given they blatant lies she has already been caught in, I’m not currently viewing her as a particularly credible witness for sexual assault or harrassment. Not without something much more compelling.

And can you imagine presenting some of this clear history of not simply an Anti-Christian Bias, but seemingly a specific desire to attack and defame someone for their Christian Faith, to a Texas Judge and Jury? Talk about a compelling witness.

I'm not really one to attack the source of an argument unless it's coming from someone who has a history of making really, really obvious bad faith arguments, but I'll make an exception for Mother's Basement. Dude's an asshole and deserves to be ridiculed for his shit during Comicsgate alone.

I'm curious, apparently according to Marchi there have been "dozens upon dozens upon dozens of reports" I've never actually seen these reports. When pressed people say it happened in another twitter thread. When I go there, there are two different types.

"I hugged him at a fan-con some years ago, I didn't think anything of it at the time, but now I feel uncomfortable."

"I saw him hug a child/I saw him kiss someone underaged during a fan photo and I didn't think it was appropriate"

On one of his livestreams, Nick went every single accusation against Vic on the Beneath the Stairs site (where many of Marchi an Rial's accusations stem from). 98% of them do not amount to anything criminally actionable. Like at all. "He made me uncomfortable" is about the extent of most of them, and the police aren't going to arrest anyone for that. This is on top of them being completely sourceless, well beyond any statute of limitations (not that any of them were properly sourced, had evidence, or were criminally actionable in the first place), and for all intents and worthless, are useless.

But do you know what I noticed? In Marchi's tweets above? The number of likes. 17 here. 33 there, a handful at best. This is a common occurrence with her. She rarely gets more than a few hundred likes. It's only her most vitriolic, hateful, and deranged tweets that get over 1,000, and only the ones big enough to get big attention by flogging about believing survivors that get higher than this. Jamie Marchi has about 20,000 followers. Monica Rial has close to 60,000 followers and is doing little better, with only her most autistic screaming getting penetration.

Meanwhile, let's look to Youtube, a platform where you can get likes, dislikes, and comments and responses. Let's take a look at YellowFlash, a channel with around 42,000 subscribers. He's been getting over 80,000 views per video, with an over 97% positive feedback rate. More people liked one of his videos covering this mess than liked hundreds of tweets by Jamie Marchi or Monica Rial. On other channels like Hamblyburger Helper's, you have 500,000 subscribers, over 120,000 views on his Vic videos and over 10,000 likes, and Hambly isn't even covering this the same way others are because he covers every bit of stupid autism he can find.

What this implies is that this is a fucking PR disaster on the Funimation side of things. Twitter has never been real life, a fact that seems to flummox many a lolcow, but what we're seeing here is a bunch of idiots getting it into their heads that they can shout down their critics like they always have, and either unaware or uncaring that they crossed a line that is going to screw them.

These people are getting a dopamine hit from the likes and retweets and similar shit, and if they don't get it, they ramp up the insanity of their screeching, often going from exaggerating to just straight up making shit up. Oh and just to dig into this piece of stupidity, since it’s going around.

1. He’s going to sue for wrongful termination! No you fucking morons. He is an Actor. This means he is not simply an at will contract employee. He has a specific written contract. At least one for each production he is involved in. Texas’s at will stuff doesn’t come into play. If he were to sue Funimation it will be for Breach if Contract, and for Defamation regarding that breach. His discovery will include that “investigation”, everyone who took part, all witnesses to it, etc. He will further sue these “witnesses” for Tortuous Interference and Defamation. The same goes for Rooster Teeth.

2. In Libel and Defamation the Burden of Proof is on the Defendant you unrepentant moron! The defendant can use truth of what they said as a defense, and they better be able to prove it. The Plaintiff just has to say “this is not true and is defamatory”. Now since Vic meets the standard for Public Figure, he will also have to show Malice on the part of the defendant. And boy, given what we see on Social Media from these twits any Lawyer could prove malice while drunk. Monica is the gift that keeps on giving in this regard. But even Marzgurl’s little tweet about “once we finish with Vic we can start going after others, in order to clean out the community”. HooBoy, is that a fun bit of conspiratorial behavior. Malice!

3. The Defendant was the Direct Cause of the Financial Damage. Nope! Try again. If the Defendants actions contributed to the breach of contract or loss of employment, tarnishment of reputation and value of business. And those actions were baseless or defamatory, they are fucked. And Texas has a pretty broad range of how fucked they are.

4. “The defendant lied or the defendant believed they were telling the truth.” The burden of proof lies on the defendant in this situation. They will need prove the defamatory statements were true, or they had the reasonable expectation that they were based on tests of evidence. Many of the likely defendants would be considered some form of press or publication. ANN or Marzgurl for example. They report on the industry. One hopes they ran their reporting past legal first, otherwise they are likely fucked. If they failed to do due diligence and reported false and defamatory information, without correction or retraction they are fucked.

5. Sony isn’t going to touch this mess. If they do they will quickly and quietly settle, then fire everybody. They sure as hell aren’t going to indemnify any of this parade of clowns save Funimation management. The voice actors are on their own. Sony/Funimation will cop to acting on information given to them in their “investigation”. If that information is questionable they will settle and happily throw those witnesses under the bus. There is now a stench of Anti-Christian discrimination in this matter. They will not want to take ownership for that, as the costs of that can be staggering. Right now this is largely confined to the nerd communities. But if it breaks out that Sony and company are discriminating against Christians? On top of the legal liabilities that is global brand damage. Yeah Sony is not gonna side with the SJW twits on this. This is not a hill for them to die on. They are still hurting from Ghostbusters.

6. The people being sued had better have a full list of all those dozens of others they are referencing. Not just third or fourth hand info. Oh and yes the “widespread conspiracy” against the plaintiff is easily shown. It’s called #kickvic.

This could go very badly for quite a few of the #kickvic crew.

Not true. The burden of proof falls on the plaintiff to establish by a preponderance of the evidence every element of the cause of action. That a statement is false is one of the elements of a defamation claim, and is thus part of the plaintiff's case-in-chief.

It's also a jury question so isn't subject to dismissal or summary judgment if it remains a disputed material fact.

(It's the other way around in the UK which has utterly fucked defamation law that doesn't fly here.)
