Alright, I've had a thought today. This story revolving around the CP stream has changed a few times. Started off with them sweeping it under the rug and acting like it never happened, then they were exposing a cp ring because instagram wasn't doing anything and andy jumped the gun on the stream according to Toon. Andy in the video seems to talk about having this folder that someone gave to him, says at one point he has to edit the image, later this changed to the images were just on instagram, then it changed further to the images were already edited, then I heard something today about andy was just playing a stream of the girl going through the folder?

But besides this grand story walking back more and more. I have an observation on all of this that hasn't been talked about yet. Where is Andy's computer? Andy moved to America for a permanent or semi- permanent living situaton to the point that Ralph put him on his phone plan because he would be here that long. Andy came to make all these videos and streams, but why did he not bring his computer with him? A Youtuber with hundreds of thousands of subscribers left his computer that he already has set up for image editing, video editing, streaming etc. to come to some shit hole apartment seperate from Ralph and is now borrowing Ralph's old laptop and using some cutrate T mobile service to do all his streaming instead of doing more professional stream in front of a decent computer.

So I have a theory and I will only submit it as a theory. I think Andy read what we said in these threads and heard the line that Null said on Toon's stream about a solid state drive keeping a residual image of the code. I think he might have taken that "hammer" solution advice he got and the reason for the crappy irl streams only and using Ralph's old broken down laptop is he had to ditch his computer to hide the evidence of a 34 gig cp folder.

The simple answer surrounding the CP stream is that nobody wants to watch it to confirm what really happened even though we have the entire thing archived on this very website afaik, for obvious reasons. The story keeps changing because there's quite a few people here who are sympathetic to Warski and Ralph in the same way that Sargon and Tonka's fans are sympathetic to them.

I don't get the psychology behind it because I'm just some dude, but that's what's been playing out. The facts are:

1: Andy said that he was editing a photo during that stream, which would either mean he took a screenshot of CP and edited that, or he had the files on his computer.

2: Andy during the stream mentioned "sending it/them" over to Ralph, which would mean either the screenshot, the edited version, or the files themselves.

3: What was shown on the screen during various points of the stream were what they themselves described as child pornography.

As far as him not bringing his computer? I have no opinion on that. I don't doubt that Andy reads the farms though, seeing as Ralph does.

I just want to post my thoughts on this whole Andy and CP drama after re-watching the original livestream.
The two main points of controversy are 1. Andy showing the images of young girls from their public Instagram accounts and editing those pictures and 2. the folder that contained the CP. To go into detail about that folder: Many girls on Instagram, including many minors, would sell their nude or very lewd photos in private, and this folder was supposedly a collection of those privately sold photos that had been leaked.

Let me address #2 first: The folder was uploaded on mega.nz meaning you do not have to download the folder in order to go through it. Andy had his unnamed female friend record herself going through the folder and then played that recording on his stream. Anytime you see the folder on the screen you can see that it's opened in movie player and playing a video. Meaning Andy never had the folder downloaded on his computer and never went onto the actual folder itself on mega.nz. A little more info.
At least not on stream, obviously I don't know what anyone does when they're in private.

#1 I think is worse. The pictures Andy showed were lewd images that were posted on Instagram by underage girls. These pictures were on a large social media platform and had been reported and manually reviewed to be "okay" by Instagram. So Andy probably assumed that those pictures (which had no nudity-just lewd/sexually suggestive) were not CP. At least I think that was his assumption as if it qualified as CP then Instagram would have taken it down after being alerted about their existence.So what Andy did was edit the lewd images to be less lewd as YouTube has stricter guidelines. Yes, that means he obviously downloaded those pictures to edit them. So then it's just a matter of thinking, do those technically count as CP as Instagram determined them not to be CP?

So the only argument for Andy having CP or looking at CP was if you would qualify those pictures that he showed of the underage girls from Instagram to be CP. Now they might be, I have no idea. Like the 3rd picture in my "Example" spoiler is pretty gross, and I have no idea why Andy would show that on stream. He is such an idiot.

Andy did a LOT of things wrong. Those girls should never have been shown in the first place, they're minors and victims in the context of this situation. Andy (or any other YouTuber) should have never brought this on YouTube until there had been a formal investigation done by the proper authorities. What were Andy's motives on having that stream in the first place. Was it for money? To get away from the drama that was going on around that time? It was such a bad decision, and now the actual pedos will most likely get away without any consequences. Do I think Andy was in possession or had seen any CP? Not really as in my head that doesn't qualify, but that is most likely a kid being taken advantage of and Warski is gross for putting it on stream. Also that still makes the Metro article accurate, like the headline "[Andy] shared vile sexual images of underage girls" is true as they never claim he shared CP, but the images Andy shared are vile, sexual and of underage girls. Metro says the viewers suggested Andy gathered and distributed CP which is true as people were accusing Warski of that in the chat. Now it does imply that Andy had downloaded or seen the CP, but the article never directly states it. So I doubt there will be any lawsuits plus isn't he supposed to be suing RWW?

I called one of the coffee places they were at yesterday to tell Andy to drop the strikes to which he said he would when he got home.
I also counter-claimed the videos since they were fair-use.
YouTube sent me a notification that they had reviewed my counter claim, and reinstated my videos, and then a few minutes later they told me that Andy "has just released their copyright claim."

The optimist in me believes Andy was true to his word, we'll see how things progress moving forward though. Didn't have any issues stream sniping earlier today though.

Basically, the context around the pictures seems to be the key point in whether or not they are considered actionable instances of child pornography. These pictures, as previously stated, were posted by underage girls for what I would think in law-speak would be "lewd and lascivious purposes".

...which sort of makes your "NONE OF THESE CONTAIN CHILD PORN" technically but not legally accurate. It seems the real problem here is that they accessed it knowing what it was, as far as the legal side of it has been explained so far.

Oh okay, that makes so much more sense. Honestly all this stuff can be confusing, but I see why now it's important for the laws to be flexible on this. I actually relistened to GODWINSON's stream with Null where he said it really depends on context. He gave the example that a pedo in jail clipping pictures of fully clothed children from magazines would count as CP while parents having pictures of their naked kids in their family photo album wouldn't count as CP. Now that I really give it some thought that really is the best way to go about it. As many laws are fairly straight-forward with what's illegal and what's not so criminals can often slide through loopholes. Like if there was some strict "have to be nude/show genitals" law for CP then creeps and pedos like Austin Jones would have gotten away with it.

So then the context for Andy's situation, I'll apply it to the picture specifically with the monkey emoji's on it from my last post: Andy knew the girl was 14 years old, Andy knew that all of this was in the context of it being CP for pedos, Andy thought the images were so indecent that he had to edit out some of it for YouTube's guidelines. Yet he still showed it on stream basically distributing it more and earned money from that stream. So then it would all depend if the court of law would determine that to be CP or not. I'm of the mindset that at minimum that is a minor most likely being taken advantage of who should NEVER have been shown. Do I believe Andy is a pedo? No, not really. Although you would think someone who has had pedo allegations against him would be smart enough to know that he shouldn't touch this stuff. But then again, Andy's not really smart. I hope this time he learned his lesson to just stay away from all of this. :optimistic:
