with what the other side has, it won't be. the only way to dismiss beforehand is no cause for action (vic's reputation is in tatters and likely TI applies) or no jurisdiction.

even if there is truth to the claims, nothing public has proven it thus a case will be done and discovery will be happen unless settlement happens. then and only then can they stop discovery and all the rotten secrets of this dead industry will be splayed across the beach.
