Now you're just repeating yourself and adding nothing to the conversation with this post. I'd even disagree with this, it only makes them potentially eligible for common law marriage which is NOT the same as "legally married" until it's declared. Common law marriage does not, for example, suddenly allow someone to change their tax filing status or insurance rates until it's recognized.

Sec. 2.401. PROOF OF INFORMAL MARRIAGE. (a) In a judicial, administrative, or other proceeding, the marriage of a man and woman may be proved by evidence that:

(1) a declaration of their marriage has been signed as provided by this subchapter; or

(2) the man and woman agreed to be married and after the agreement they lived together in this state as husband and wife and there represented to others that they were married.

That's all there is, that's the absolute objective criteria set fourth by the laws of the State of Texas as to when a common law marriage is legally valid and recognized.

  1. Agreement
  2. Cohabitation
  3. Representation
Absolutely nothing else.

They don't meet 3. They do 2. 1 I'm having an issue with as it appears to be a bit more complicated than simple cohab (eg: does she use his last name? Are their financials commingled? Are they a spouse on one/the others insurance? Do they have children together - no doesn't count against them) however yes will help. Again however if you're an attorney in TX I'll defer.

What would be lulzy would be if they did go the "were married" route and then lost so they doubled their potential debt.

Now that said the question is will they attempt this avenue and abuse the lack of requirement for evidence try to backdate it to retroactively to invoke spousal privilege who knows.

So glad I didnt buy the Broly blu no matter I want to. Toei botched the color tint, and Funi stripped the Vic special feature interview.

Well it's a good thing neither my brothers nor I decided to grab a copy of the DVD when we were out yesterday; if the Blu-Ray footage is botched, the DVD may be as well (can't believe Toei did that, what the fuck). We've been considering getting it for a brother's birthday coming up, but he never put it down on his birthday list so meh. Seeing it in theaters was good enough.

But emitting the Vic interview in light of all of this is fucking stupid, and I hope Funimation gets reamed hard over that.

I understand that but the posts I replied to disputed how simple the common law marriage process is in Texas.

Now the topic has moved on to if they'll try to abuse the extremely lax evidence requirements of common law marriage to try and backdate it to retroactively invoke spousal privilege especially considering there's several early weebwars videos and posts that refer to Soye as Monica's husband thus they can point to that and say "teehee look we've been married these people who hate us even said so so why would they lie for our benefit (:"

You know I'm surprised, under Texas law falsely accusing someone of rape is only a misdemeanor but falsely calling CPS on someone is a straight felony

The relavent section would be the following

Tex. Family Code, Sec. 261.107. FALSE REPORT; CRIMINAL PENALTY; CIVIL PENALTY.

(a) A person commits an offense if, with the intent to deceive, the person knowingly makes a report as provided in this chapter that is false. An offense under this subsection is a state jail felony unless it is shown on the trial of the offense that the person has previously been convicted under this section, in which case the offense is a felony of the third degree.

(b) A finding by a court in a suit affecting the parent-child relationship that a report made under this chapter before or during the suit was false or lacking factual foundation may be grounds for the court to modify an order providing for possession of or access to the child who was the subject of the report by restricting further access to the child by the person who made the report.

(c) The appropriate county prosecuting attorney shall be responsible for the prosecution of an offense under this section.

(d) The court shall order a person who is convicted of an offense under Subsection (a) to pay any reasonable attorney's fees incurred by the person who was falsely accused of abuse or neglect in any proceeding relating to the false report.

(e) A person who engages in conduct described by Subsection (a) is liable to the state for a civil penalty of $1,000. The attorney general shall bring an action to recover a civil penalty authorized by this subsection.

false rape accusations are treated like stealing candy from a store unfortunately. i fail to see how admitting to a felony and trying to take peoples kids away makes you look like LESS of a cunt, still.
 
While we wait for the papers to drop, I want to bring up the question of Iago and Igor again. When we first got these codenames, a lot of us have tried to attach them to certain individuals, but as new information has come out, some have not been 'checked' off as far as I can tell. The general consensus has been something like Chris, Adam, or some other mysterious individual as Iago, and Shane, Ron, Monica, Marchi, and well, anyone that has been extremely vocal as Igor. We learned that Shane is not Igor over some of the last few streams with Nick.

This stands out to me because we've had a major addition to that as far as Igor is concerned. In Nick's last 2 streams with Ty, we learned that Iago and Igor are NOT in the first round of suits. This means, if it really is Funimation, Rial, Toye, Marchi...this begs the question, who is Igor? Iago is definitely the more interesting and slimy of the two individuals, but now I'm curious who the heck is Igor. All of the popular candidates are out of the picture.

This has me going back to the start of the situation; what people were 'vocal' at the start in February, and then retreated into silence. Someone who would have been a perfect candidate for Igor, but because we learned about Igor in March, they went under the radar. What VA's or 'exceptional' individuals were highly active at the crucial #kickvic stages? I think of Sean Schemmel of course, D.C. Douglas(not so sure about him), then there are some ANN people early on, and Marzgurl, who is unlikely based on how Nick talked about her maybe not even getting brought into the case since she's broke and pathetic.

Seeing the Dox of Adam from Crunchy Roll reminded me because he was one of the more interesting candidates for Iago, which reminded me to look at Igor again. Nick and Ty said we won't have a reveal of their identities until at least round 2, so even when the suit drops today(fingers crossed), we'll still be wondering for a while.

Sticking your dick in someone, or jerking off while someone else does, gives no legal protection. It's a SPOUSAL privilege, not a cuck privilege.

You guys have to be careful with that since Texas still has common law marriage, and they already meet two prongs of the 3 prong test, all they have to do now is call each other husband and wife and at that moment they're legally married per Texas Law

It's not retroactive. They've held themselves out as engaged, not as married.

There are also two spousal privileges, and neither would apply to them about this case.

There's the privilege that a spouse cannot be compelled to testify in a CRIMINAL trial against the other. The second is this:

Tex. R. Ed. 504

(2) General Rule. A person has a privilege to refuse to disclose and to prevent any other person from disclosing a confidential communication made to the person’s spouse while they were married.

Also not retroactive. SoyeBoye said as recently as yesterday that they are ENGAGED. Maybe that would have been another good reason for him to STFU but he's not very smart. After all you never know what particular dumb as dogshit thing you say that you don't think is important actually is.

I really want this to bite Rial and Soye in the ass later. The ultimate lol moment for me will be seeing Soye get told by the judge that he needs to provide evidence against Rial because they aren't recognized by Texas state law as a married couple yet. Or better yet, for him to refuse and be in contempt of court and do jail time. Because we all know that he's a galaxy brain cuck and would very much rather do jail time than go against his God.

The lynchpin of if this is felony stupid is if she actually filed a report as it's a necessary element of the felony offense, if not she can only get got on the harassment statute.

Texas Penal Code Sec. 42.07
(a) A person commits an offense if, with intent to harass, annoy, alarm, abuse, torment, or embarrass another, the person:
(1) initiates communication and in the course of the communication makes a comment, request, suggestion, or proposal that is obscene;
(2) threatens, in a manner reasonably likely to alarm the person receiving the threat, to inflict bodily injury on the person or to commit a felony against the person, a member of the person's family or household, or the person's property;

(c) An offense under this section is a Class B misdemeanor, except that the offense is a Class A misdemeanor if:
(1) the actor has previously been convicted under this section;
