But they can't exclude them from discovery and bring in a surprise witness at trial. The opposing party has to know who they are and what they will likely say in advance. Real life is not Mattlock. They generally gave to be on the witness list unless it is a rebuttal witness challenging what is essentially a lie. And even then you're gonna have azad fight.

They're already being asked to provide the names of all these people who supposedly were harassed by Vic.

And if they want to produce anyone at trial, they'll have to produce a witness list including everyone who they plan on testifying and a general description of what they'll be testifying about.

Then the plaintiff will have the opportunity to take the deposition of anyone slated to testify, as well as to subpoena them for any relevant documents and other relevant discovery. (Or considering the pool of potential witnesses in this case, it's likely most of them are also people who could be added as defendants so they could seek broader party discovery like interrogatories, requests for production and requests for admission in their own suit.)

The simply reason why Funimation is a Defendant, and Sony isn't, is because Funimation tweeted a (bullshit) rationale for his separation, and let Monica, Marchi and Soye talk mad shit about while holding themselves out as agents of the company (Funimation).

If you doubt the impact of this, look at how PULL and the like justify their belief that Vic is guilty and how frequently they mention him being fired because the investigation found him guilty. Likewise about Monica's tweets.

The defence is going to have to try to argue those tweets had little to no impact on Vic's reputation. Unfortunately for them, the kickvic movement itself is evidence of just how damaging those tweets were and how much they influenced the beliefs of "reasonable people".
