Chris-Chan Arrested and in Jail, awaiting Hearing on Monday (28-Dec-2014)

All I can say is Chris really got what he deserved. I couldn't imagine him getting off of this freely or with a warning.

What's a "normal" sentence for something like this? :\
 
In case it hasn't been mentioned, there's a big difference between "mace" and "pepper spray," even though people use the terms interchangeably colloquially. Mace is what the cops have and it's much more powerful. I was sprayed in the face with pepper spray, but just because I was wearing glasses, it had minimal effect.

Our little austic has grown up and turned into a real criminal.

I could forgive his attack on Mike as a panic driven stupid move by a scared child and his deranged mother but in the video you can see he's not panicking, he goes about calmly doing what he set out to do and then Mace'd that poor guy for what ever reason.

He was not under threat or duress so I have no pity for him. He assaulted a by stander for no real reason and thus he should pay the price for his actions just like any other adult would.

Stupidity has never been an excuse to break the law and I think Chris is about to learn this first hand.
 
The most anyone ever thought might have happened based on listening to the police scanner was he knocked on some guy's car door. I am not sure if that will end up being a misinterpretation, but either way, I assume the poster who suggested car-jacking was being facetious.

That is informative. But I would caution anyone from reading that and concluding there is a likelihood Chris will do 5 or more years in jail. What tends to happen is the prosecutor will say to Chris "Look son, (or daughter), just plead guilty to these lesser charges and do your 30 days. If you go to trial you could end up in prison for 5-20 years."

BTW, the class 6 felony (which would happen if they could not PROVE maliciousness) is:



Class 3 requires PROVING maliciousness. Not "come on guys, we all know Chris is a douche and hates men, he was being malicious". But beyond a reasonable doubt proof to a jury of non-Christorians.

I agree that it is entirely conceivable Chris serves time for this. But I would be shocked if his sentence is measured in years instead of days. You have to be really careful about combing through the laws, and finding the most serious criminal statute that could conceivably be applied to this event. That's not really how things work.

I agree, Chris isn't going to jail for years and no one has factored in whether or not the prosecution will offer a plea bargain to Chris

Wait, what?!

He and / or Barb supposedly had some young kids Cat put down for scratching him, an has blamed him for stealing his homework and releasing a snake into his house.

What really happened is a matter of speculation, however it's Chris so take anything he says with a grain of salt (or whole cellar) but it's not outside the malicious realms of possibility Chris has no empathy for others or every one is under him an Barb so there concerns are not worthy of his attention, he is a entitled prick in other words.
 
Chris will not lose SSI/SSDI benefits because he was convicted of a felony. However, these benefits will be suspended upon his long term incarceration.
Ok, I swear I didn't go out of my way to "ween" but I live near a courthouse/jailhouse and I was walking home from the grocery store when I stopped in and grabbed some brochures. This is from one of those brochures:
"If you are receiving Social Security, your benefits will be suspended if you are admitted for more than 30 continuous days to a jail or prison because you were convicted of a criminal offense. Your benefits can be reinstated, after filing the proper paperwork, starting with the month following the month you are released. Although you cannot receive monthly Social Security benefits while you are confined, benefits to your spouse or children will continue as long as they remain eligible. If you are receiving SSI, your payments are suspended while you are in prison. Your payments can be reinstated in the month you are released, as with benefits you will need to file the proper paperwork. However, if your confinement lasts for 12 consecutive months or longer, your eligibility for SSI benefits will terminate and you must file a new application for benefits."
It also goes into how to reapply for the SSI benefits and those don't look good for Chris. Not because he wouldn't get them again (I'm sure he would) but because it's a lot of work and he'll try and get someone else to do it. But Chris isn't a kid anymore, so he can't use Bob's information again; he also can't use Barb's unless she's his "legal guardian". He would also have to go back to the doctor and get another diagnosis of Autism. The one he had from his childhood is so outdated that it would not be allowable for this new reapplication process. Again, not saying he wouldn't/couldn't get these benefits again, but it's so much work he'll surely bitch and complain about it.

I'm really nervous about this outcome. I just don't know which way to go. If Chris goes free, I'll be pissed and Chris will think this is ok behavior. If he gets sent away for 5 years, that's really going to suck. Not saying he doesn't deserve it (because he does) but it'll suck none-the-less... especially for Barb and the dogs/cat. You know Barb isn't going to take care of them while Chris is sent away.

Unless someone manages to talk some serious sense into Chris, he'll never take plea bargain. A plea bargain would be an admission of guilt. And Chris is always right, and always the victim. Didn't you know that?

Remember their last plea bargain? Where they pled guilty but still wanted to tell "their side" of what really happened,,,,,,
