Chris-Chan Arrested and in Jail, awaiting Hearing on Monday (28-Dec-2014)

I was googling news to see if Ruckersville has a newspaper online. No dice, but this came up.

CB chatter from the area picked up a report of a man fitting Chandler’s description attempting to carjack an unidentified individual in the parking lot of the shopping center.

The carjacking allegation is news to me. My God Chris, what have you done?
 
I'm going to bow out of legal quarterbacking here since the true and honest legal team has shown up, but, as someone who has been involved with the way Going To Jail Works (mostly from the side of the people who run it ), I'll add a couple possibilities I've been wondering ... Chris MAY be in a segregation cell and not with the general population. My speculation on this is two fold 1) if he acted like a complete jack ass during arrest, transport and intake (highly likely) he would have been deeply motivated (forced) into a restraint chair and wheeled off to a little room where you can think about your sins. If he tried to bite or spit, on went the spit hood -- not quite as dramatic as transferring Hannibal Lecter to Memphis, but then Chris isn't that clever either. 2) If he in any way implied that he was suicidal or dramatically annouced he would "kill himself" during intake (also highly likely as he is Barb's Little Man) he goes to a private room where he is put under suicide watch which basically means a jail officer comes by on a regular basis to make sure you haven't done away with yourself. (This is NOT the same thing as refusing to eat. Like someone said earlier, if you refuse to eat at they time they offer it, too bad, you're not going to eat). In my neck of the woods to be placed on a 5150 (police slang for Batshit Insane) physc hold you are taken to the physiatric Ward of the local hospital that supplies this service and held on a mandatory 72 hour evaluation, the fact that he is a guest of the county lock up right now suggests to me that he is NOT on a physc hold.

Also, my fellow law abiding Kiwis, let this stand as a lesson. NEVER NEVER NEVER get arrested on a Friday afternoon or over the weekend. Courts don't work weekends, so you will be cooling your jets until Monday, and they take you in order of how you came in. Come in on Sunday? You're going to be way way down on the docket. Chris'll probably be seen tomorow late morning. And honestly, he's DAMN lucky he didn't draw a county that takes a full holiday hiatus, I know lock ups where he wouldn't be seeing a judge until after New Years, and he's not going to be able to bond out until his bail is set. He may get "time served" (he's doing it right now) factored in once he goes up to answer these charges (this will be when he goes to appear on the hearing for the arraignment charges) but we'll see.

Probably my favorite part of my sitting here wondering if he's gotten himself a private room through his dramatics is that they will have taken away EVERYTHING from him that he might possibly use as a ligature to strangle himself with ... And oh my, yes, yes, a strap on harness made of bright red webbing and a big steel ring is going to be the first thing to go. I'll just leave that right there for you...

He's either in prison for 5 years (at least) or in an institution for 10. Actually, considering what happened to that Boggs sperg -

- who got 13 years for threatening someone with a knife - well, I think this is honestly the end of Chris as we know it if the judge's standards are those befitting a non-exceptional individual.

First off, thanks for the awesome post.

Secondly, with regards to the part of your post that I quoted, is this a situation that the court will be aware of and will be trying to avoid? I mean, will they be more lenient with him and not give a custodial sentence in light of this fact?
 
Do any of our resident legal people know how long it's likely to be before Chris's ultimate fate is determined? Here it could easily take more than 12 months before someone on similar charges was tried and sentenced (or before a deal was reached) and their behaviour while on bail prior to conviction would definitely be relevant to sentencing. From what I've read, the presumption in favour of bail is not as strong in the US and it's possible to be remanded in custody until trial for charges similar to those Chris is facing.

This is my fault for mishearing something on the radio recording. There's a part (@29:30) where they dispatch a unit for "The suspect you were trying to locate" and mention a name "Ryan Collins." They say "He was calling regarding the card, that you left on his door" but I didn't understand the first part and thought they said "knocked on his door" when listening the first time. Almost exactly 10 minutes later (@39:40) a unit says they're "Out with the Collins subject in the JC Penney parking lot at the mall." My brain put the two together and figured that "suspect" they were looking for was Chris, who approached the "Collins subject" and "knocked on his door".

I don't think these events are related, and the initial dispatch at 29:30 doesn't mention the Collins guy being at the mall at all. I don't know how he would have ended up in the JC Penney parking lot.

I believe someone mentioned the psych unit for Albemarle County is in the same facility as the county lockup, or at least on the same campus. The jail does have psychiatrists and psychiatric nurse practitioners on their medical staff. If that's the case then I think it's likely that had the general warder made him Someone Else's Problem by sending him in for psych, he'd still be considered in the county lock up.

Also it's probably worth mentioning that if Chris is on suicide watch there's definitely a 24/7 closed circuit video feed of him being recorded somewhere. There may be a camera on him regardless of where he is. Not that we're likely to get our hands on the footage.

Months and months. A lot depends on how determined (and financially capable) Chris and Barb are at dragging things out ridiculously. The fastest resolution will be if Chris manages to cop a sweetheart plea deal at the arraignment, but that's not going to happen.

If Chris did plead guilty at the arraignment, is it likely he'd be freed on bail until sentencing or would he be remanded in custody until sentencing - or is it one of those "it depends" situations?

You really think that much?? I have a feeling they're just going to realize he's a giant child and release him to mommy.
Not in my country, Australia - we are pretty lenient cf. America. But in the American South? I wouldn't be surprised.

I'm not a lawyer, but I think at this point a couple of years would be the equivalent of a slap on the wrist for him.

I would say with Chris everything depends, but Chris is too cheap for the real thing :briefs:.

Whether or not Chris gets out in the near future depends on Barb's ability (and willingness) to post a bond (I have doubts she'd be able to make full bail). Or if anyone else wants to stump up the cash, because we're not likely to get much out of Chris while he's inside. However, if anyone really is ween enough (and I'm not going to name names - you know who you are) to drop cash getting Chris out, they would do best by just giving him the money and letting him post it himself. They do NOT want to be responsible for making certain Chris makes his court appearances.

It's more common in rural areas where the local hospital with a psych unit could be inconveniently far away. And it may be possible to get access to that footage if someone wants to do the legwork. Personally I doubt it would be worth the effort.

The carjacking allegation is nonsense. It comes from taking chatter from the police scanner out of context - as JFKDestroyer points out above.

TL;DR: Barb doesn't have to care and she likely won't as much as people think.
I guess a lot of that might depend on how incapacitated Barb is. If she's as dependent on Chris fetching q-sands and barbage for her, as some rumors suggest, she might be VERY motivated to get dum-dum back.

However, if she can get another helper monkey, or can find a way to do enough of it herself, I do believe she is the type of monster who could eat her young (figuratively speaking - maaaybe literally) without any true remorse. It probably wouldn't be hard to find an animal that is better housebroken than Chris. If Barb can easily replace Chris, or isn't as dependent on him, well...

One thing I'm not understanding here is this notion that Barb's going to kill herself or otherwise break mentally because of a lack of Chris.

It should be clear to all that she's a consummately selfish woman who has made it to where she is by always looking out for number one:

In theory, I think she would. But the reality is that she needs Chris as much as he needs her, if not more so. I don't know how physically capable she is these days, but probably not very. Emotionally, though, Chris is pretty much all she has in the world, apart from a couple of fat dogs. If Chris goes to jail, she will have no one to turn to. For all she treats him like shit, threatens suicide and threatens to disown him or whatever, if Chris actually walked out the door she'd do anything to get him back. If he does wind up doing porridge, I'd be interested to see her reaction on his return.

I somehow missed that Chris had previously posted this in a rant on the Fix Sonic's Arms Facebook group he started (bolding mine).

Also, copy and paste the following true statement in your letters and telephone conversations:

I honestly don't see Chris getting simple probation for this. If he had his probation extended for mouthing off to his PO He's going to do the suspended sentence (wasn't it 6 months) on top of the likely 120 days he's gonna get for tresspass after forbidden. Don't most low-security joints farm out cons as basic slave labor? I'd love to get a call center call from Chris, it would make my day.
