Victor Mignogna v. Funimation Productions, LLC, et al. (2019) - Vic's lawsuit against Funimation, VAs, and others, for over a million dollars.

ROFL this is the 6D level chess Lord Beard plays. Get fucked Casey Boi.
So, with how my exceptionalism has interpreted the letter, they have any time before his deposition to file that motion and any time after that would be considered too late?

contumacious
[ kon-too-mey-shuhs, -tyoo- ]

adjective
stubbornly perverse or rebellious; willfully and obstinately disobedient.

This is a good adjective. I think it applies to a bunch of people we follow on the farms. I have never seen it written, or spoken to me in my life.

Ty meant it in this sense:

contumacy
/kont(y)amasiy/ The refusal or intentional omission of a person who has been duly cited before a court to appear and defend the charge laid against him, or, if he is duly before the court, to obey some lawful order or direction made in the cause. In the former case it is called "presumed" contumacy; in the latter, "actual."

That fucking power play...

You understated that.

Ty just nailed Casey to the floor with that one. There is no wiggle room since Ty made clear he can read a calendar and is damned sure Casey's clients have no excuse not to be available on those dates, and if he tries to dream one up, Ty already knows he'll be spouting shit and can just take that to the judge to prove he's getting the run-around and that Casey needs to be forced to comply with reason.

Though Casey could try to strike first and claim that Ty is the one backing out and being unreasonable but he'd have to be pretty arrogant to do so and have the balls to go before a judge and testify that.

Casey claims to be a "super" lawyer. Of course he's that arrogant. To be fair though, Beard is pushing him around. But its going to be hard for Casey to complain considering he punched first.

"So you see judge, I tried to depose Mr. Mignogna in order to Anti-SLAPP and give my clients 90 days to gather nothing while they twist his statements and continue to defame him... Wait, where are you taking me?"

Oh it won't be hard for him to complain at all, considering how much he's whined already. Hard for him to justify though before a Judge. The vibe I get from him is he's so used to being the bully in court instead of the bullied primarily due to his "super lawyer" status.

As fun as it would be, don't expect the judge to engage in overt legal theatrics himself. He'll just grant the motions, cite some rules why, and tell both sides verbally he expects them to cooperate with each other as much as procedure requires. We should keep an eye out to see if this will actually get a scheduled hearing in a courtroom. Intrepid Kiwis may be able to attend.

So, how is this going to play out with both sides wanting the other to be deposed first?

Casey wouldn't commit to a date for Ron and Monica until after Vic had committed to his. Ty tentatively confirmed May 30th then backed out when Casey wouldn't commit to a date for Ron and Monica. A few days later, Ty said that May 30th was fine (again) and asked for dates for Ron and Monica. He didn't get any, so he scheduled them for May 15th. Casey immediately replied with "I thought I told you we were going first." Casey again doesn't cite any possible days when asked for a day between May 15th and May 29th.

As of today, Casey finally said that Monica and Ron would be available in June and then Ty responds to that by saying that Vic's May 30th deposition will need to be rescheduled.

Ty also made the extension on that TCPA (or whatever) motion tied to Vic's deposition. Once Vic is deposed, that's the end of their deadline on that motion. He's essentially slapped down his girth and told Cucksy to suck it or face the consequences.

Well, if MoRon really want the TCPA, they're running out of time. So, Casey could just go ahead and file the TCPA, and no one gets depositioned until the 90 days are up. Ty won't let them have Vic until he can get MoRon's, even going as far as offering them an extension for TCPA, under Rule 11.

By all accounts, Ty/Vic look way better in this situation, while the defense is acting like whiny little shits. I suspect they aren't going to get what they want.

So Ty uses Rule 11, the rule Casey claims makes Vic go first for deposition to force a TCPA extension but still forcing both (I think) Monica/Ron to be deposed first......
So is it safe to assume Rule 11 doesn't have a rule to make Vic go first in deposition?

Ty is also pressing to make a confidentiality agreement and protective order a requirement before deposition can take place and is using Casey's own filing as proof that it is necessary for his client.

Given the chance that the confidentiality agreement/protective order might not be approved/agreed upon, would a TRO be the next logical step?

The whole issue I see with dreaming up this little conspiracy is that these people don't strike me as that smart. If they were that smart, they never would have found themselves in this position. These kinds of people are so full of their own shit and have had their own way ruling their little fiefdoms for so long that they're secure in their own hubris. When it all goes downhill they shit themselves and do nothing.

What kind of fraud and conspiracy charges would they be looking at if they went down this road? I mean they are stupid, so maybe the implication that they'd be committing a litany of crimes is actually a point in the pro conspiracy column. It's easy to assign some grand conspiracy that involves everyone when you look at the whole insoc jus influence throughout the MSM, politics, and pop culture, and I personally believe there is to an extent, but that kind of thing happens at a level far above the losers at Funimation et all. Their conspiracy against Vic has been leaking like a fucking sieve. I have little doubt that if there was another conspiracy among these exceptional individuals to fuck over the court and Funimation that it would be discovered in short order via leaks or their own idiotic actions.

Casey padding hours seems completely plausible to me and has been speculated by others with far more judicial knowledge and experience than myself.

I was attempting to say it’s funimation execs using their underlings lawyer to stall until Funimation has its house in order. It’s not a grand conspiracy to say an employer hired attorney representing a worker is more interested in serving the employers interest.
