Hissrad my question is: why do you think our analysis, bolstered by opinions from actual attorneys called to the bar, is inferior to that formulated by PULLsters like Ochazuke and Lain who I believe have yet to attain the age of majority?
 
PULL's dumb ass got shut down again. They keep parading around the "confidentiality" and "what do you have to hide card".

4 attorneys just told you that releasing the text messages from Soye has no effect because the defending party chose to make the depositions public.

They are never the best any night. Still funny to think they believe he has to prove anything.

They can't get their heads around the facts that:
1. This is not a criminal trial. Vic won't be treated as a criminal and Monica and Jamie will definitely not be treated as "victims."
2. Vic isn't the accused here, he is the accuser. Again, he isn't on trial for the supposed "crimes" they believe he did. He is accusing Monica, Ron and Jamie of defamation, tortious interference (a big part of the lawsuit they often forget) and civil conspiracy.
3. Vic won't have to prove that he isn't a sexual predator or rapist or whatever. It's Monica, Ron and Jamie that will have to prove that he is. That's how defamation works. If they can't prove their claims of "100+ women" and "sexual assault", which is clearly defined as literal rape in Texas, they lose.
4. Muh "Defamation is a bitch to prove". Just parroting something they've read off google without giving any though into why it would be hard to prove. It's actually very easy to prove when you have text messages and public tweets. Because they were stupid and arrogant enough to defame him publicly for all the world to see.
4. They forget about the tortious interference part of the lawsuit most of the time. Ron's texts alone make the case for this, so he is already fucked, what remains is showing that Monica and Jamie too were complicit. And that's where the civil conspiracy part comes in. Hissrad even says that he's not familiar with the term, but then why should his opinion on the matter be considered more reliable than an actual lawyer's is beyond me.

Four lawyers. And just as an objective fact, any competent lawyer you showed this to, without any other knowledge of the case, just given Soye's tweets and an outline of subsequent events and asked to spot issues would recognize tortious interference. Good luck finding a lawyer who isn't being paid to say otherwise who says it isn't.

So if there is evidence of Monica doing TI with Cons, how hard would it be to prove Civil Conspiracy when the people live together?
 
I find myself beginning to wish that Phoenix Wright never happened. PULL et al. seem to more or less expect some dramatic anime cutscene where someone kicks open the courtroom doors with a "HOLD IT!" right before the gavel hits, then they bring in all of Vic's super-legit victims holding their tweets in front of them as totally-admissible-and-real evidence, then Vic does one of those on-the-stand breakdown animations where his eyes go blank and his colors invert or whatever. That's hyperbole, obviously, but they've made it quite clear that they actually think the whole "plaintiff is revealed as the perpetrator" trope is going to play out in real life. Fucking hell.

Texas Civil Conspiracy:

(1) two or more persons
(2) an object to be accomplished,
(3) a meeting of the minds on the object or course of action
(4) one or more unlawful, overt acts
(5) damages as the proximate result

1,2,5 are established.

4 would be the depend on the outcome of the current cases

5 would need to have leaked or somehow obtained evidence of two or more parties communications where they explicitly agree to commit the acts in 4.

Seems unlikely unless discovery turns something up or one of the parties flips and turns over evidence.

With how strong a case it is already against the three people being served and the big pockets company looking like they are likely to settle, I don't think Ty Beard is going to bother trying to prove Civil Conspiracy unless the evidence just falls into his lap.

The information was handed freely over to BHBH so even IF BHBH gave it to Nick, they are allowed to since it wasn't gotten through Discovery/Subpoena. Sucks that whole "everything out in the open" thing is a 2 way street huh.

Which is a fallacy, cause Nick has stated; multiple times mind you, he got them from one his very reliable sources over at Kamehacon, so that is moot argument for those PULL trolls.

Why go through the very public process of "outing" him at all? Why not actually get the authorities involved if you have so much evidence? If the statement "Vic is a pedo rapist" is true, then going public with this information will basically destroy any real chance you've ever had at real justice for the victims.

Yea that is what I don't get underage victims have a waaaay longer statute of limitations. So there would at least someone Bill Cosbying Vic about now after 5 months of this, IF he was doing what is being said to underage girls.
 
To be fair, us law is based on uk law. Mental Injury doesn't mean "hurt feelings", though. It means non-physical abuse. Psychological torture, lies designed to cause direct harm or to manipulate a person's mental state, that sort of thing. Despite the recent behaviour of certain police forces and politicians in this country, it still isn't a crime to hurt someone's feelings.

And as for US civil law: as a lawyer acquaintance of mine said once, "butthurt isn't a tort".
