Okay, very important distinction as it would be ridiculous for him to admit the opposite but then it would be really hard to not believe that considering how stupid he has been so far.

Oh dang. Would rather wait for the official word. Too many variables involved to trust this random discord user to not sperg out in front of ~10000 viewers.

I think someone said that the Judge can actually do that, it's just very rare. I mean, in this case it's pretty obvious that this is a proper case (not a SLAPP) and the worst Casey can do is try to anti-SLAPP it, fail (because everyone and their mothers know this is a proper case) and be left with a mighty pissed-off judge for disrespecting his instructions and wasting everyone's times.

At best, the Judge is just telling Casey there is no way this is going to go away if he files an anit-SLAPP and it would be blatant abuse for trying.

It would be fairly improper for a judge to say that before such a motion has even been entertained.

It could be that the Judge does not want to entertain a TCPA until depositions are completed.

Yeah, no. Claims that any statements were made without Malice are immediately defeated by the "I want his head and his balls" tweet. Anything made after that would be seen as made with malicious intent.
Still a better response than what Casey put out.
