Any time from it's already been decided and we don't know yet to June 21, 2019, the deadline to file a TCPA. I say that because if the court doesn't rule before then and doesn't extend the deadline, it expires then and the matter is effectively decided by operation of law, i.e. the defendants don't get to depose just Vic, which is the only issue the plaintiff cares about, and then immediately file their TCPA to have months to run amok spewing bullshit.

It's basically her admitting "yeah, I'm getting sued because I opened my mouth and said shit, but I believe what I said, but I don't want to give a dime, so please end this with no pain on my end before I lose the shirt on my back over a lawsuit I was running and hiding from since day one.", or that's how it looks to me, but I'll defer to actual legal eagles for a better take on this.

She's also asking for attorneys fees. I suppose much of this response is boilerplate, which is all that's necessary at this point in the proceedings, so probably not worth much analysis - but obviously I also defer to the people who actually know what they're talking about. I just can't get over the guff about the 8th and 6th amendments...

No, it's just a general denial. Plaintiff has to prove all his allegations.

That would be thin in some places but in Texas, it's allowed. You file as little as you possibly can at the outset.

Not at all. It's a perfectly acceptable response. Nice and broad. But actually attacks the elements that we know Marchi to have been involved in. Mainly the "investigation" or comments to employer and the Twitter insults. To our knowledge we don't have any direct communications between Marchi and the Cons. This is what a response is supposed to look like. Also as a reminder, of the four defendants currently being sued, the case against Marchi is probably the weakest one, going by publicly available information. So until we see the Investigation Report or something else, this one could go either way.
