Could they still file the TCPA before Vic is deposed to avoid theirs?
If they try to pull a fast one after the judge has enunciated the playground rules for both of them, they will be stuck with one mighty pissed off judge for the rest of the trial. Considering an anti-SLAPP has 0% chance of making a prima facia, per-se defamation case go away, that would be a really stupid move on Casey's part, even compared to everything else he's pulled already.

The problem is they are going to claim Hyperbole for the Balls tweet but it would only apply for the first two sentences, the 3rd sentence would still count as Malice and in my opinion significantly less Hyperbolic

Maybe the lawyer had her sperging out on twitter purposefully to demonstrate that she has a pattern of being a total bitch and therefore any particular tweet she makes can't be considered indicative of malice towards the specific target of her tweet. She's like the Hulk. She's just angry all the time.
 
Damn, Huber actually showed up. Vic mentioned him in one of his unlocked streams as well. Apparently they met at the gym or something and talked. My guess is that he's one of the VAs who knows about the civil conspiracy but can't say anything about it. And who would blame the guy for not wanting to speak up, in a few weeks his popularity is going to skyrocket amongst the Dragon Ball fan base.

Vic and Huber have been going to the gym playing racquetball with each other I think both before and after the January/February events. If it was Huber who went to the hearing, then he must be paying attention to Nick and everything else that’s going on. Or he got the tip from Rial and Soye. He might be in the “innocent until guilty” crowd after all, despite his remarks about Marchi’s story.

There is still the question of discovery as well, we have seen her public tweets, but more private conversations may come to light which could make things worse

Hubar is present at the hearing but Vic isn't.

Let's take Shane at face value and believe for a second that he isn't just lying about and misrepresenting what was written on KF.

Is Hubar a plant, claiming to believe Vic and becoming his sole confidant but secretly feeding info back to MoRon et al?

I seriously doubt it. I imagine its just he was in the area and around that day. And knew a shitshow was going on and tickets are free.

It was only the Lawyers, Judge, Court staff and two people from the public who are Tazz from Racket's discord (whose notes I forwarded here) and Chuck who is VA friend of Vics.

In short: Casey agreed not to file Anti-slapp before Moronica has been deposed, so Vic got what he wanted.

Yes but if I recall correctly, there were people in the replies of this tweet asking if she meant what she said and she gave a response that implied so. She also had enough time since she sent the tweet till now to clarify that she did not want any actual harm upon Vic (which to my knowledge, she has not done). Hence, I think if those two conditions are met, then her defence is fucked. Even if you meant it as a hyperbole, that fact that you did not issue a statement that you do not condone violence against him is a clear indication that you wanted people or were directing people to go after him and try to physically harm him.

It's not very stable, but I'm pretty sure they could go with that angle given conditions were met

I'm not sure what @BigDuckEnergy is asking exactly. You mean Chuck Huber feeding back info to Moronica for the hearing or in general. Cos if it's for the hearing, @KEK7go is right, their attorney is present and he'll relay this info. If you mean in general, I doubt it. Casey has proven to be very inept, if information was being fed to him, his documents wouldn't be a laughing stock ATM. Likewise with Moronica, if Chuck fed them info, they'd relay to Casey in the hopes of trying to get Vic behind bars, and that info would be vital)

Most likely. He's kept his mouth relatively shut because of the kids and like Nick has stated before, other VAs support Vic but don't come out publically because they don't want to be attacked by the same group of people

I wouldn't come to any conclusions about what happened before Nick's debrief of the dude tonight. He doesn't seem like he really understood what was going on, but Nick will know what to ask him to draw out the relevant information.

(Don't mean that to sound insulting. Just that he might not have known what to pay attention to, and Nick will ask the right questions to get it figured out, like he's doing a direct examination.)
