This strikes me as the difference between someone following the case overall, and someone focusing on 1 specific point.

SUBTITLE C. JUDGMENTS

CHAPTER 41. DAMAGES
Sec. 41.001. DEFINITIONS. In this chapter:
(5) "Exemplary damages" means any damages awarded as a penalty or by way of punishment but not for compensatory purposes. Exemplary damages are neither economic nor noneconomic damages. 'Exemplary damages' includes punitive damages.

(7) "Malice" means a specific intent by the defendant to cause substantial injury or harm to the claimant.

Sec. 41.003. STANDARDS FOR RECOVERY OF EXEMPLARY DAMAGES. (a) Except as provided by Subsection (c), exemplary damages may be awarded only if the claimant proves by clear and convincing evidence that the harm with respect to which the claimant seeks recovery of exemplary damages results from:

(1) fraud;

(2) malice; or

(3) gross negligence.
While sitting in traffic court, I watched lawyers knock down obvious points that were established "outs" for a given violation, so that when we get to establishing guilt, we'd already covered that none of the "outs" were valid.

Oh look, a lawyer from New York talking about a civil court case in Texas and trying to compare it with a Supreme Court Case with someone who has yet to be determined by the courts to be a public figure.

Also, what a backpedal. “I don’t care about anything else in the petition but the one tweet out of 400 potential defamatory tweets. Plus the tortious interference and civil conspiracy.

I know they arent intending to ride the whole case on that single remark, and it was included moreso to say, in a very teasing way, that "Soye obsessively posts about this every day without stopping" instead of "Soye is a meanie-head who said something not-nice", but the way it is worded in this document COULD be misquoted out of context by KickVic'ers and used to propagate slanted coverage and misinformation about the case in the public sphere.

Did you see Ron’s Twitter DM of him speculating that one of Ty’s relatives is Vic’s girlfriend and that that’s the evidence of civil conspiracy and tortious interference? That’s the level of retardation we’ve reached.

I'd actually love to hear an actually competent lawyer argue the other side. That could be a great stream.

I'd especially love his reasoning on how accusing someone of multiple rapes isn't defamatory. The defense to it is inevitably going to be substantial truth in some form.

You don't get to raise that other than as an affirmative defense, which means actually proving it, which means proving it at trial, which precludes a TCPA, because the claims are, if you are raising an affirmative defense, essentially admitted, i.e. you actually did say these things.

The plaintiff has sufficiently alleged statements that are on their face defamatory per se.

It looks like some KickVicers sent them that one screenshot of "you said Vic is a piece of shit, he is not a human feces" blurb from the Retraction Letter and told them "this is what Vic is suing multiple people for" and they got them to dance to their tune by saying "Haha, Vic can't sue for that, what an idiot. His lawyer must be a grifter if he said he can win a defamation case on being called a piece of shit"

Kickvicers have been tweeting the "piece of shit" part of the lawsuit, and only that part of it to these lawyers and they're commenting thinking the defamation is because someone called vic a piece of shit. You'd think they'd know better.
