First 2 guys I saw in the thread were IP lawyers though, Douchette is indeed a criminal lawyer. He's saying an argument could be made, not that it will prevail. Casey probably will try to argue that Vic is a public figure. He may even win that argument, but if malice or reckless disregard for the truth can be established then the point will be moot.

An assault is not an opinion either, its an event that either happened, or didn't.

I'm fairly certain that this dudes reading of the Texas Anti-SLAPP is highly faulty as well. The law as he describes would never pass court muster. It's designed to deny the Plaintiff access to the court system. It requires the Plaintiff to fully prove his case beforehand. without benefit of Discovery or examination of Witnesses? Yeah no, I'm sorry this dude is FULL OF SHIT.
