A’yup! That’s the provably and known false statement. The Piece of Shit part is just hyperbole and opinion. The Criminal part might in isolation by considered the same. Except the fool making the statement made a rather extensive habit of contacting the plaintiffs employers and business partners to fraudulently claim he was under criminal investigation for sexual assault of minors. The defendant was further given an aura of legitimacy in his defamatory claims by his proximity and relationship to a prominent industry insider. This resulted in employment and income loss. Widespread ongoing defamation that has permanently tarnished the Plaintiff’s good name and ability to work.
The devil is in the details and context is everything.

He's saying an argument could be made, not that it will prevail. Casey probably will try to argue that Vic is a public figure. He may even win that argument, but if malice or reckless disregard for the truth can be established then the point will be moot.
