Jesus fuck KickVic is pulling out all the stops in hopes of not being dug a six foot grave by some weird eternally 29 Christian guy. Super Lawyers are also ducking fumb.

The thing is that no amount of opinions expressed by lawyers on social media are going to change the outcome of this case.
 
With the case as is, soon the anime industry is going to get a harsh, rough, dry lesson on how the law works in america. What class most benefits from this? Why, lawyers. They're just lining up to appear like they're on the right side of history so they'll get hired for those sweet, sweet billable hours.

Is any of them high profile enough to defend sony?

Hasn't everyone tackled this already ? Having a verified account means next to nothing on whether or not you're a public figure. For reference, this is how easy it is to get verified on Twitter:


Nick already explained that in lawspeak, a public figure would be someone that could easily be identified by their fame or reputation. For example, if I showed a picture of Vic and a picture of Keanu Reeves and asked a group of people to identify the two. A majority of people would immediately identify Keanu whilst maybe only 1 or 2 people could identify Vic.

Vic is known in the anime community, outside it, he's almost completely unknown. Nonetheless, Ty and Nick have already stated they have anticipated the lawyers will be making that case and have been preparing accordingly. All these lawyers creeping out of the woodwork just want some attention thrown their way.

If I had to take a shot in the dark, I'd say Casey probably called up a few friends to look through the suit and asked for them to publically laugh at it in the hopes of demoralising or causing Ty, Vic, Nick and ISWV to have doubts over the validity of the suit and the chances of winning it. This may be his new strategy as his 'depose and defame' Plan B failed.

I'm 6 pages back but both the lawyers I've seen "dunking" on Nick/Ty seem to be IP lawyers.... Are they buddies of Funimation's IP lawyer or something?

I found that very strange, too. Claiming someone is a sexual predator is just expressing an opinion? wut? I mean, they're Lawyers, so I expect that they know what they're talking about, but that just sounds ridiculous, especially after all the damage these "opinions" caused.

First 2 guys I saw in the thread were IP lawyers though, Douchette is indeed a criminal lawyer. Fascinating that he jumped straight into this by talking to some of the worst possible people, please tell me they've not been talking to Shane too.
 
Guess being a super lawyer isn't all that lucrative. How shameful that you have to start a gofundme to afford a $2000 CPAP machine to keep you alive when you're a super duper attorney. Maybe he should've saved the money he sent in to be awarded the title and spent it on his health. And curious how he's actually raised almost 5x his original amount yet still has the campaign going. Guess he's buying stream games with Marzgurl. Maybe that's why he's suddenly weighing in. He's another Nick wannabe. One night of streaming could've bought that machine....that's IF you have charisma and presence

Interesting, here comes the people making "matters of opinion" arguments about defamation. That's the usual defense because a matter of opinion is typically protected.

Problem as I see it is if this is a matter of "opinion" it certainly does not seem it was presented that way to conventions when discussing Vic. Ron told KH that there were "charges coming" as in this is not a matter of opinion, this is a matter of fact.

Has anyone thrown the KH texts at these suddenly astroturfing superlawyers?

He's saying an argument could be made, not that it will prevail. Casey probably will try to argue that Vic is a public figure. He may even win that argument, but if malice or reckless disregard for the truth can be established then the point will be moot.

I'm fairly certain that the Texas view on "Public Figure" takes the more classical narrower view of the term, largely restricting it to Political Leaders and those individuals with enough national prominance and recognition that they can influence public policy and debate. Not simply "some dude from a cartoon show".

I'm fairly certain that this dudes reading of the Texas Anti-SLAPP is highly faulty as well. The law as he describes would never pass court muster. It's designed to deny the Plaintiff access to the court system. It requires the Plaintiff to fully prove his case beforehand. without benefit of Discovery or examination of Witnesses? Yeah no, I'm sorry this dude is FULL OF SHIT.
 
Also they claimed several people were assaulted.
An assault is not an opinion either, its an event that either happened, or didn't.

Jaime and Monica's BS stories are also first hand accounts. There is no avoiding perjury saying they heard it from a trustworthy source and believed it.

It's a coincidence that those are the people who he first talked to. Don't think about it.
Edit: Also, I presume that everyone knows that Nick is going to be talking about these garbage superlawyers on tonights stream.

Unless Casey files a TCPA before Monday, it's not going to be without the benefit of discovery. The defendants have responses due then. The court as also made clear that the expectation is that either both sides are deposed before a TCPA is filed or none of them are.

So far, I haven't seen any of the lawyers who are weighing in citing any case law. That alone means their opinions should be taken with a grain of salt.

-Anti SLAPP means defamation is totally legal in texas, guys
-He's totally a public figure, forget that even if he's a public figure, all you have to do is prove malice
-What's a "tortoise indifference"?
-LOL, they have no evidence in their filing. No, I've never heard of notice pleading, what's that?
-This California/New York state law PROVES he has no case!
-Nick is just in it for the $175K that he can't even access
-I'm totally a neutral third party, now excuse me while I say that Vic should just accept his career is over and go die in a gutter
