In the US, such programs as you describe have been found illegal time and time again... in the UK, they are also illegal in that fashion. :edit: In fact, thanks to the shit that all EU countries have to sign up to if they want to be EU members, it's illegal in all EU countries... though whether some of those countries bother to enforce this is something else.
