Yeah, seems to be the case. I have no issue with accepting the agreement, but it honestly seems really silly to not go after the defendants for the stunt they pulled, especially knowing Ty's stance on "chickenshit" lawyering.

Unless one of the conditions of the agreement is that somebody takes a baseball bat to Rial and Toye until they are vegetables, I don't see this being honored. I fully expect Shane to "magically" have documents or transcripts that will continue to come out.

Then again, I imagine that the BHBH team knows that these two are incapable of sticking to any agreed terms and are waiting for them to break any new conditions so that they can ream them even harder.
 
A little more context about Jamie McGonnigal.

He lives in Hyattsville, Maryland, which is right next to Bladensburg. This location is significant, it's a hive for a certain kind of thinking.

There was a SCOTUS decision yesterday regarding the Peace Cross. For those who don't know, it's a 40-foot high WWI memorial located in Bladensburg commemorating those who lost their lives overseas.

The lawsuit was brought by the American Humanist Association, who hate it on the grounds it represents favoritism towards Christianity. They have several members living there who have been fairly vocal about anything commemorating the past that offends their views on atheism.

DC is kind of like a cosmos, people cluster around specific areas based on their trajectories and you can tell something about a person (and who they socialize with) based on the neighborhood. Georgetown is where the ultra-elite live, Dupont is where the activists are, Capitol Hill is full of lobbyists / Hill staffers, Petworth is where the up-and-comers gather. This stratification still exists as you move outside the city. Alexandria, for instance, is where you'd find a lot of scientists, defense contractors, finance guys, and the like.

Hyattsville / Bladensburg is a satellite. Historically, it's a place where you went to do dirty work, it's where the dueling grounds used to be and a large part of the population there today are retirees and illegal immigrants. There's a lot of auto mechanics, industrial supply shops, cleaning services and other blue-collar industry in the area that doesn't speak to influence or power. The towns are located on the border of a much more prosperous county that enjoys a better educational system, lower taxes and superior property values - household wealth averages increase signfiicantly by walking a few blocks west.

In terms of that DC cosmos, the people who inhabit this place often work for non-profits, they are older, they tend to be activists, and they characteristically focus on edge-case social issues that lack prominence. They're hangers on, they have claim to some past glory along with some fault that keeps them from enjoying the respect of their peers. Although no one would admit it, they're kept around for the rare situations others see them as useful and mostly get passed over in favor of anyone else.

As a result, you get this mix of tiredness and bitterness amongst the residents. They are well educated but lack the personal qualities required to achieve their potential. It's common for small, vocal minorities clutch onto some terribly insignificant issue and blow it way out of proportion. The Germans have a word, Lebensmüde, which classically means tired of life. It comes to mind as a way to describe the average town-hall meeting there. People discuss how to tear down the past rather than ushering in a better tomorrow, conversation focuses on offense moreso than possibility.

It's important to remember Jamie sees himself as an accomplished producer, activist, voice actor, and organizer. The fact he would bring the sophisticated political organizing skills he gained at NOI to something as silly and pedantic as anime absolutely fits the profile. This is a person overcompensating for his own missed opportunities, seeking to right some wrong from the past. The cognitive dissonance emerging from the difference between his self-image and reality must be immense, I'm sure he enjoys a special kind of inner turmoil and attaching himself to the Vic situation is an attempt at catharsis.

It's shameful looking at the failed project Jamie has become.

While I'm only mildly surprised that there may be some sort of Rule 11 confidentiality agreement, once the responses to the interrogatories are in hand, it COULD be a simple matter of filing them in the case, and we'll get what's filed.

I can only assume that Casey/etc are starting to realize the power of the chans and KF's 'weaponized autism' and are scared that everything they reply will be picked apart and almost immediately discredited.

While this latest news may slow the progress, it will not stop it.

Casey and clients have turned people against them with their SPERG antics, if the agreement is sealed or confidential itself, we'll STILL be able to figure out parts of it. For instance does Ron stop tweeting about the case? (Yes? well probably part of the agreement), etc.

Various people WILL leak at some point so...

I'm in wait and see mode now.

It's only a win for them in the short run. BHBH's agreement was probably only upheld with Vic's decision because we already know Ty is annoyed of all these stupid games. Depositions will be on video and both sides have the same available information from the interrogatories/discoveries. Vic also benefits from this because their whining about protecting muh victims can stop while he rebuilds his reputation.

I guess it's sort of like making a deal with the devil and beating him at his own game. They were given the benefit of the doubt and repeatedly given 2nd chances to prove something, yet they still can't win with all of their options exhausted. Casey and his paperwork clusterfuck, 2nd chance. MoRon and their stupid decision to avoid the initial confidentiality request, 2nd chance. Think about how all of this plays in the mind of a jury. When they finally lose, no excuses.

Anything within 20 miles of DC has seen cancerous growth over the last 30 years. You can still see vestiges of the people who used to live in these towns and neighborhoods. Like the Bladensberg cross. The people who made those towns are gone though and are replaced either by illegal immigrants or carpet bagging shit heels like Jamie. The original residents children have fled south to the Richmond metro area, while their parents have either retired to the mountains or else await the sweet oblivion of death behind locked doors in neighborhoods where nobody speaks english. It's pretty sad tbh. Been great for Richmond though. The city is actually becoming a pleasant place to live. The locals are also racist af. You got a containment zone for the Mexicans around the phillip Morris factory and a combination of ghetto nigger gangs and rich whiteys keep them out.

I'd rather this doesn't be public based purely on how there's so many mentally handicapped people on each side and will continue to embarrass themselves. I just want a satisfying conclusion even if it's dealt behind closed doors....I mean if info gets out there then I won't complain.

Vic gets final say in this, and my assumption is that Vic, being the incredibly forgiving, gentle man that he is, didn't want any more potential "look how evil, sexist, and blah blah blah Vicstans are!!!" I also assume that this combined with the fact that a denial of this rule 11 confidentiality agreement would seriously damage the defendants in the court, it would also likely damage the reputation of BHBH in the eyes of the judge (he'll almost undoubtedly be annoyed with them for turning down something that he thinks they wanted from the beginning, and he'll likely see both of them as playing this chickenshit game, despite the actual truth) and it would absolutely damage their reputation in the eyes of the public, given the increased scrutiny from the KV side as of late, with Douchette and co.

Overall, I'm not that troubled by this result. I would have certainly liked to see the defendants sanctioned for this petty, retarded stunt, but in the end I still trust the judgment of Ty and co. more than my own on this.
 
Don't care about the "outrage", they don't know what real outrage is, so why bother with them because they are gonna play the victim card when that happens, don't give a fuck about that either, people need to realise that they have to ignore their outrage and victim playing because it's all they have.

What MoRon want to do is continue to slander Vic and do so legally, but I am sure that abusing deposition and discovery to defame someone has to be illegal or sanctionable. And as for Casey S. Eric. I don't know if he's a joke, a shyster or a lawyer doing his job dealing with shitty clients.

The first involved the story of a girl who claimed that she went to one of Vic's Sunday Christian panels, but was the only attendee who showed up. In the course of the meeting, Vic took her virginity, and afterwards told her she was a horrible person. There is no place, time or name given. In order for this story to be true, it would mean that there would have had to be an advertised panel for Vic with only one person bothering to show up. Seems dubious.
Oh thank god, there is One claim of actual sexual intercourse! It's was consensual, so still not rape, but still! I thought we'd never get one!

Also remember homosexuality actually has never been a modern thing. One notable example being Roman Times on that I think.

I also assume that this combined with the fact that a denial of this rule 11 confidentiality agreement would seriously damage the defendants in the court, it would also likely damage the reputation of BHBH in the eyes of the judge (he'll almost undoubtedly be annoyed with them for turning down something that he thinks they wanted from the beginning, and he'll likely see both of them as playing this chickenshit game, despite the actual truth) and it would absolutely damage their reputation in the eyes of the public, given the increased scrutiny from the KV side as of late, with Douchette and co.

Overall, I'm not that troubled by this result. I would have certainly liked to see the defendants sanctioned for this petty, exceptional stunt, but in the end I still trust the judgment of Ty and co. more than my own on this.
There was also a theory running around that Vic wanted some confidentiality for a past lover(s) who might have been having affairs with him when they weren't exactly unattached, who's lover/spouse might not have been aware of any infidelities going on.

Honestly doesn't really matter why Vic would want confidentiality. Nobody actually wants their shit out in the open, even if they don't have any "skeletons" in their closet. Not a fun experience, living in a glass house.

Not as much fun for the rest of us who've showed up to watch the freak show, but understandable.

That makes sense. I think that Ty is relying on them making rules that they are not gonna keep. Vic is winning because he's exercising restraint and focus and Ty, as much as he would like to be a nuke to them, has become a Laser Blade scalpel. In RPG terms, it's their turn to attack and Ty has to plan accordingly. I think he would want to let their gambit blow up in their own faces so he can show they are still using chickenshit tactics in trying to defame Vic using the law to do so. If that's the case and the judge busts Casey doing this shit he's gonna be PISSED!

If Ty were to go to back to court and argue against a confidentiality agreement because Ron and Monica are now in favor of one, then he'd look like a fool in front of the judge.

The real objection here was that:
1. on the 31st May Casey Erick said no, no, no to confidentiality - to the Judge as well as to BHBH.
2. On the 10th (or 11th) of June when discovery was due with no prior warning or notice he failed to provide it saying he needed confidentiality first.

It seemed like it was clearly intended to stall for time/obstruct BHBH from obtaining information and was not a valid concern.

As an additional note the confidentiality agreement Casey rejected on the 31st was a mutual confidentiality agreement. The one he demanded on the 10th (or 11th) was one sided - confidentiality for names of people provided by his side only.
