Exactly my point! We all know they are not gonna be able to keep their mouths shut about this and will use this to attack Vic.
The confidentiality Casey asked for was specifically one sided and hence there would be no way for Ron or Monica to break it - I assume any deal Ty has gone back with would be rather different:

Any confidentiality agreement will immediately be broken by Ron leaking to Shame. Which will lead to entertaining fun.
I understand why people think that. I mean, MoRon are clearly stupid as fuck, and love running their mouths, but still thats not something I'd gamble on. As exceptional as shane, ron, monica, ect are, I have to lean towards them not doing something that would so blatantly ruin their case. This might be an unpopular opinion here at KF but I really just wouldn't wager on that happening. That said, if it did happen, my level of shock would still be zero. I'm sure its something that Ty has considered but I doubt they are banking on it. Goddamn it would be funny though if it did happen
 
The real objection here was that:
1. on the 31st May Casey Erick said no, no, no to confidentiality - to the Judge as well as to BHBH.
2. On the 10th (or 11th) of June when discovery was due with no prior warning or notice he failed to provide it saying he needed confidentiality first.

It seemed like it was clearly intended to stall for time/obstruct BHBH from obtaining information and was not a valid concern.

As an additional note the confidentiality agreement Casey rejected on the 31st was a mutual confidentiality agreement. The one he demanded on the 10th (or 11th) was one sided - confidentiality for names of people provided by his side only.

That third point is pretty important, I think. Judges don't like stalling tactics. They don't want people wasting their valuable time, and Ty clearly displaying their petulant little stunts by just accepting and moving on should play well with the judge, especially considering the fact that they did ask for, and argue for, a confidentiality agreement previously. It's obviously difficult to truly understand the strategy at play here since we aren't lawyers, but I think Ty is using some solidly measured judgment here.

If Ty accepts confidentiality I imagine he’d request full confidentiality. If MoRon can’t help themselves and leak anyways so be it.
 
On one hand, confidentiality agreement is the worst decision, for us. Even if the judge would have ultimately ordered confidentiality anyways, it would have been hilarious to see Casey in court trying to explain his 180 flip.

However, it's also probably the best decision, from a strategic sense, keeping in mind the fact that BHBH is trying to win a case and not purely trying to entertain us. Fight it and all parties look bad to the judge. Agree to confidentiality, and I'm sure the judge will have noticed that Casey has lied to him in their first meeting, but BHBH won't look equally bad for also flip-flopping. And yeah, BHBH could try to go back to court argue that they only wanted it to prevent shenanigans, but the judge is still going to be pissed at having to mediate this shit again. Saying yes to confidentiality makes only Casey look worse to the judge without having to convince the judge of your intentions.

Of course, that makes things a lot less entertaining for us. Damn it, why do lawyers have to prioritize their client's interest and not the entertainment value of the case?!

I'm not sure about the strategic value of confidentiality.

Being able to show the world that the accusations are garbage and that the other side is stupid is strategically valuable to Vic as it:
- makes conventions more likely to work with him and less likely to listen to the other side
- makes the studios look increasingly stupid for having dropped him
- encourages his fans to promote to the GFM

Obviously to some extent the info that's already public has done that to an enormous degree and further information may have limited value - but it may not.

The confidentiality agreement covers only the stuff that doesn't get used as evidence in the trial, so we get to see the important parts.
 
If you're disappointed at the missed opportunity for laughs or wanted to see scorched earth against these cows, just remember:

As hinted at by Ty and Nick, Todd Gaiden will not be merciful at all in his suit against Pridemore. They'd best enjoy the (unwarranted) mercy Vic has shown them -- their next opponents won't.

All the relevant infornation will still be publicly filed, just with names redacted. Or otherwise in accordance to whatever deal. I doubt we’ll miss out on any of the important stuff.

Plus if a bilateral confidentiality deal is struck, we end up with the possibility of watching Ron violate it and the ensuing entertainment from that.

Aside from delaying, it looks like Casey is trying to spin a narrative about Vic by trying to shackle him to Nick and any bad actors supporting Vic. I don’t think it will fly, at least not nearly well enough to make up for lack of evidence for truth as a defense, but I can’t blame him for working with what he’s got. Even if he’s being a moron while doing it.

Well Casey didn't turn over the requested information on time over this. This is a good Nick question to talk about...and he is going to talk about it. There's really no reason not to fight this as it's someone being unethical. It's not about the confidentiality.

Not really as his request for it was conditional and they got the other condition they were seeking so there is little use in it for them. Casey would look notably worse as he definitively declared no use for the confidentiality agreement for the very reason he now requests one. On the other hand Ty sought either a rule 11 or an agreement not to file the TCPA before their depositions of ron/monica. I'd say the one who has to go directly against what they said would be the one looking like a fool.
