Even a really good affirmative defense isn't going to knock out a prima facie case. Whether or not Vic is a public figure is essentially a factual issue that must be resolved by a jury.

As to that factual issue, the judge is certainly going to remember that he actually thought Ty was Vic the first time he met him. I would be amazed if anyone on the jury has any idea who he is or will buy an argument that a fan project is enough to make someone a public figure you can lie about with impunity.

I’m not sure even “limited public figure” would apply to Vic? Is there a Judicial Test for Public Figure in Texas?

A limited public figure is someone who has injected themselves into a public controversy and for the purpose of that controversy alone can be treated as a public figure.

Guess who has willingly said absolutely nothing about this case involving him?
 
Using the GFM as an example of him being a public figure is quite telling that they're grasping at straws. Just go to the website and you'll see tons of Joe Schmos who are getting tons of money from generous people. Are they ALL public figures as well? I'd love to see them explain their reasoning.

Unless it's them trying to bring in Nick which would be the best scenario. Not for them but it would be very entertaining for the rest of us.

When do you think we will be getting Toye's depo? I know he's doing it tomorrow but I hope we get the details on how well that's going to go. Since we don't have Vic's, I'm wondering when we will get Ron's.

Yeah, I rarely stay up to catch the stream live and decided I wanted to tonight only to see that. I probably won't even make it to the Vic stuff tonight, but I missed the

I'm genuinely surprised the TCPA wasn't filed and he showed. I'm still not convinced Monica will, although things are looking much better on that front.
I think they had the TCPA ready to go in case Vic did poorly in his deposition. After his depo was a nothing burger The new guy probably said it would be foolish to file it before MoRon were deposed and piss off the judge.
 
Casey does. In fact he demanded it in his e-mail exchange with Ty regarding discovery. That's what all his whining about the things Ty had sent him was about.

In the amended motion Ty included the response email he had sent Casey where he identified that 4 (if I recall correctly) of the 6 items were included but Casey wasn't looking in the correct spot, that the text messages Casey wanted could be found from his own client or online because his own client had given them to Shane, and that they weren't required to Bates label anything.

Casey could always depose Vic again anyway if new evidence came out or if they manage to find someone who will testify about something. Otherwise they don't have any reason to depose him again unless they couldn't get through everything, but given they apparently spent two hours on pointless crap I'm guessing that they didn't have anything better to ask during their time.

I assume that most people on the jury won't know who the hell Vic is or have much knowledge of anime in general so they'll feel the same way. I think better story is Casey not being able to pronounce his name. If he were actually super famous or a public figure Casey would probably know how to pronounce his name from hearing it plenty of times in passing. It's even funnier because Casey should know the guy who's suing his clients.

It says something about how low expectations for these clowns are that merely failing to do the absolute dumbest possible thing they could do is a step up.

Okay this has probably been evident from the beginning, but essentially they want to show that Vic is a public figure and therefore it's not a civil offense for them to slander him. Given how absolutely intransigent these assholes have been regarding their story about Vic being the worst sexual predator since Genghis Khan, I'm surprise Ron is letting his legal team take this route because essentially doing so says, "I emphatically state that Vic is a sexual predator and I have proof but in case I am lying he's also a public figure and therefore I can slander him as long as I can prove there was no malice (which I can't because this was full of malice, bitch!, but watch the shoe-eater dance rather than think about it)."

How does Ron reconcile this "I wasn't there but if I was I didn't do it and if I did he had it coming" approach, which of course is how lots of these cases are handled but definitely shows some weasel wriggling on his end? Not really the approach of a noble warrior trying to save the honors of all those ladies Vic hugged, is it?
 
The only thing I can think of for asking about Star Trek is that there is/are someone(s) from that series that have accused Vic and they are the super secret accuser that will bolster one of soy/rials affirmative defense claims. However, without the transcript or video (that Nick hinted at last night might be available?) I have nothing.
They dont get to do that though, they have to turn over their names and such. This isnt TV court where your surprise witness flys in from Ice Station Zebra to accuse you of something

You can still defame public figures, the difference being that, if the libeled/slandered were to sue for defamation, they'd also have to show that this person acted with malice, i.e. "knowledge of falsity or with reckless disregard of whether false or not".

They were going to get deposed regardless of a TCPA, judge had already scheduled them.

I agree that the line of questioning regarding ST Continues and the GFM are trying to set some play up for the TCPA.
Part of the whining about a second deposition round was due to the motion to compel eating into Vics deposition time. Since that didn't happen, 4/6 complaints were 'Casey not read good' and 2/6 was about labeling requirements that don't exist, he's going to have to work for his shekels.

I wasn't trying to refer to the TV trope of the surprise witness. Because they haven't answered the interrogatories we don't know who else they may try to bring in.
