Part of the whining about a second deposition round was due to the motion to compel eating into Vics deposition time. Since that didn't happen, 4/6 complaints were 'Casey not read good' and 2/6 was about labeling requirements that don't exist, he's going to have to work for his shekels.

Apparently not. I mean MoRonica are just throwing money at him stupidly. I mean why go through the depositions, even Vic’s, before TCPA? They are paying $5-7k per day this week. Why do that if winning the TCPA makes that massive expense worthless? TCPA is supposed to be to prevent the Defendant from getting raped by legal costs over a petty bs matter. Similarly why waste all the money on discovery stupidity?

MoRonica is probably $40k in the hole, just for the purpose of getting to depose Vic and getting nothing out of it except an under oath grilling about his ST fan films. What are they accomplishing with all of this idiocy?

Probably under the illusion they can rack up billable hours and then file the TCPA to financially ruin him legally. Not sure if that is how things work though. I mean can a person honestly hire multiple firms, rack up the legal fees, and then tcpa to make the other person financially responsible? Seems extremely easy to abuse if so.

Oh i meant putting in work to get that second deposition out of a judge considering all of the complaints up to Wednesday were addressed and should be considered moot. It should even be obvious to MoRonica that they are getting bilked considering Casey's long filings that are 80% cut and paste and 20% padding. I wonder if they'll wish they went with Jamie's strip mall guy by the time she's up for depositions.

Not really, you have to have the other guy file a complete BS lawsuit against you first, and in that case, he deserves it.

If they had any brains they would be looking enviously at Jamie's Strip Mall Lawyer already. The remarkable thing with MoRonica is they seem to be throwing money at "big money" law firms without getting the normal benefits. Look at BHBH, that is why you go for a broad established firm rather than a single retail lawyer, if you have the budget. The firms can offer a broad spectrum of pooled resources and specialists. MoRonica are paying 3 lawfirms, but only seem to be getting one barely paying attention lawyer out of each.

I rather doubt that Chupp would award them legal fees even in a successful TCPA claim after the discovery BS. I think Legal fees are an option, not a guarantee.

Not true. In the event a court finds that a lawsuit was filed with the purpose of retaliating against a defendant for exercising First Amendment rights, the court "SHALL award to the moving party:

(1) court costs, reasonable attorney's fees, and other expenses incurred in defending against the legal action as justice and equity may require[.]"

That part isn't optional.

Also: "(2) sanctions against the party who brought the legal action as the court determines sufficient to deter the party who brought the legal action from bringing similar actions described in this chapter."

However, this isn't a one way thing. If the court finds a TCPA motion was filed for absolutely bullshit reasons:

"(b) If the court finds that a motion to dismiss filed under this chapter is frivolous or solely intended to delay, the court may award court costs and reasonable attorney's fees to the responding party."

Hmm.

See that is the part I was curious about. Is Moronica hiring 3 firms to defend them considered reasonable attorney fees is what I was getting at. I mean I have no doubt the TCPA will more than likely fail, but just the idea that might be a strategy they are pulling to financially ruin vic.

No. There is actually a process for determining reasonable attorney fees and it isn't just jacking them up by hiring a bunch of lawyers. I'm not sure if they use it in Texas but quantum meruit is often used to describe it. Like every Latin
phase lawyers use, it means "I know Latin and you don't." In practice it means what the work was worth.

And that may actually be a a strategy, it's just a really bad, dumb one in this specific case.
 
You can still defame public figures, the difference being that, if the libeled/slandered were to sue for defamation, they'd also have to show that this person acted with malice, i.e. "knowledge of falsity or with reckless disregard of whether false or not".

In one of his incredibly few public statements regarding his views on the law Clarence Thomas recently voiced that he felt that the issue of special rules for libeling or defaming "Public Figures" was due for re-examination by SCOTUS. I have a happy daydream of lawyers standing in front of the High Court having to explain what a Weeb is. "And they do what with these body pillows?!?"

Even if something absolutely hilarious happened (like the judge having to get called in and him coming down on Soye) there's only so much he could say about it. The more realistic case is that Ron got grilled and had a whole lot of nothing, which means that there's nothing to say beyond mocking Ron and doing a five minute rant about how they're screwed.

Better to wait until Monica is done and do one big deposition round-up and go through a transcript (though last night he made it sound like he was trying to get audio/video) when one becomes available.

Remember, most of the absolutely idiotic shit we have on the Soye Boye is shit he publicly posted. Monica is where there might actually be something interesting. Unless the Soye Boye completely chimped out, all he did was confirm shit we already knew.
