We don't even know if the affidavits can be admissible as evidence. Probative value has to exceed prejudicial value and so on. And if it's a "I heard from a friend who saw another friend get RAPED by Vic," that's probably not admissible, either.

It's all up to discovery, of course, but at the moment ManJawtrarian just seems like a person who wants to push an agenda and desperately wants to be relevant. Like a female Shane.

It seems very clear that Judge Chupp won't let them submit anonymous statements that seem to only exist to further defame Vic. If they want to share ludicrous and false stories in the court of public opinion, and the court of law - they gotta have their names attached.

Funny thing would be if they were lying about it, and don't want to be called out... that'd be a shame.

If Nick is being Legit, which I don't doubt, these dumbasses just handed the nuclear launch codes to Ty and BHBH on the Civil Conspiracy since we know that the Ijima story is bullshit, they just publicly defamed Vic and tried to TI business relations not even 24 hours ago, and when we recall a certain loony troon handed in her affadavit to MoRonica when it's known she was in communication with Marchi, it's not going to be hard to link them as a co-conspirator and that Marchi and Rial are definitely in contact.

I don't know what these people are thinking. The smart play here is to act in a way that doesn't link anyone together, and to not publicly do the thing you are being sued for. I think they need to donate their brains to science because I think we need to see what sort of thing causes such catastrophic malfunction.

Nick also confirmed that Judge Chupp said balls to Casey's request for a gag order, and that if anyone who sent in an affidavit wanted their stuff secret, they should withdraw their affidavit.

Also, Nick said he got 5 affidavits. Only one of them was Monica, and the others were none of the individuals named in the Funi/Sony investigation. So much for them wanting to come forward.

Nick also teased some material that came in that he says are too stupid to believe.

Sworn affidavits? I always had a suspicion those calls on stream were a gayop by #kickvic to try and trick Nick into committing defamation using forged documents to try and take him down.

Who needs forged documents when you have a literal travelling circus on twitter to do that for you? Cuntrarian just outed herself as one of the sworn affidavits, cause she sent her's to Nick so he would release it before discovery. Nick saw through it and held onto it. Nick said on his twitch stream, one of the affidavits was Monica's also.

So if 4 of those affidavits are not from the Funi/Sony Investigation, then what the hell are those 2 other stories from the damn thing
 
So, is it probably safe to assume that the sworn affidavits were the surprise that manjaw was gloating about before? There was something about wishing that they didn't depend on Nick cooperating. They (manjaw and Monica) wanted Nick to stream the affidavits, but he picked up on the fact that they desperately wanted it and he cock blocked them by refusing.

Around that time originally, people assumed that she was referring to the fake letters, but I'm thinking now that this sounds more likely.

These people are living on Twitter/Tumblr. Most of them have no job and no real social life. Their world is all virtual.

In addition to that, they spend a large part of their time isolating themselves (ban/block) from different opinions. And they surround themselves with similar people, who spend their days parroting each other.

Some of them have been living this life for months or even years. That's why they end up coming out of touch with reality.

(And if, in addition, the individual has psychological problems... ).

I have a question and hope someone can direct me to the right place. Someone did the outstanding work to find background information (I mean her writing) of MJ Montelo and was kind enough to post it, I was in the middle of reading it and had to leave but want to go back and finish her screed to understand her rattled brain, can someone direct me to where this is please.

They probably can for the purposes of the TCPA, as they establish a contested issue of material fact. They're not terribly useful in the actual trial phase unless someone shows up, though.

It's looking like the TCPA phase is going to be a battle of the affidavits, but I don't see how the defense knocks out a defamation case based on the mere fact they can establish that they actually have an affirmative defense. A jury has to decide that.

So it seems like there are a couple hurdles here, the less-discussed TRCP 91A special exceptions that are getting a hearing, a probable TCPA, which looks like it's shaping up to be somewhat like a summary judgment motion, and then, possibly, another actual summary judgment motion after discovery. As well as any interlocutory appeals if anyone wants to try their luck at that after losing a TCPA.
