Hey dingus under Texas Law rape is titled "Sexual Assault" full stop, what you're thinking is 'sexual assault' is actually two different offenses "public lewdness" and "Indecency With a Child" (under 17).

Sec. 21.07. PUBLIC LEWDNESS.

(a) A person commits an offense if the person knowingly engages in any of the following acts in a public place or, if not in a public place, the person is reckless about whether another is present who will be offended or alarmed by the person's:

(1) act of sexual intercourse;

(2) act of deviate sexual intercourse; or

(3) act of sexual contact

(2) "Sexual contact" means, except as provided by Section 21.11, any touching of the anus, breast, or any part of the genitals of another person with intent to arouse or gratify the sexual desire of any person.


Sec. 21.11. INDECENCY WITH A CHILD. (a) A person commits an offense if, with a child younger than 17 years of age, whether the child is of the same or opposite sex and regardless of whether the person knows the age of the child at the time of the offense, the person:

(1) engages in sexual contact with the child or causes the child to engage in sexual contact; or

(2) with intent to arouse or gratify the sexual desire of any person:

(A) exposes the person's anus or any part of the person's genitals, knowing the child is present; or

(B) causes the child to expose the child's anus or any part of the child's genitals.

Sadly for him Deviancy is defined under Texas penal code as sodomy, the Administrative Code futher defines deviancy as having a interest in sexual violence and sexually abusing children

(9) Deviant Sexual Behavior--A sexual act that meets one or more of the criteria defined by state law. This includes sexual arousal to or interest in prepubescent children, sexual violence, and hypersexuality.

Meanwhile "Sexual Misconduct" could be defamation per say as under the Sexual offense chapter of the Texas Penal Code all the proscribed criminal offenses are referred to as "conduct" and not "acts" and "Sexual Conduct" is defined under the Pornography statute as the following:
"Sexual conduct" means sexual contact, actual or simulated sexual intercourse, deviate sexual intercourse, sexual bestiality, masturbation, or sadomasochistic abuse.

(c) For purposes of this section, "act of sexual abuse" means any act that is a violation of one or more of the following penal laws:

(1) aggravated kidnapping under Section 20.04(a)(4), if the actor committed the offense with the intent to violate or abuse the victim sexually;

(2) indecency with a child under Section 21.11(a)(1), if the actor committed the offense in a manner other than by touching, including touching through clothing, the breast of a child;

(3) sexual assault under Section 22.011;

(4) aggravated sexual assault under Section 22.021;

(6) sexual performance by a child under Section 43.25;

An adverse decision on a TCPA motion is subject to immediate interlocutory appeal by both parties. The denial of such a motion is appealable by right, while granting it can only be appealed by permission. Depending. It's a relatively new law and hasn't been completely hashed out. And the appeals courts don't even agree on this.

I don't think that's a particularly good admission. They admit they acted based on wild allegations from some Internet crazy, based on absolutely nothing, that Vic is a pedophile, something they have no evidence of whatsoever.

For some reason the KickVic side seem to think that the TCPA motion which Ty has expected since March has somehow won the case just by being filed.

On reading it, the main arguments in it are things Nick had suggested ages ago - there are no surprises here but the KickVic'ers think it's a crazy slam dunk that was never expected by Ty/Vic.

On a side note Ron/Monica have sent letters to 9 potential witnesses asking them to preserve any evidence - Nick's on the list as are a few other interesting people.

To be fair though, Texas is an at-will state right? So isn't why they fired him less important than how they acted in the process? Co-signing the rumors and publicizing them as "official from Funimation" seems way worse than "we get our info from Twitter".
After reading their document it really feels like they're trying to sell the VAs down the river and pretend that they have nothing to do with any of this.

If Funimation wins this, they've extricated themselves from the case, but everyone else is then vastly more fucked immediately so they're pretty premature to celebrate.

It would be less important if they had only said "We are no longer working with Vic, all appropriate roles will be recast." Instead of "We do not condone harassment of any kind."

They didn't "fire" him because he wasn't an employee. That's why he's not suing over that. I'd also be fascinated to know who made the choice to make that tweet in that manner. It's exactly what any competent HR department will tell you never, ever to do.

Even the "Following an investigation we're no longer working with Vic" part.

When Toye had already been talking about an investigation and claiming it had found proof of sexual assault was a bad move.
