On its surface that looks somewhat bad - as the statement from the deposition appears to contradict Vic's public tweet. Did Vic approve the GFM or not? The tweet certainly said yes - I think more context from the deposition may be needed to confirm what Vic actually said at the deposition as there's a gap that could break the context there.

Agree that this isn't what the case is about but if Vic seemingly lied or contradicted himself in deposition even on an irrelevant point it could be painful.
 
It's hilarious and sad that they are literally trying to burn Nick down, and only proving him right because they're so pathetically incompetent

And they're trying to subpoena this guy.

They're gonna subpoena this guys, and ignoring the fact that they demonstrably don't have good depo questioning skills, they're inviting this guy to continue doing the same PR they suggested Vic do after he laid down and died low after getting cancelled.

It's actually a pretty damn good joke, and you're very close to it. The * in Figs is actually a branch from a fig tree, denoting that it's supposed to be a fig tree. Che's place of death was "La Higuera" which means "The Fig Tree." The even funnier part about it is the double meaning, which is Socialism is For Fags. Most even moderately politically involved and somewhat honest people know that Che really hated gay people. It's an ironic joke, poking fun at the far left's championing of someone who stood staunchly against the things they support, while also referencing and arguably celebrating the fact that he's dead.
 
The question reads as did Vic bless Nick making it without his knowledge, Vic says No. How is that contradictory to Vic supporting it after it is made?

It's framing an innocuous question negatively to get the gotcha moment they want.

It's almost like Nick called that they only wanted Vic's discovery and file a TCPA so they could CONTINUE to defame him unopposed
 
What's the point of this? The money's already in the IOLTA, the process has been going on for so long that if there was a problem BHBH would have had to answer for it at this point, and we already have numerous examples of lawsuit GFMs.

And is Lemonade suggesting that the GFM, whose stated purpose is to guarantee Vic's day in court after numerous people libeled him, costing him his job, the breach of several contracts, and business opportunities, in addition to the right to not be seen as a criminal despite never being brought to court for his alleged crimes... is somehow supposed to disturb the peace of society? Or lead to corrupt practices?

OR PERVERT THE REMEDIAL PROCESS OF THE LAW?

Why would you emphasize these parts when the stated purpose of the GFM was to financially support someone who was at real risk of not being able to support himself, much less clear his name by court of law?

There are two things about gofundme lawsuits that should thrill everyone in the legal profession.

1. It can allow someone who lacks the means to gain access to the legal system.

2. Its a new way for lawyers to get paid.

They are barking up the wrong tree to try and argue GoFundMe lawsuits are improper. A bleeding heart judge will accept the former and a tough as nails mercenary the latter. Besides, thanks to Citizens United money=speech so the general public not only is allowed to donate money to causes, we have a constitutional right to do so. God bless America.

...not to be pedantic, but doesn't "approve" relate to the process of GFM getting the approval to proceed from Vic, whereas they are asking about whether Nick asked him for permission to set it up in the first place.

The timeline as I understood it was GFM set up by Nick (without telling Vic) > GFM locks it, some process to acquire Vic's yay/nay is engaged with > GFM receives approval, unlocks campaign.

There are two potential areas Vic could be asked for approval, one is initial setup, the next is "hey bro are you okay with this?". Initial setup permission was bypassed by Nick, and then GFM asked for Vic to yay/nay it.

It sounds contradictory but only if you intentionally ignore the process which actually occurred...which Nick has gone over multiple times.
 
Are they seriously trying to argue that Nick is effectively acting as an investor to this case and speculating on it for his own monetary gain, and specifically that he's going to get some share of the damages? I really hope there's some legalese meaning to this that isn't the plain reading, because the plain reading is honestly some of the most exceptional shit I have ever read in my life.

Yes, they're doing exactly that! It's so hilariously transparent and stupid at the same time.

The only way to do this successfully is somehow to revive the long-dead doctrines of champerty or maintenance. And this completely isn't going to happen, and that's why they buried this desperate hope in a footnote.

And I'm totally with you @AnOminous: The author of this trash should be burnt into the ground for the font alone.

Note: the person who usually sees documents submitted to a court is a law clerk. For some weird reason, in America, that's usually just some high performing law student. The word for this kind of person is "nerd." I'm just saying from personal experience that if the first reaction to your otherwise dumb document is also just autistic screeching about the font, it's just going to make things even worse.

What absolutely slays me, is that they got called out for the TCPA/discovery games... so they bring in a TCPA specialist, to play some 4D TCPA/discovery games :story:

Like holy shit, telegraph what you're doing even HARDER, they'll feel it in China.

They want an exemption from the stay of discovery so they can do exactly what Nick Rekieta accused them of trying to do
