Oh my God, they need to stop. They really need to stop inserting themselves in and talking about a case they know absolutely nothing about. If you feel the need to comment, do your research, look at both sides and then form an opinion based on the presented facts and arguments. It just reveals a lot about the person commentating if they still repeat this idiotic idea. It is now on record that Vic did hire a PR firm and lay low initially. We had heard about it before but it has been confirmed by Vic himself now. So they either didn't bother reading the parts of deposition that got revealed due to the Fuhrer's motion, or actively ignoring this fact. So they end up looking either ignorant, stupid, or disingenuous. And it's usually a combination of at least two of those qualities.

He would most likely be brought in as a witness to the event, if not provide a signed affidavit of the events he witnessed.
Edit: @AnOminous Fair enough, I was thinking in terms of just getting into contact with him rather than in terms of a subpoena.
