It's almost like threatening a lawsuit you know you'll lose is a really bad idea, especially if it's a copyright suit that you're openly admitting to not having a copyright over the images at the time of the alleged infringement.

I know nothing about copyright law, but wouldn't Cohen have to prove that Null profited from, or caused Cohen to lose sales due to copyright being posted on this site in order to even come close to a court awarding 300k in damages? I know Cohen is just waving his dick around to scare null, but I am interested on the reason why his claim has no merit.

Also who the fuck copyrights pictures of their kids?

He is basing that on punitive damages. The court awards him 0 dollars in compensation for the infringement and 300k to punish @Null for daring to infringe the copyright. Which btw can only be done if the copyright is registered. Which is why he is being a busy bee and trying to get his family photos registered. Its dumb though. He is unlikely to win but that's not the point. He is just trying to threaten dear leader with expensive legal issues to get him to bend the knee.

I like Akiva, I consider him a friend. That's why I wish he handled it differently. Instead of suing, he should have just laid low. Hired a PR firm. Apologized for all the horrible things he's done to each and every person he had assaulted or offended. He could have gone to therapy, got a regular job at a Wal-Mart while everything just blew over and everyone would welcome him back with open arms.

Now? Now it's just really sad.

I just wanted him to admit he did wrong so he could come back one day, like Al Franken.

That's statutory damages for which the infringer would be liable if there is any infringement. Null would at most be liable for vicarious infringement. I wonder what Cohen's novel argument for the availability of statutory damages for vicarious infringement is.
