I'm not a lawyer, but in my life I've watched or read a couple dozen depositions. Toye's has got to be my favorite so far. He's arrogant and malicious, as well as being an outright liar. His affect is so off that it's downright skin-crawlingly uncomfortable to watch. Simply put, Toye lies, and lies maliciously, about almost every important point in the depo. He is going to be pure poison in front of a jury. God help him if he testifies, but even if he doesn't they're still going to show the depo and when they do, he is
done. Don't be shocked if the jury outright laughs at the more absurd parts, like the whole "I'm a sheepdog protecting the weak, just like Chris Kyle!" bit.
I can see now why his legal eagles are trying far-fetched legal maneuvers to throw this suit out. I can definitely see why they're playing games to avoid turning over discovery. Discovery for Toye is going to be, I'll bet, even worse than the depo was. His lawyer should push for a settlement now, because the info that's still going to come out is going to
bury Toye in a mountain of shit that no defendant can dig out from. Of course, the lawyer has to follow the client's wishes, so you have to ask yourself: What is the absolute dumbest thing Toye could do? I think it's a combination of pissing off the judge and pushing for a trial, the last two things Toye should want. Way back when Ty first dropped the papers regarding his Tweetstorm on Toye, I said that I'd never seen someone so comprehensively self-detonate their legal case. I had no idea that things would get so much worse.
