Victor Mignogna v. Funimation Productions, LLC, et al. (2019) - Vic's lawsuit against Funimation, VAs, and others, for over a million dollars.

The goal of those questions wasn't to obtain admissible testimony, I'm convinced... it was to get excerpts for #LawTwitter.

I think it's mainly a matter of getting something that sounds incredibly damning because he has to know how shitty his own clients are and that he's going to need something at least as good in order to trump everything that Ty is going to bring out. It just so happens that anything that suits that goal also makes a nice little cherry pick for the peanut gallery on Twitter.

If you look at the different lines of questioning he tried to bring up, most of it makes sense from the perspective of helping the case:

If they can attack the GFM account in some way it deprives Vic of money, which when it comes down to it is a big part of winning cases when you can keep going as long or longer that everyone else.
If they can make it look like Vic authorized the apology letter then he's admitted to being a sex addict which might make the allegations against him seem more likely to have occurred.
If they can make it seem like the other people posting to Twitter, etc. are responsible, then who's to say that Ron/Monica should bear the cost of the damages when everyone else did it.
If they can make it seem like Vic thinks the people who slagged him are trustworthy, then their accusations against him must be correct.
If they can make him admit he's responsible for the actions of his fans in one case, then they can blame him for not stopping other actions that aren't his own.

Fuhrer Lemonhead is scummier than the phlegm stuck in his throat, but if you're Ron and Monica and have a case built on nothing you need a real dirty rat bastard of a lawyer to try to take that shit and squeeze hard enough to make diamonds.

But GFM doesn't have the funds, Ty does, or rather Vic does in an IOLTA account with BHBH. That gets pointed out the whole "scam" idea evaporates.

The firm maintains it, but it is held in trust for the benefit of Vic, meaning the firm has a fiduciary duty not to touch it except specifically for costs and fees itemized and billed. It bears interest, but the interest goes into a fund that benefits organizations that provide legal services to low income citizens.

The money is as safe as municipal bonds and Law Twitter has a bowl of crack and brain tumors for breakfast, lunch and dinner.

How would you even go about attaching those accounts? Aren't those sorts of trust accounts generally well shielded from collection actions and bankruptcies?

I'm not sure, actually. You know who would know, though? Ty Beard, as one of his practice specialties is asset protection.

After watching two of the depositions here’s my take on why Funimation ultimately filed TCPA and why they did it so late right after depositions.

1) They realized they were being held at a higher form of responsibility after all the questions to Vic about employment status/1099 differences.

2) They realized that the questions were also raised towards Monica Rial by her counsel and she probably didn’t have definitive answers either so they were trying to get Vic to answer for himself and for her.

3) They were already forming together their defenses and could not find their white paper justifications asked for by their attorney and understood they had to take a chance that it wouldn’t come up but ultimately were intimidated by the questions presented about Funimation at the depositions, and how much not only legal liability this could cause, but how much it would affect their bottom line operations within Texas after their employment/1099 status was jeapordized.

4) it became their saving grace to put this together in hopes they could convince Judge Chupp just enough to have all of those questions put to rest and possibly revamp the way they operate their contracts.

It’s like paying the BBB to be a highly rated business. It’s worthless.
I say nshss because that's a scam targeted at high schoolers where you just pay them money and yoi can say you're a part of their society. Unlike NHS where you have to actually do something and have good grades in order to be accepted.

.

If they where really worried about the 1099 thing they would have just settled. I would not be surprised if immediately after this case they simply change their contracts with voice actors to make them actual non employees. They might get hit with a class action, but after seeing how hard they cratered Vic for the lols I doubt it.

I was reading this thread on my phone as a guest earlier and don't have the time to go over it again and quote people so apologies if this has been gone over before, but if the speculation about the hidden identities of the unnamed women being the twins and that translator who has a history with Ronica are true it makes the requested confidentiality regarding these three in light of the earlier grandstanding about "getting the truth out" kind of odd.

I could understand if they had actually gotten in touch with some witnesses/accusers who weren't that close to the situation or who haven't been involved in the industry/fandom/cons for a while that it might take some convincing and the promise of anonymity to come forward and testify. But these women are close, if not intimately close, friends of Ronica. You'd think they would be very willing to help their friends out and that they'd be the least likely to request their names withheld considering they'd likely be found out anyways, and with the company they keep you'd think they would be proud of coming out and helping bring down Vic.

If I didn't know any better I'd say Ronica and counsel realized people might find it kind of ..... how do I put it ..... suspicious that out of the so called countless women who've been victimized ..... 3/4 of the women who's accounts have gone on record so far have lived together in the same household for a time.

It makes their dumb opposition to the confidentiality agreement that would be normal in such cases look incredibly weird and counterproductive. But hey, Ron Soye Boye thought he had to pose as the sheepdog of whammen believing and scream to the skies he wanted ABSOLUTELY EVERYTHING public.

Did they realize "everything" would include, well, everything?

Given how unprepared Ron seemed in the deposition compared to Vic? I think a lack of preperation is a common theme that will will be seeing playing out over the next couple of weeks.

I dunno. That might be the case if they didn't depose Vic first. Seems like the deposition knowledge went the other way, since Vic went first.

The twins history is littered with info about how close they were to ron and monica. It is WAY more then just "rented a room for a while". Here is a screen cap of one of them working with ron. There where plenty more of them with ron and monica socially.

This really does put a spike into the credibility of a neutral third party narrative.

These arrangements are all really suspicious. They're supposedly fans and a VA and her cuck for some reason import them into their home and give them jobs at their own workplaces? Were these people all fucking in some degenerate poly thing?

Clearly for the same reason they wanted to go to Vic's room. Because you know what happens when you go to somebody's con room!

You watch shitty satelite TV and eat jellybe-

Sorry. Bad example.

I am of the personal opinion they have had an account on certain cam sites. God's speed trying to find an account though. Soye didn't even have to bring a snack tray for it and they definitely have the thot complex down pat.
