Number 1, definitely number 1. You just know it's gonna be a shit show this is the lawsuit that never stops giving, expect only the highest quality of exceptionalism
I'm expecting it to actually be a really boringly written with vague details and presented like it was filed before the depositions as if it was just late homework.
 
I wonder how shot to shit parts of their argument will be by the affidavit from Dahlin though. They put all this work into a TCPA and then a single affidavit just fucking sinks their entire motion by itself. I sure hope Casey didn't put in a lot of time writing making it all up.

We never knew the name of the person who knocked on the door in her accusation until he was named in the court filings. With their egos, do you really not believe that they'd be so stupid as to name someone that they'd just assume would lie for them?

Nick of all people showed Stan's Affidavit snippet on Twitter with a mild implication that something was interesting about it. This affidavit was never filed anywhere so Nick got it from somebody else involved. This can realistically only have been Ty. An Affidavit Ty is going to file and Nick is intending to show off eventually? That's definitely not something hurting Vic's case.

It's not that I'd put it past them but, from a layman, this feels like the final nail in the coffin for them. I just don't want to celebrate prematurely.

To what extent are lawyers free to talk about a case after it has ended. I'd love to have Casey go on his show after all of this is over because I'm sure that man has some stories to tell. Obviously he's bound to some extent by client-attorney privilege and can't disclose details, but I also wonder if Ron and Monica will try to file a complaint against him or even outright sue him after they get fucking wrecked, in which case I suspect he would be able to far more forthcoming with details, or at least they would show up in court documents.
 
Just as an aside, I cannot imagine Funimation is happy right now with the MoRons. Their absolutely determined effort to get Vic into Deposition prior to the filing of the TCPA motions has meant BHBH can bring up Sabat, Monicas internal emails and all the rest in their count to Funi's effort to get out of this without having to comply with the discovery demands and actually fight the accusations. That entire deposition debacle was brutal because both Ron and Monica claimed authoritatively that it was FUNIMATION who provided the necessary information with which they based their actions. The "investigation".

Funimation can still throw them under the bus later, but at this point its gonna be tough for them to get out of this on a procedural motion designed to prevent frivolous lawsuits. And the worst part? Those depositions were completely unnecessary. They did not have to happen. Everyone could have just filed their initial responses with general defenses and then filed the TCPA the next day. But nooooo. Monica and Ron just had to get Vic under oath and make him squirm. For reasons.

Only explanation I have is they flat out lied to their attorneys and convinced them they could get that sweet GoFundMe money.

Why in the hell would you need an affidavit for that? The school should have a record for it or that firing should follow Vic throughout his whole life. If the school can't corroborate the story the affidavit is only good for toilet paper.
Because they want their rumor mills to be seen as truth so badly that they’ll run with it just to get a few likes and try to pretend the court will give two fucks if it doesn’t pertain to the current lawsuit. They want to use it as a way to say Vic is lible proof.

I noticed that a lot while Marchi’s lawyer was deposing Vic. Nick didn’t pause to address it either so it was fucking fuinnier that he knew we all already saw it.

Were you not paying attention? He was mentioned in Funimation's TCPA and the documents filed by MoRon.
Dahlin was completely unaware he was listed as a witness to Rial's allegation. In his tweets, he seemed to be conveying that Monica's account might not be totally accurate. Also, BHBH seems to have just got his affidavit.
