I'd be sad she drank the koolaid but at this point it's pretty obvious these people are cockroaches in human skin, this whole TCPA filling reads like a greatest hits of all the dogshit they spewed onto twitter. How can this pile of shit be even considered a legal document with it's lack of citations for caselaw or anything?

No, he's just going to say, "go to the jury."

There is a caveat in that if the evidence the defendants are relying on comes from Vic himself (some sort of admission), the judge could rule on the issue as a matter of law and decide there is no factual dispute. I don't think that's going to come into play for Monica and Ron.

This filing is so offensive and I haven't even read the entire thing. If I was the judge, I'd want the attorney's head. I'd want his balls. I'd want him to feel an ounce of the pain he's causing me by forcing me to wade through 490 pages of inadmissible crap and then I'd want him to choke on all 490 pages. But you know, that's just me.

What are the examples of something that they could strike from the filing? Ty seemed to indicate the articles could be struck and other stuff such as some of the affidavits. Wasn't sure what would qualify it.

Anything that isn't provable like the 100 or w/e posts from PULL. Not only are they not admissible, you can't even prove the people are real. Hell I'm pretty sure some of the accusations are from some of our own on troll accounts.

Michele Specht's affidavit, probably. As far as I could tell through my quick skim, it had no relevance to any of the rape/assault allegations, but just showed that Vic was a bit of a scummy cheating tail chaser.

Since its prejudicial value outweighs its probative value, it would probably not bee seen by the jury.

But maybe I'm wrong. My brain is fried.
