I think it's most likely that Vic's encounters were all consensual.
That said, what I am beginning to understand is why the people who worked with or around Vic started to hate him. A lot of people, especially women, are going to feel a bit of empathy for someone in a relationship with a significant other that is brazenly cheating on them. My guess is that it just got to a point where they just despised him for it and wanted him gone.
Still sounds like jealousy to me. Imagine working with a handsome, super great guy who will fuck almost anything but you. Which is what I hope this all stems from since it then makes Ron angry Vic didn't fuck his wife.

Their TCPA in and of itself establishes that the defendants intentions are malicious in nature. Now, due to it being privileged it may not be able to be used against them in an official capacity, but any sane individual can see the writing on the wall just by reading the cover page alone. I'm almost confident that the judge will see this as well, and their little stunt they pulled with their shitshow of a TCPA filing will come back to bite them in the ass.

I never followed RWBY past the first 3 seasons. The whole charm of it was that they literally used 3d custom girl to animate their waifus. It was a full on passion project and it came through in it. That picture looks like generic action magical girl shit. No wonder nobody is watching it.
Pretty much went to shit when Oum died. You can clearly see the transition since everything starts going downhill in every aspect from the second half of the third season.
You could say it was generic anime shit from day 1. Back then, it was high school stuff, now it’s epic adventure after what you knew is destroyed. And it’s not like the writing was ever good. The shift in V3 was after what you could say was a badly done tournament arc.

Nick has stated that Funimation probably has the best chance of winning on TCPA, which I'm inclined to agree with.
However, as more and more info about the Funimation show trial investigation of Vic starts to trickle out, their case is also beginning to look a bit shaky.
It is incredibly difficult, but Toye being a fucking moron really helps with that.
Toye not bothering to confirm the identities of anyone on a forum called pretty ugly little liars and just electing to believe anonymous internet postings from it without making any attempt to verify that it's even more than one person goes beyond negligent. Publishing based wholely on unverified anonymous testimony is actually one of the few things that get you there. Now you could say Toye's publishings weren't based wholely upon that, but he has made other statements that are (100s of wamen, relies on that.). His little I do not recall spiel also means he can't claim to have believed them 100% at the time of publishing. He can say he believes them now, but that's not all that matters.
I suspect that will be enough to overcome actual malice, at least for the purposes of the TCPA. I could certainly be 100% wrong.
For Monica, since Vic's position is that she's currently lying about their alleged encounter in a hotel room, maintaining the lie would probably be to be knowingly and willfully lying. His claims that Marchi is lying are a little less solid because it's more interpretive of a root event that both people claim happened.
I think Marchi wins her TCPA. Funi is a toss up. I think Monica might have the worst shot at TCPA actually. Since Vic is alleging that she's lying, her alleged lying would be knowing and willful unless she's insane. Ron probably loses his for being a complete dumbass and admitting that he used anonymous sourcing froma forum with liars in the title, believed it unquestioningly, and proceeded to prevent himself from being able to claim he believed them 100% at the time he published them.
Aren’t Monica and Ron joined at the hip as defendants though? If anything, Monica May cancel out Ron for not being as jarringly bad.
I suspect Jamie is the most practical of them who has actually had to hustle in life a bit. I suspect when actual consequences came into play her first priority became making sure she wasn't part of them rather than public sympathy and trying to further smear Vic.

He's a strip mall attorney whose practice is similar to Nicks. He represents people who got DUI's, arrested for shoplifting, petty assaults etc. Basically he has alot of experience with clients who are Fucked with a capital "F". Monica and Ron went online and went to find some slick corporate lawyers with fancy office buildings and expensive "super lawyer" credentials. That type of Attorney is fine...if you are willing to blow through 100,000 dollars in the span of a few months. They are able to pull on tremendous assets to get you out of trouble. But Monica and Ron can't pay for those services so they are getting the absolute bare fucking minimum effort out of their attorneys.
Isn’t there some kind of code like a Hippocratic path where you have to do your damndest to the best of your ability to your client? Being a lawyer must be fun.

Been thinking about Rooster Teeth.
They are sister studio's to Crunchy Roll and Cartoon Network/Adult Swim. How many contacts do you think they have in the anime industry? If they have the contacts then Rooster Teeth has the facilities to do dubbing. And since Funimation's reputation will be marred by this debacle, well, there might be an opportunity for a new company to do anime.
Also Rooster Teeth is quiet because they aren't getting sued. They figure they are all covered legally.
I had figured that RT would back down because the overtime problems, this whole lawsuit going to shit on their side, and finally a subscription price increase to add insult to injury.
But they hired a voice actor to replace Vic and they cropped Qrow out of the iTunes banner.
So I'm guessing they will have to be looking down the barrel of a lawsuit before they change anything.
By then it will be too late. Their flagship show will be marred by this controversy. Their reputation will be destroyed because management stood by as their company was weaponized against an innocent man.
I hope it was worth it Rooster Teeth. I really do.
While I think Rooster Teeth as a company going down in flames or incurring the wrath of corporate overlords is unlikely, they didn’t need to fire Vic to hurt their reputation outside of their little bubble. Volumes 5 and 6 of RWBY did that on its own. A lot of good Will has been lost amongst the non diehards and volume 6 alone has some people putting RWBY and/or RT as a whole on #GetWokeGoBroke watch.
