IANAL, but a TCPA is supposed to just be a statement that says "they're oppressing my first amendment rights, here's why, suck my dick." Reading their TCPA, I'm not really getting the whole "HERE'S WHY" part. The oppressing and dick sucking is there, but not the actual important part. So my question is, how easy would it be for BHBH to defeat the TCPA for the individual parties? I'm most interested in Funimation, since the claim there is the flimsiest.

That's pretty much what a TCPA is supposed to be, yeah. And it's a special type of request for summary judgement, and in general the more complicated your argument is for summary judgement, the more it implicitly argues for the case to go to a full trial to sort out. The right to petition the government for redress of grievances - in other words, to have your day in court - is only denied in exceptional circumstances. Curtailing the right of redress of one person to protect the public participation rights of another is the point of a TCPA, but the courts definitely want to reserve that for circumstances where the defendants can clearly make that case. If the plaintiff can bring up specific evidence and show that they arguably could have a case, they get to move past the TCPA.

MoRonica's TCPA reads like a giant pile of bullshit attempting to prejudice the judge against Vic, and I'm hoping that Judge Chupp sees right through that bullshit. Funimation's is on pretty shaky ground too - they don't argue that what they said was true, merely that they technically didn't say that Vic was fired for harassment. BHBH has plenty of precedent to site that says that literally true facts with a defamatory gist are, indeed, defamatory. They almost certainly get through the TCPA for defamation, which I think will drag the civil conspiracy and vicarious liability causes through to trial as well (but it's more up in the air).
