I think you're giving too much credit to her story that may as well have not happened at all, given the fact that Dahlin just straight up doesn't remember the incident as opposed to just remembering it differently-- not to mention, like McConnell, Vic isn't asked about this incident at all during his deposition.

Never mind that it didn't serve as an element of the investigation levied against him.

I'd take law Twitter a lot more seriously if they ever acknowledged any weaknesses in the cases of the defendants but they never do - which makes them nothing more than a cheer squad.

Without knowing future affidavits and Nick's cockteasing bullshit:

1) I'm 99% Confident Monica's TCPA is DoA thanks to that Stan Dahlin affidavit. It shreds apart her claims of assault, makes her a liar. Most of what is included is prejudicial. They argue on damages, they don't argue on defamation, basically admitting to it. It looks extremely unprofessional and more like a forum post than a law document. How you can't see this extraordinarily weak TCPA for what it is, you'd have to be fucking blind. Ron also contacted conventions as well, which goes to Civil Conspiracy.

2) I'm about 65% sure about Funimation. Corps are notoriously tough and with very loose labor laws, on its face Funi seems like it has the best chance to beat it. Though what discounts their favor is that Ty and Co. can say that their investigation was incompetently done due to not revealing the Monica story or implying they conspired with Monica. They can also say they inadvertently accused Vic of crimes of which he has never been charged, defaming him and damaging him. So inept investigation that never revealed the Monica incident, possible conspiring and not telling Vic, implying Vic was accused of actual crimes. I guess this is the more controversial stance since everyone says Funi has the best chance to win. I don't think it does though.

2) I'm about 60% sure about Marchi TCPA dying. Out of everyone, hers seems like the best chance to beat it. The problem is that she claimed assault, has constant details changing and made malicious Tweets. I think the way this dies if they have a way to prove that she contacted conventions or strong-armed other voice actors and Funimation higher-ups to fire Vic.

These lawyers are so stupid, they try and use Twitter like a forum site with these bloated multitagging posts. You'd think they could just get their ex-computer scientist to use one of the numerous free forum site templates out there to create a place for them to discuss without looking like a bunch of tech illiterates.

Then again, their tech expert managed to screw up a Hello World variant by using printf() without a \n to actually format the fucking output, so I can only assume he flunked out of programming harder than he flunked out of parenting. If he were capable of coding even remotely competently, he would not be in the kind of debt he's presently in.

I think if Chupp is doing what he apparently plans to do and weigh all the TCPA's on their merits at the same time, all three are DOA.

All three cover the same basic facts and territory, and if Chupp is the type to want the wheat separated from the chaff and to make sure each holds water since they are to some extent relevant to the others, the sheer weight of inconsistency will kill all three.

I agree Funimation would have the best chance if divorced from the others, but if reviewed alongside the others, their pisspoor vetting of evidence and shafting of Vic on the dubious evidence of people with all sorts of motives to screw him for their own gain just makes Funimation look bad enough that TCPA success gets swept off the table.
